Title : Divinity doctrine in the Arab Thought

Many religious, social and anthropological studies show that divinity in societies in general and in Arab societies in particular is enmeshed with human existence itself. That is, from Adam and on , divinity in societies underwent several changes. The prophets were the one charged to correct doctrines throughout human history .Nowadays, contemporary reality tells us that The Holy Prophet Muhammad is the seal of all prophets and that no other divine prophet will follow both in the Arab world or elsewhere.

This Is Minnesota: An Analysis Of Disparities In Black Student Enrollment At The University Of Minnesota Law School And The Effects Of Systemic Barriers To Black Representation In The Law, Maleah Riley-Brown, Samia Osman, Justice C. Shannon, Yemaya Hanna

Minnesota Law Review Headnotes, Vols. 94-106 (2009-2022)

Lawyers often occupy powerful positions in our society and can have a profound impact in designing and changing laws, influencing major policy regimes, and leading cities and communities. Further, the law is often lauded as a method to promote a system of justice and fairness. But for too long, the law has enforced a system of justice based in White supremacy and oppression. Laws were designed and implemented to steal land from indigenous communities, to enslave and oppress Africans, and to force Japanese-Americans into internment camps, amongst many other atrocities. To this day, the law is used to both expand …

The Threat Of Deepfakes In Litigation: Raising The Authentication Bar To Combat Falsehood, Agnieszka Mcpeak Feb 2021

The Threat Of Deepfakes In Litigation: Raising The Authentication Bar To Combat Falsehood, Agnieszka Mcpeak

Vanderbilt Journal of Entertainment & Technology Law

Deepfakes are all over the internet—from shape-shifting comedians and incoherent politicians to disturbingly realistic fake pornography. Emerging technology makes it easier than ever to create a convincing deepfake. What used to take significant time and money to develop is now widely available, often for free, thanks to rapid advances in deepfake technology.

Deepfakes threaten individual rights and even democracy. But their impact on litigation should not be overlooked. The US adversarial system of justice is built on a foundation of seeking out the truth to arrive at a just result. The Federal Rules of Evidence serve as an important framework …

The Legal Framework Of Apostasy In Egypt: A Manifestation Of Secular Reconstruction Of Sharia By A Modern State, Ahmed Sedky Mohammed Jan 2021

The Legal Framework Of Apostasy In Egypt: A Manifestation Of Secular Reconstruction Of Sharia By A Modern State, Ahmed Sedky Mohammed

Theses and Dissertations

The legal consequences of renouncing Islam or apostasy, which include depriving the apostate from some civil rights, and the non-recognition of the act itself by law in Egypt have been usually criticized as a blatant violation of the right to religious freedom. Such criticisms are based on the right’s definition according to international human rights law precisely the International Covenant on Civil and Political Rights. The dominant reasoning for this violation according to the majority of the related literature is the conservative interpretation of Sharia, the principal source of law, that has been adopted by Egyptian judiciary for more than …

The Failure Of Imagination: A Theoretical And Pragmatic Analysis Of Utopianism As An Orientation For Human Life, Maverick Edwards Jan 2021

The Failure Of Imagination: A Theoretical And Pragmatic Analysis Of Utopianism As An Orientation For Human Life, Maverick Edwards

Liberty University Journal of Statesmanship & Public Policy

Utopian theorists have long attempted to imagine “perfect” frameworks for human life. From Plato’s description of the ideal, state-centric society in the “Laws”, to Murray Rothbard’s anarcho-capitalist society, theorists have created a myriad of solutions they believe will fix most, if not all, human dilemmas. In analyzing these utopian projects from pragmatic and theoretical perspectives, this paper will argue that utopias are a failed project. Pragmatically, the development of utopia has a long and consistent track record of failure. Even the “successes” of utopian thought are under scrutiny, as they ultimately collapsed. Theoretically, the conceptualization of “perfection” entails unimaginable risk. …

Spirit Of The Corporation, Russell Powell Jan 2021

Spirit Of The Corporation, Russell Powell

Seattle University Law Review

Christian theologians have analyzed the productive and destructive qualities of institutions, sometimes attributing to them human virtues and vices. In City of God, Saint Augustine describes a utopian vision of human community within a Christian context as an alternative to the flawed “City of Man.” Contemporary theologians and sociologists have described collective structures of human behavior in institutions as having a kind of “spirit” analogous to the individual human “spirit.” Institutions are then assumed to take on an existence separate from the individuals within them, and in fact, the “spirit” of an institution influences the behavior of individuals. In The …

Spirit Of The Corporation, Russell Powell Jan 2021

Spirit Of The Corporation, Russell Powell

Seattle University Law Review

This Article provides a contemporary theoretical framework for Berle’s insight as a basis for considering its legal and ethical implications for corporate governance. Part II attempts to unpack contemporary understandings of spirit in order to provide a helpful working definition. Part III considers the origins and essential traits of the modern business corporation in the United States. The question posed by Berle—whether corporations can or ought to have a sort of moral orientation—is discussed in Part IV, while Part V ponders potential policy shifts that might tilt the orientation of the “spirit of the corporation” toward the common good. Part …

Equality, Animus, And Expressive And Religious Freedom Under The American Constitution: Masterpiece Cakeshop And Beyond, Daniel O. Conkle Jan 2021

Equality, Animus, And Expressive And Religious Freedom Under The American Constitution: Masterpiece Cakeshop And Beyond, Daniel O. Conkle

Books & Book Chapters by Maurer Faculty

Professor Conkle's contribution to this volume, pre-print attached, is the chapter "Equality, Animus, and Expressive and Religious Freedom Under the American Constitution: Masterpiece Cakeshop and Beyond."

