Framing Legislation Banning The "Gay And Trans Panic" Defenses, Jordan Blair Woods
University of Richmond Law Review
This Article, prepared for the University of Richmond Law Reviewsymposium commemorating the fiftieth anniversary of the Stonewall Riots of 1969, uses the Stonewall Riots as an opportunity to analyze and theorize the political dimensions of legislation banning the gay and trans panic defenses. As a moment of resistance to state violence against LGBTQ people, the Stonewall Riots are a useful platform to examine the historical and current relationship between the state and the gay and trans panic defenses. Drawing on original readings of medical literature, this Article brings the historical role of the state in the growth of gay …

Epistemic Corporate Culture: Knowledge, Common Knowledge, And Professional Oaths, Boudewijn De Bruin
Seattle University Law Review
This Article does not assume that professional oaths accomplish what they are intended to do. Yet, I believe that oaths can fulfill important functions once they are crafted as part of carefully designed, more comprehensive approaches to managing ethical culture. Or better, I believe that by investigating more closely what an oath really is and what its preconditions are, we may gain insights that will help to change corporate culture for the better, even if companies do not wish to adopt oaths to manage ethics. Methodologically, this Article is grounded in various strands of philosophical research. In particular, I build …

Israeli Perspectives On Alternative Dispute Resolution And Justice, Omer Shapira
Pepperdine Dispute Resolution Law Journal
Israel is a highly litigious country with an overburdened legal system infected with delays. In addition, Israeli society is highly diversified and saturated with social disagreements and rifts between groups. This article identifies two concepts of justice in ADR discourse in Israel—Justice as Efficiency and Justice Beyond Efficiency—and illustrates their application in the context of several ADR developments in the court system, community mediation, the education system, environmental conflicts, and complaints against public bodies. Using these visions of justice, the article explores the justice goals of ADR in Israel, assesses whether they have been achieved, and considers the future of …

New York’S Raise The Age Law: Restoring The Juvenile Justice System Leaves Courts Legislating From The Bench, Sara V. Gomes
New York’S Raise The Age Law: Restoring The Juvenile Justice System Leaves Courts Legislating From The Bench, Sara V. Gomes
Pace Law Review
With New York’s enactment of the Raise the Age law, the State’s Legislature codified the omnipresent notion that juveniles processed in the criminal justice system should be treated differently than adults given that they are inherently less culpable for a multitude of reasons, both measurable and incalculable. Flaws emanating from the minutiae of the Raise the Age law have surfaced since it became effective on October 1, 2018, as criminal matters involving sixteen-year-old offenders have been adjudicated in courts following the newly introduced procedures for removal of cases involving these youth to Family Court, or the newly-created Youth Part. Simultaneously, …

Does Nepa Help Or Harm Esa Critical Habitat Designations? An Assessment Of Over 600 Critical Habitat Rules, John C. Ruple, Michael J. Tanana, Merrill M. Williams
Wallace Stegner Center for Land, Resources, and the Environment publications
This paper tests whether impact analysis pursuant to the National Environmental Policy Act delays federal decision making, and whether the NEPA process results in significant changes to the substance of federal decisions. We reviewed 636 rules designating critical habitat for species that are protected by the Endangered Species Act. Because of a circuit court split, some of these rules were subject to NEPA analysis while others were not. In comparing these two groups we found that rules that underwent NEPA analysis were completed more than three months faster than rules that were exempted from NEPA review. We also found that …

Introducing Homeschooling Students To The Librarian Profession And Personality Types, Paul Mclaughlin

The librarian profession needs diversity in its membership to provide service to the variety of patrons who visit libraries and to have the array of skills needed for a library to succeed. Jaeger and Franklin (2017, 23–24) have encouraged the use of inclusive services and outreach programs that take advantage of the diversity inherent in the United States’ population to stir interest in the librarianship profession. Homeschooling students come from a variety of cultural and social backgrounds and rely on public libraries to gain access to curriculum materials, educational programming, and technology. School Safety In Rural Settings, Daniel W. Eadens, Larry Walker, Vasily Yurin
Faculty Scholarship and Creative Works
Extreme violence is in our communities and sometimes flows into our schools. Read no further than the local newspapers if you want to see the impact on campus: physical violence, serious injury, suicide, mental crises, and threats with deadly weapon. In fact, the first documented school shooting in this country occurred in the year 1764 in rural Pennsylvania (Keenan & Rush, 2016). Unfortunately, shootings continue to plague our society and occur on rural school campuses today. Are rural schools safe? Is there a way to better predict school violence so it can be prevented? What kind of rural schools are …
Prosecuting Members Of Defense Legal Teams And Its Ethical Implications For The Prosecutor: A Proposal For A New Ethical Standard, Belle Yan
Hastings Journal of Crime and Punishment
This Note explores improprieties and conflicts of interest that may arise when a prosecutor’s office investigates and files charges against defense counsel or a member of the defense legal team. Specifically, this Note focuses on such investigations and charges that arise from defense counsel’s representation of a defendant whom the same prosecutor’s office is prosecuting. The intimately adversarial and professional relationships between prosecutors and defense attorneys taint the legitimacy of any charges against defense counsel for alleged misconduct. The ethical standard proposed here suggests a non-waivable conflict of interest. This would assist the prosecutor’s office in avoiding the appearance of …

Promise Amid Peril: Prea's Efforts To Regulate An End To Prison Rape, Brenda V. Smith
Scholarly Articles in Law Reviews & Journals
This Article discusses the modest aspirations of the Prison Rape Elimination Act (“PREA”) that passed unanimously in the United States Congress in 2003. The Article posits that PREA created opportunities for holding correctional authorities accountable by creating a baseline for safety and setting more transparent expectations for agencies’ practices for protecting prisoners from sexual abuse. Additionally, the Article posits that PREA enhanced the evolving standards of decency for the Eighth Amendment and articulated clear expectations of correctional authorities to provide sexual safety for people in custody.

Special Education By Zip Code: Creating Equitable Child Find Policies, Crystal Grant

It is estimated that more than 1.3 million youth in the United States have a disability. One in four American adults have a disability that impacts major life activities. With disability rates this high, our nation must prioritize efforts to ensure that all children with disabilities and in need of special education are identified and receive the support they need in school. Congress, through the Individuals with Disabilities Education Act (IDEA), mandated that all public schools locate, identify and evaluate all students suspected of having a disability. The special education community refers to this affirmative duty as “child find.” Unfortunately, …
