Since mid-2023, the Supreme Court of the Republic of Indonesia has prioritised the strengthening and harmonisation of Indonesian civil procedural law to better align with international practices and standards. This initiative seeks to enhance the competitiveness of Indonesian judicial institutions in resolving commercial disputes through acceding to relevant private international law instruments. The HCCH 1970 Evidence Convention is among the key private international law instruments identified by the Supreme Court as a priority for Indonesia's accession. The central government's policy of mandating budget efficiency has had a significant impact on regions, particularly those dependent on central government transfers. In the context of the Special Region of Yogyakarta, efficiency not only impacts regular regional budget (APBD) revenues but also Special Fund transfers. Using a socio-legal approach, this study explores and analyzes the impact of efficiency on public service delivery and regional development in the Special Region of Yogyakarta (DIY), as well as the regional government's strategies for budget optimization. The dual system model in the implementation of credit information in Indonesia makes the relationship between the Financial Services Authority (OJK) as a public credit registry and the Credit Information Management Institution (LPIP) as a private credit bureau interesting to observe. Abstract
The Constitutional Court's decisions regarding election simultaneity demonstrate a highly progressive development in constitutional reasoning. The Constitutional Court has issued at least three decisions related to the election simultaneity model: Decision Number 14/PUU-XI/2013, Decision Number 55/PUU-XVII/2019, and Decision Number 135/PUU-XXII/2024. So far, studies of these decisions have tended to be placed within the framework of constitutional interpretation. However, the Constitutional Court's stance in Decision Number 135/PUU-XXII/2024 goes beyond merely interpreting the constitution to also construct a constitutional provision on election simultaneity by separating national and local elections. Law Number 20 of 2025 on the Criminal Procedure Code introduces the Deferred Prosecution Agreement (DPA) as a special mechanism for corporate offenders. Article 328(8) grants judges substantive authority to assess proportionality, the impact on the national economy, and the suspect's ability to meet the agreed conditions—yet provides no clear parameters. This absence risks legal uncertainty, judicial formalism, and abuse of power, while colliding with the presumption of innocence within Indonesia's civil-law tradition, in which judges have traditionally played a passive role. One aspect