CHAPTER ABSTRACT: Does the First Amendment protect religious wedding vendors from anti-discrimination laws that require them to provide goods or services for same-sex weddings? The fundamental question is whether equality or religious freedom should prevail in this setting, but the complexities of American free speech and free exercise law—exacerbated by the Supreme Court’s decision in Masterpiece Cakeshop—have obscured the debate with dubious distinctions and highly contentious rationales and arguments. In this Essay, I present …

This Essay reviews Jack Rakove’s Beyond Belief, Beyond Conscience and Winnifred Fallers Sullivan’s Church State Corporation with an eye towards the complex management of religious property in U.S. constitutional doctrine. Part I summarizes Rakove’s book and highlights its value in the context of recent scholarship on early American legislative theory. Part II critiques Rakove’s turn from description towards advocacy of James Madison’s liberal protestant political theology. Part III summarizes Sullivan’s book as a particularly potent rebuttal to Rakove’s. Part IV takes up Sullivan’s method to consider the most recent crisis of religious property before the Supreme Court, that of government …

The Legal Obligation Of The Us Government To Protect Asylum Seekers, Joy Karges Jul 2020

The Legal Obligation Of The Us Government To Protect Asylum Seekers, Joy Karges

Honors Program: Senior Projects (Public)

Immigration has always been an important topic of conversation in the United States and around the globe, but the recent surge of migrants at the US southern border has centered the debate around what is often referred to as “illegal immigration”. Some scholars argue that our detention facilities treat migrants as though they were criminals while others say detention facilities are the best way to keep migrants from making the journey to the US and threatening our national security. The purpose of this study is to untangle some of the misunderstandings surrounding immigration from Central America. By assessing some of …

Korean Americans, The Protestant Christian Church, And The Future Of Asian American Lgbtq Rights, Josiah Pak Jul 2020

Korean Americans, The Protestant Christian Church, And The Future Of Asian American Lgbtq Rights, Josiah Pak

UC Law Journal of Race and Economic Justice

This paper focuses on the Korean American Protestant Christian church and their past, present, and future support for LGBTQ rights. It explores both first-generation Korean American immigrants and their children, native-born second-generation Korean Americans. Specifically, it recounts the process of emigration for many first-generation Korean American immigrants and how it carried over the conservative, traditionalist, and religious frameworks that contribute to stonewalling future LGBTQ equality rights. Additionally, this paper addresses second- generation Korean Americans swinging between ideologies and social underpinnings of the older generation and a new “American” identity. By recounting Korean immigration to the United States, the role of …

Faith, Law, And Love: Peg Brinig's Legacy, Stephanos Bibas May 2020

Faith, Law, And Love: Peg Brinig's Legacy, Stephanos Bibas

Notre Dame Law Review

The central question in Peg Brinig’s work is how the law can help intimate associations to raise healthy kids. She pursues this theme through a variety of inquiries, ranging from parochial schools in big-city neighborhoods to covenant-marriage laws in Louisiana. Her answers depend on context, varying with how close each social actor or institution is to the process of raising children. But nearly all her recommendations seek to foster permanent, loving, involved social environments.

Following Brinig’s lead, I’ll celebrate her work by highlighting some of the answers she offers in three different social contexts. In Part I, I’ll explore her …

Celebrating Robert Cochran And The Future Of "Embodied" Christian Legal Scholarship, Barbara Armacost

Pepperdine Law Review

The occasion for this Article is a festschrift for Professor Robert (“Bob”) Cochran. I celebrate Bob’s significant scholarly contributions to the maturing of Christian Legal Scholarship. He applied a Christian perspective to legal issues, hosted conferences, mentored Christian Legal Scholars, and edited books of essays featuring Christian perspectives on law. Bob’s work in this area had a huge influence on the flourishing of Christian Legal Scholarship. This Article considers the future of Christian Legal Scholarship. It enters an ongoing conversation (disagreement) between law Professors David Skeel and David Caudill. In a 2008 article, Skeel defined Christian Legal Scholarship so narrowly …

“Souls Aren’T Saved Just In Church Buildings”: Defining “Religious Exercise” Under The Religious Land Use And Institutionalized Persons Act, Taylor Luckey Brennan Mar 2020

“Souls Aren’T Saved Just In Church Buildings”: Defining “Religious Exercise” Under The Religious Land Use And Institutionalized Persons Act, Taylor Luckey Brennan

Duke Law Journal

Throughout its First Amendment jurisprudence, the Supreme Court has acknowledged the difficulty inherent in determining the scope of the multivalent term “religion.” The Court has repeatedly struggled to articulate workable definitions of religion, religious belief, and religious exercise. And the struggle is ongoing. The Religious Land Use and Institutionalized Persons Act (“RLUIPA”) protects “religious exercise” in the land-use context. If a claimant can prove that its religious exercise is substantially burdened by a land ordinance or zoning regulation, it may receive an exemption.

Although RLUIPA offers a definition of “religious exercise,” it remains unclear just what types of land uses …
