The Lawyer Turns Peacemaker, Richard C. Reuben
The Lawyer Turns Peacemaker, Richard C. Reuben

No doubt millions of people and businesses have benefited from simpler, less stressful modes of dispute resolution. Moreover, ADR is primed for much greater growth, as witnessed by the breathtaking expansion of court-related programs, the rush of lawyers and nonlawyers alike to mediation training seminars, and the pledge of thousands of businesses and large law firms to consider ADR options. But the child born of necessity is still, at best, teetering between adolescence and adulthood. For all of its potential to reshape the ways problems are solved, it still shows a dark side-coercion, conflicts, competency issues and commercialism -that leaves …

Guardians: A Research Note, Chris Guthrie, Lawrence M. Friedman, Joanna L. Grossman
Guardians: A Research Note, Chris Guthrie, Lawrence M. Friedman, Joanna L. Grossman
Vanderbilt Law School Faculty Publications
Guardianship goes back quite far in legal history; it has been a feature of American law since the colonial period. Something like guardianship is a necessity in a system that recognizes private ownership of property, while dividing the world into those who are, and those who are not, sui juris-that is, fully capable of acting on their own. The boundaries between these two domains can be quite indistinct. Defining who is insane or incompetent can be especially problematic because these categories are socially and culturally variable. Most people committed in 1900, for example, would hardly be considered insane today; they …

Hozho Nahasdlii--We Are Now In Good Relations: Navajo Restorative Justice, Robert Yazzie
Hozho Nahasdlii--We Are Now In Good Relations: Navajo Restorative Justice, Robert Yazzie
St. Thomas Law Review
Having illustrated American adjudication in a Western-style police model of justice, this essay will focus on Navajo justice concepts. It will show why, aside from the breakdown of police and social-work models within the Western-styled justice system, many Navajos prefer their traditional system of justice. As will be shown, the Navajo system of justice is based upon discussion, consensus, relative need, and healing. It is "restorative justice," which puts people in good relations with each other, and in continuing relationships. The Navajo system is "horizontal" or egalitarian law. It is illustrated as a circle where everyone is equal. In contrast, …

Developments In Liability Theories And Defenses, Robert A. Destro

Litigators with experience in the field of religious liberty believe that courts do not seem to take religious liberty claims and defenses very seriously; however, it is difficult to know why. To be sure, the anecdotal evidence is certainly there, not only in the reported cases, but also in the actual courtroom experiences of those who attempt to raise religious liberty claims and defenses. In one Texas tort case, a trial court judge stated that she would not permit the Church "to hide behind the first amendment;" in a Maryland case a number of years ago, I was asked by …

Ensuring Effective Communication: The Duty Of Health Care Providers To Supply Sign Language Interpreters For Deaf Patients, Elizabeth Ellen Chilton
Ensuring Effective Communication: The Duty Of Health Care Providers To Supply Sign Language Interpreters For Deaf Patients, Elizabeth Ellen Chilton
UC Law Journal
When a profoundly deaf patient arrives for treatment at a hospital or doctor's office, how should communication barriers be overcome? Are sign language interpreters always required? Who is responsible for coordinating and paying for interpreting services? Many health care providers are uncertain about the answers to these questions and are unaware of their legal duty to establish effective communication with their deaf patients. Consequently, patients encounter considerable difficulty in getting sign language interpretation in medical settings. Many health care providers lack comprehensive policies for the provision of sign language interpreters. In addition, doctors practicing in their own offices are reluctant …

Political Lawyering, One Person At A Time: The Challenge Of Legal Work Against Domestic Violence For The Impact Litigation/Client Service Debate, Peter Margulies
Michigan Journal of Gender & Law
The premise of this Article is that, in his assertion that client service work is political lawyering, Ralph Reed is right. Indeed, Gary Bellow made a similar point about the political content of both impact litigation and client service work in a classic article written almost twenty years ago. Of course, Reed and Bellow are hardly ideological soulmates. Reed disapproves of the political content of service work, while Bellow heartily endorses it. On that point, this Article sides with Bellow. It employs the example of domestic violence lawyering to demonstrate why Bellow and Reed are correct that client service work …