of evaluating the Constitutional Court, which has been in existence since 2003, is the issue of ethical compliance. Although a code of ethics for constitutional judges currently exists, it applies only to sitting constitutional judges. In reality, however, many former constitutional judges frequently act as parties in cases heard by the Constitutional Court. The author found that there are still former Constitutional Court judges who have served as parties—either as principals or as legal representatives. ธุรกิจธนาคารพาณิชย์เป็นธุรกิจประเภทหนึ่งที่มีการประมวลผลข้อมูลส่วนบุคคลของลูกค้าเป็นจำนวนมาก โดยภายหลังจากที่พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“PDPA”) มีผลใช้บังคับโดยสมบูรณ์ ธนาคารพาณิชย์หลายแห่งมีการกำหนดมาตรการและนโยบายในการประมวลผลข้อมูลส่วนบุคคลของลูกค้าเพื่อคุ้มครองข้อมูลส่วนบุคคลอย่างเคร่งครัด แต่ถึงอย่างไรก็ดี ในปัจจุบัน เนื่องจากการตีความตาม PDPA รวมถึงกฎหมายที่เกี่ยวข้องยังไม่มีคำพิพากษาของศาลที่ครอบคลุมในทุกประเด็นเป็นบรรทัดฐาน จึงทำให้ในทางปฏิบัติแล้วอาจเกิดปัญหาในการตีความและใช้ PDPA รวมถึงกฎหมายที่เกี่ยวข้องเพื่อดำเนินธุรกิจของธนาคารพาณิชย์ได้ ในบทความนี้ ผู้เขียนจึงจะหยิบยกและนำเสนอข้อพิจารณาหรือประเด็นที่น่าสนใจในเชิงปฏิบัติของการประมวลผลข้อมูลส่วนบุคคล (การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล) ของลูกค้าในธุรกิจของธนาคารพาณิชย์โดยพิจารณาตามฐานการประมวลผลข้อมูลตามกฎหมายของ PDPA ที่ผู้เขียนมีความคิดเห็นว่า ประเด็นที่จะนำเสนอในบทความนี้อาจถูกนำไปใช้พัฒนาและต่อยอดในการกำหนดแนวปฏิบัติหรือมาตรการการคุ้มครองข้อมูลส่วนบุคคลของลูกค้าโดยธนาคารพาณิชย์ เพื่อให้ธนาคารพาณิชย์สามารถให้บริการลูกค้าได้อย่างมีประสิทธิภาพโดยที่ลูกค้าได้รับการคุ้มครองข้อมูลส่วนบุคคลตามกฎหมายอย่างเต็มที่ หรือป้องกันปัญหาต่าง ๆ ที่อาจเกิดขึ้นได้ในอนาคต

การเผยแพร่ข้อมูลบนสื่อออนไลน์มีลักษณะคงอยู่อย่างถาวรและสามารถเข้าถึงได้ตลอดเวลา เมื่อข้อความอันอาจเป็นการหมิ่นประมาทถูกเผยแพร่ผ่านแพลตฟอร์มดิจิทัล ปัญหาทางกฎหมายจึงเกิดขึ้นว่าควรเริ่มนับอายุความเมื่อใด เนื่องจากภายใต้หลักการเผยแพร่หลายครั้ง (Multiple Publication Rule) การเข้าถึงเนื้อหาแต่ละครั้งอาจถูกตีความว่าเป็นการกระทำความผิดใหม่ ส่งผลให้อายุความถูกขยายออกไปอย่างไม่มีที่สิ้นสุด ทำให้ผู้เผยแพร่ต้องเผชิญความเสี่ยงทางกฎหมายอย่างไม่มีกำหนด อันก่อให้เกิดผลกระทบเชิงยับยั้ง (chilling effect) ต่อเสรีภาพในการแสดงความคิดเห็น และเกิดความไม่สมดุลระหว่างเสรีภาพในการแสดงความคิดเห็นกับสิทธิในชื่อเสียงของบุคคล บทความวิจัยนี้ศึกษาวิเคราะห์มิติปัญหาทางกฎหมายว่าด้วยการกำหนดจุดเริ่มต้นการนับอายุความของความผิดฐานหมิ่นประมาทที่กระทำผ่านสื่อออนไลน์ โดยมีขอบเขตการศึกษาครอบคลุมถึงแนวคิดว่าด้วยการสร้างดุลยภาพระหว่างเสรีภาพในการแสดงความคิดเห็นกับการคุ้มครองชื่อเสียง การตรวจสอบหลักเกณฑ์การนับอายุความตามประมวลกฎหมายอาญาและประมวลกฎหมายแพ่งและพาณิชย์ของไทย และการศึกษาเปรียบเทียบพัฒนาการ บรรทัดฐานคำพิพากษา และบทบัญญัติทางกฎหมายของประเทศอังกฤษและสหรัฐอเมริกาที่นำหลัก