The Logic Of Peace, Jonathan Schell Sep 2003

The Logic Of Peace, Jonathan Schell

New England Journal of Public Policy

Jonathan Schell’s The Unconquerable World points the way out of the devastation of the twentieth century toward another, more peaceful path. And his investigations into the great nonviolent events of modern times — from Gandhi’s independence movement in India to the explosion of civic activity that brought about the surprising collapse of the Soviet Union — suggest foundations of an entirely new kind on which to construct an enduring peace. As Schell makes clear, all-out war, with its risk of human extinction, must cease to play the role of final arbiter. “The Logic of Peace,” printed here, is the final …

Norms, Rationality, And Communication: A Reputation Theory Of Social Norms, Andreas Engert Sep 2003

Norms, Rationality, And Communication: A Reputation Theory Of Social Norms, Andreas Engert

ExpressO

Does the discovery of "law and social norms" necessitate breaking with the rational choice paradigm? In this paper, I argue for an answer in the negative. To this end, I propose a reputation theory of social norms, which differs from other proposals in two principal respects: First, it explains norms without any assumption of behavioral constraints (like habit or conscience) and normative motivations (like altruism or aspiration to esteem). Second, it does even without any assumption regarding model-exogenous, private information that most other reputation and signaling explanations use (such as the discount rate in Eric Posner's signaling model).

Instead, reputation …

Group Therapy For Incarcerated Women Who Experienced Interpersonal Violence: A Pilot Study, Rebekah G. Bradley, Diane R. Follingstad Aug 2003

Group Therapy For Incarcerated Women Who Experienced Interpersonal Violence: A Pilot Study, Rebekah G. Bradley, Diane R. Follingstad

CRVAW Faculty Journal Articles

This study evaluated effectiveness of group therapy for incarcerated women with histories of childhood sexual and/or physical abuse. The intervention was based on a two-stage model of trauma treatment and included Dialectical Behavior Therapy skills and writing assignments. We randomly assigned 24 participants to group treatment (13 completed) and 25 to a no-contact comparison condition (18 completed). We evaluated treatment effects, using the Beck Depression Inventory, Inventory of Interpersonal Problems, and Trauma Symptom Inventory. The data demonstrate significant reductions in PTSD, mood, and interpersonal symptoms in the treatment group.

All-Inclusive List of Electronic Theses and Dissertations

The Second Great Awakening spurred the moral reform campaign dealing with prostitution in the United States. In the nineteenth century as public areas were being segregated specifically for prostitution anti-vice reformers engaged in a discourse over the allocation of what historian Mary P. Ryan calls "public space." Beginning with the Progressive Era and the onset of the white slave trade, reformers shifted their attention from the regulation to the abolition of prostitution. Social hygiene and sex education became a part of the reform dialogue. Most major cities of this time eradicated the officially sanctioned Red Light District. However, the mid-western …

The Rights Of Parents With Children In Foster Care: Removals Arising From Economic Hardship And The Predicative Power Of Race, Ann Cammett, Megan Mclaughlin, Martin Guggenheim, Sharonne Salaam, Nanette Schorr

City University of New York Law Review

The following symposium at the Association of the Bar of the City of New York explores the predicament posed by the surge of child removals through neglect petitions, and the subsequent placement of those children in foster care. The panel, whose comments are published here, offer some poignant reflections on the crisis of the child welfare system.

Context And Pretext In Conflict Resolution, Kevin Avruch Jul 2003

Context And Pretext In Conflict Resolution, Kevin Avruch

Journal of Dispute Resolution

In this essay, I want to reflect on some of the problems raised by context and pretext from a different angle. I want to first consider some aspects of the varied contexts in which conflict resolution and alternative dispute resolution (ADR) developed in the United States, particularly in the academy. Historically, there have been some differences between the two, partly evident in the different meanings of the notion of "dispute" adopted by theorists and practitioners. I then want to examine some of the underlying pretexts for doing this work, and some possible consequences-especially as we more frequently engage in the …

Correspondences And Contradictions In International And Domestic Conflict Resolution: Lessons From General Theory And Varied Contexts, Carrie Menkel-Meadow

Journal of Dispute Resolution

Does the field of conflict resolution have any broadly applicable theories that "work" across the different domains of international and domestic conflict? Or, are contexts, participants, and resources so "domain" specific and variable that only "thick descriptions" of particular contexts will do? These are important questions which have been plaguing me in this depressing time for conflict resolution professionals, from September 11, 2001 (9/11), to the war against Iraq. Have we learned anything about conflict resolution that really does improve our ability to describe, predict, and act to reduce unnecessary and harmful conflict? These are the questions I want to …

From The Ne’Er-Do-Well To The Criminal History Category: The Refinement Of The Actuarial Model In Criminal Law, Bernard E. Harcourt Jul 2003

From The Ne’Er-Do-Well To The Criminal History Category: The Refinement Of The Actuarial Model In Criminal Law, Bernard E. Harcourt

Law and Contemporary Problems

Harcourt discusses three developments in 20th century criminal law: the evolution of parole board decision-making in the early 20th century, the development of fixed sentencing guidelines in the late 20th century, and the growth of criminal profiling as a formal law enforcement tool since the 1960s. In each of these case studies, he focuses on the criminal law decision-making.

Dead To Rights: A Father's Struggle To Secure Mental Health Services For His Son. Georgetown Journal On Poverty Law And Policy, April Land

Faculty Scholarship

This Article analyzes the gap between children's statutory rights and their actual access to services within the educational, medical and juvenile justice systems. This Article lays out the strong statutory rights and protections in the areas of special education and contrasts them with actual experience in trying to secure appropriate education, Medicaid and the juvenile justice system. The Article concludes that the agencies responsible for administering federal law must not be permitted to continue to avoid compliance with clear statutory mandates. They are failing to meet their legal responsibilities by asserting that services should be provided by other agencies, rather …

Perfect Substitutes Or The Real Thing?, Naomi Cahn Apr 2003

Perfect Substitutes Or The Real Thing?, Naomi Cahn

Duke Law Journal

This Article traces the development of adoption law using recent scholarship in history and sociology, as well as nineteenth century legal sources. The early history of American adoption provides a novel and useful context to analyze the complicated relationships between "traditional" and "alternative" family forms. The Article discusses how judicial interpretations of the meaning of adoption were cabined by the traditional significance of blood relationships, and examines the treatment of adopted and biological children in three contexts: parental consent to adoption, inheritance, and the civil and criminal laws governing incest. The Article argues that the challenge today, as was true …

The Importance Of Purpose In Probation Decision Making, Wayne A. Logan Jan 2003

The Importance Of Purpose In Probation Decision Making, Wayne A. Logan

Scholarly Publications

Articulation of purpose is, and should be, an important feature of any governmental activity. Since 1962, and the publication of the Model Penal Code, governments have increasingly seen fit to identify the purposes of punishment. To the extent such purposes have been expressly identified, however, they have primarily related to imprisonment, informing the duration inquiry. Governments have been far less dedicated to the articulation of the purposes of probation, a disposition that today easily accounts for the majority of penal outcomes in U.S. courts. This paper explores the role of purpose in probation decision making. It begins with a historical …
