Before Jones confesses his crimes to Imam Ahmad, he should be clear on the duties and role of the imam of a mosque. The imam's duties usually consist of leading prayers and providing advice and assistance to those in the community who seek them. Imams are chosen for their knowledge in matters of religion. It is possible, however, that the community has more knowledgeable persons within it who are not interested in the position of imam. In such cases, when a more knowledgeable person visits the mosque, the Muslims present at that time, including the imam, may choose that visitor …

The Death Wish Of Late Modern Euro-American Culture And The Spiritual Wisdom Of The Ancient Native Peoples, Joe Holland
The Death Wish Of Late Modern Euro-American Culture And The Spiritual Wisdom Of The Ancient Native Peoples, Joe Holland
St. Thomas Law Review
In particular, this article addresses certain negative aspects of Euro-American culture. There are, of course, powerfully positive and creative aspects to this same culture. But if one went to a physician because of lung cancer, one would not wish that the physician devote time to praising the good functioning of one's digestive system. Instead, one would wish that the physician address the life threatening pathology. That is what I will do here.

God and femininity share similar positions of marginalization within the law and the legal academy: the classic division between home and business and the “feminine world of morality and love and the realm of “tough” survival skills and competition.” This marginalization, coupled with facets of American traditions, preclude progress from being achieved with respect to either, because neither is significantly part of the American public discourse, and the introduction of either is frowned upon within the academy. This marginalization is evinced by the work of people such as Michael Novak, who painted God as a small-time entrepreneur in his endeavor …
On Being A Muslim Corporate Lawyer, Azizah Y. Al-Hibri
On Being A Muslim Corporate Lawyer, Azizah Y. Al-Hibri

It appears to me that religion subconsciously informs our individual professional practice and that a non-humanitarian form of secularism has quietly shaped our corporate laws. The attendant dissonance causes severe dissatisfaction, and at times even disfunction, in our society. The claim that our present corporate laws are imbued with a non-humanist secularist perspective deserves closer examination from a religious vantage point. Given our constitutional guarantees, our present legal structure appears to place undue burdens on persons of faith in this country. A more just balance between religious and various forms of secular perspectives is, I submit, a worthy goal for …
"The Harvest Is Plentiful, But The Laborers Are Few": Hiring Practices And Religiously Affiliated Universities, Robert John Araujo
"The Harvest Is Plentiful, But The Laborers Are Few": Hiring Practices And Religiously Affiliated Universities, Robert John Araujo
University of Richmond Law Review
This is a paper with a modest goal about an immodest topic: how mankind does God's work in this world. In particular, I address a small part of this rather large question: how do religiously affiliated schools make their modest contribution to this work? More particularly, who gets chosen to be a laborer in bringing in the plentiful harvest. The laborer is the teacher or administrator, the vineyard is the religiously affiliated university or college of the late twentieth century United States. Consequently, I address employment practices: who gets hired as a laborer and by what criteria is this special …

States Overstepping The Constitutional Bounds In Religious Activities As Demonstrated In Abington V. Schempp, James J. Dickey
Brigham Young University Prelaw Review
Do states overstep constitutional bounds when they conduct religious exercises? This is the question argued before the Supreme Court in 1963 in the landmark case School District of Abington Township, Pennsylvania, et al. v. Edward Lewis Schempp et al. (Abington v. Schempp) (374 U.S. 203). This paper will answer the previously asked question by addressing the following areas as they relate to the Abington v. Schempp case:
-
Facts of the case
-
Arguments of each side of the case
-
Majority and minority opinions of the Justices
-
Opinion of prominent writers
-
My personal opinion

A Restatement Of The Supreme Court's Law Of Religious Freedom: Coherence, Conflict Or Chaos?, Carl H. Esbeck
A Restatement Of The Supreme Court's Law Of Religious Freedom: Coherence, Conflict Or Chaos?, Carl H. Esbeck
Faculty Publications
Religious freedom as guaranteed in the First Amendment makes religious pluralism more likely, while pluralism makes the maintenance of religious freedom as a fundamental civil right more necessary. It seems there is a limit, however, to the expansion of America's religious pluralism that, when exceeded, shatters cultural consensus thus rendering impossible the political and civil discourse necessary to sustain democratic institutions.1 This follows because pluralism promises freedom but exacts a price in civic disunity and moral confusion. The question thereby resolves itself into just how a religiously diverse people are to live together, despite their deepest differences, while sharing in …
