Locked Out And Locked Up: Assessing The Relationship Between Housing Instability And Recidivism For People With Criminal Drug Records Using A General Strain Theory Framework, Mark Paul Plassmeyer
Electronic Theses and Dissertations
More than 32.5 million Americans have been arrested for drug offenses since 1996 contributing to the fact that currently nearly as many Americans have a criminal record as a college degree. After an arrest for a drug offense, often regardless of whether one is convicted, people are subject to civil penalties known as collateral sanctions. These sanctions include restrictions on access to subsidized housing, financial benefits, student loans, employment, and important aspects of civic life such as voting or holding office.
Due to recent recidivism rates - over 75% for people exiting prison with a drug record - researchers and …

Few of us give much thought to local laws, yet local laws, such as zoning and other land use regulations, have an abiding influence on our lives. Think for a few moments about the types of businesses located near your home. Are these businesses places you frequent? Considering socio-economics, how do land uses differ from locale to locale throughout your city or state? Do all citizens have an equal voice in the land use approval process? The answer is likely no, which creates environmental and economic justice issues.
Like all businesses, when it comes to payday lenders, geography matters. Payday …

“Mlk 50: Where Do We Go From Here?" Teaching The Memphis Civil Rights Movement Through A Therapeutic Jurisprudence Lens, Christina A. Zawisza
Belmont Law Review
As the nation pauses to commemorate the 50th anniversary of the assassination of Dr. Martin Luther King, Jr. on April 4, 1968, in Memphis, Tennessee, it is imperative that we study the epic civil rights history of Memphis which preceded this dreadful event, especially in the legal academy. Therapeutic Jurisprudence (TJ), with its focus on laws, legal processes, and legal actors, and the extent to which they can be therapeutic or antitherapeutic, is a fitting academic vantage point. The TJ repertoire of principles and techniques and the “genius loci,” a spirit of time and place which comes from the field …
The Effect Of Family And Social Support On Suicidal Ideation In Jails, Megan L. Small
The Effect Of Family And Social Support On Suicidal Ideation In Jails, Megan L. Small
Honors Undergraduate Theses
Suicidal ideation and associated behaviors are up to four times more common among jail inmates than the general community (Jenkins et al., 2005; Hayes, 1986). Research finds a variety of social, biological, and psychological factors interact to influence suicidal thoughts of incarcerated individuals (Bonner, 1992; Borrill et al., 2005). Particularly, psychological distress such as, depression and feelings of hopelessness, along with loss of social support and decreased feelings of connectedness have been linked to suicidal ideation and behaviors (Moscicki, 1997; Hawton & van Heeringen, 2009). Recently, the Centers for Disease Control and Prevention (2017) has emphasized the importance of connectedness …

This retrospective study surveyed decision-making and challenges among 78 gay cisgender male couples utilizing in-vitro fertilization (IVF) and a gestational carrier. While most couples (67.1%) found the decision to actively pursue fertility treatment ‘not difficult’, 32.9% felt that it was ‘somewhat difficult’ or ‘very or extremely difficult’. Almost 30% of couples had not undertaken financial planning for treatment, which introduced delays of N2 years for 25.3% of participants. Conceiving twins was ‘important to very important’ in 52.3% of couples, and 84.2% of couples chose to transfer two embryos to ‘increase the odds’ or reach an ideal family size in a …

Women In Ministry: How Conflicts Between God's Purpose And Church Doctrine Impact The Efficacy Of Female Church Leaders, Nicole L. Davis
Department of Conflict Resolution Studies Theses and Dissertations
The following research was a biographical narrative that examined the lived experiences of male and female church leaders and their perspectives on the social, moral, and religious implications of female church leadership. The purpose of this research was to explore the ideologies and identities of women leaders within the faith ministry, the definitions of ministry and leadership, the role of women in church ministry, and their understanding of marketplace ministry. I employed conflict resolution theories relating to power, change, and mental modeling as the basis of analysis for evaluating the impact of church policies and practices on the utilization of …
Keeping It In The Family: Minor Guardianship As Private Child Protection, Deirdre Smith
Keeping It In The Family: Minor Guardianship As Private Child Protection, Deirdre Smith
Faculty Publications
Due to the opioid use epidemic and an overwhelmed public child protection system, minor guardianship is an increasingly important tool for relative caregivers seeking to obtain legal authority regarding the children who come into their care because of a parent’s crisis. Yet minor guardianship originated in colonial law for an entirely different purpose: to protect legal orphans who had inherited property. Today’s guardianship laws are still based on this “orphan model” which does not fit today’s reality. This Article is the first to analyze how these outdated guardianship laws are being used as a form of “private child protection” and …

Faire Valoir Ses Droits À La Chambre De La Jeunesse : État Des Lieux Des Barrières Structurelles À L’Accès À La Justice Des Familles, Emmanuelle Bernheim, Marilyn Coupienne
Canadian Journal of Family Law
Hong Kong's Children Proceedings (Parental Responsibility) Bill: Comparative Family Law Reform And Multidisciplinary Collaboration, Katherine Lynch
Hong Kong's Children Proceedings (Parental Responsibility) Bill: Comparative Family Law Reform And Multidisciplinary Collaboration, Katherine Lynch
Canadian Journal of Family Law
Many comprehensive reviews of family justice systems have been undertaken in common law jurisdictions over the past 20 years, all seeking to provide more meaningful affordable access to justice for families and children. Hong Kong is also under pressure to enact legislative reforms originally proposed in 2002-2005 which deal with children’s matters and more broadly, with family and matrimonial issues. Legislative reform was anticipated when the Government announced the long awaited Children’s Proceedings (Parental Responsibility) Bill (“Children’s Bill”) in 2015. After significant public consultation, however, the Government announced in 2018 that it would delay implementation of this draft legislation. Unfortunately, …

Transforming Deportation Defense: Lessons Learned From The Nation’S First Public Defender Program For Detained Immigrants, Talia Peleg, Ruben Loyo
Transforming Deportation Defense: Lessons Learned From The Nation’S First Public Defender Program For Detained Immigrants, Talia Peleg, Ruben Loyo
City University of New York Law Review
The unprecedented pace of deportations in recent years has led to increased investment, at the local level, in the provision of high volume legal services to immigrants facing deportation. Each investment in greater legal representation of noncitizens offers unique opportunities to raise the bar in a practice area that has been plagued by low quality representation and to experiment with institutional design as the immigration system slowly but surely moves toward a civil Gideon system. This paper takes a look at questions of institutional design and attorney practice norms within the context of the New York Immigrant Family Unity Project …

The Stakes Of Smart Contracts, Mark Verstraete
The Stakes Of Smart Contracts, Mark Verstraete
Loyola University Chicago Law Journal
By consensus, smart contracts are a revolution in private ordering: They offer guaranteed enforcement, independent of the whims of territorial governments; efficient formation and interpretation; immunity from external interference; and complete deference to the parties’ wishes. Each of these claims is a myth. While smart contracts present themselves as natural and neutral, they are in fact deeply politicized. The Legal Realists tore down the foundations of smart contracts almost a century ago. Advocates for them have not solved the problems of the past—they have forgotten them.
This Article offers a new critique of the optimism about smart contracts and desirability …