Single Publication Rule มาปรับใช้ ผลการศึกษาพบว่า การปรับใช้หลักการนับอายุความแบบเดิมที่ถือว่าการเผยแพร่ซ้ำแต่ละครั้งเป็นความผิดใหม่ไม่สอดคล้องกับลักษณะของสื่อออนไลน์ และก่อให้เกิดภาระเกินสมควรแก่ผู้เผยแพร่ จึงควรนำหลัก Single Publication Rule มาใช้ โดยถือว่าการเผยแพร่เนื้อหาที่มีสาระสำคัญเดียวกันเป็นการกระทำเพียงครั้งเดียวและเริ่มนับอายุความนับแต่วันที่เผยแพร่ครั้งแรก เว้นแต่การเผยแพร่ครั้งหลังจะมีความแตกต่างอย่างมีนัยสำคัญจึงจะถือเป็นการเผยแพร่ใหม่ อย่างไรก็ดี การนำหลักดังกล่าวมาใช้ควรกำหนดรายละเอียดและกลไกทางกฎหมายเพิ่มเติม อาทิ การให้ดุลพินิจแก่ศาลในการขยายอายุความ การกำหนดขอบเขตระยะเวลาและการนับอายุความจากวันที่เผยแพร่ครั้งแรกให้ชัดเจน ตลอดจนมาตรการที่ใช้บังคับกับคลังข้อมูล แพลตฟอร์ม และผู้เผยแพร่ เพื่อสร้างความสมดุลระหว่างเสรีภาพในการแสดงความคิดเห็นกับสิทธิในชื่อเสียง ให้สอดคล้องกับบริบทของสังคมดิจิทัล

การใช้มาตรการควบคุมตัวผู้กระทำความผิดเกินกว่าความจำเป็นอาจก่อให้เกิดผลกระทบต่อสิทธิและเสรีภาพของบุคคล ตลอดจนเป็นปัจจัยหนึ่งที่นำไปสู่ปัญหาความแออัดในเรือนจำและยังมีข้อจำกัดในการแก้ไขฟื้นฟูผู้กระทำความผิด แนวคิดเกี่ยวกับมาตรการปฏิบัติต่อผู้กระทำความผิดแทนการควบคุมตัว (Non-custodial Measures) จึงมีความสำคัญในฐานะแนวทางที่มุ่งลดการใช้การควบคุมตัวและการจำคุกที่ไม่จำเป็นในกระบวนการยุติธรรมทางอาญา ทั้งยังสอดคล้องกับหลักสิทธิมนุษยชนและมาตรฐานสากล โดยเฉพาะหลักเกณฑ์ตามข้อกำหนดมาตรฐานขั้นต่ำแห่งสหประชาชาติว่าด้วยมาตรการไม่ควบคุมตัว หรือ ข้อกำหนดโตเกียว (Tokyo Rules) บทความวิจัยนี้มุ่งศึกษาการพัฒนามาตรการปฏิบัติต่อผู้กระทำความผิดแทนการควบคุมตัวในกฎหมายไทยในสองประเด็นสำคัญ ได้แก่ การปล่อยชั่วคราวในระหว่างการพิจารณาคดี และ มาตรการควบคุมตัวผู้กระทำความผิดในสังคม โดยศึกษาหลักเกณฑ์ตามกฎหมายไทยประกอบกับการศึกษาเปรียบเทียบกรอบกฎหมายของประเทศสหรัฐอเมริกา ประเทศอังกฤษ และประเทศออสเตรเลีย เพื่อนำเสนอแนวทางที่เหมาะสมสำหรับการพัฒนามาตรการของประเทศไทย

บทความนี้มุ่งศึกษาถึงการคุ้มครองสิทธิอนามัยเจริญพันธุ์ของสตรีและผู้มีความหลากหลายทางเพศในบริบทประเทศไทย ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน เช่น อนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) หลักการยอกยาการ์ตา และเป้าหมายการพัฒนาที่ยั่งยืนข้อที่ 5 ซึ่งต่างยืนยันถึงสิทธิในการเข้าถึงสุขภาพทางเพศและอนามัยเจริญพันธุ์อย่างเสมอภาคและปราศจากการเลือกปฏิบัติ จากการศึกษาพบว่า แม้ประเทศไทยจะมีความก้าวหน้าในเชิงกฎหมายและนโยบาย แต่ยังคงเผชิญอุปสรรคสำคัญ อาทิ อคติจากผู้ให้บริการ ความเหลื่อมล้ำทางเศรษฐกิจและภูมิศาสตร์ ตลอดจนข้อจำกัดทางกฎหมายที่ยังไม่สอดคล้องกับมาตรฐานสิทธิมนุษยชนสากล การศึกษาวิจัยนี้จึงมุ่งศึกษาพัฒนาการและปัญหาทางกฎหมายและนโยบายของประเทศไทยที่เกี่ยวข้อง เช่น การยุติการตั้งครรภ์ การขยายสิทธิประโยชน์ด้านการคุมกำเนิด การบริการอนามัยเจริญพันธุ์ รวมถึงสิทธิในการเข้าถึงบริการยาฮอร์โมนและการยืนยันเพศสภาพ โดยศึกษาเปรียบเทียบกับการคุ้มครองสิทธิอนามัยเจริญพันธุ์ในสหราชอาณาจักร เยอรมนี และอินเดีย อันเป็นตัวอย่างการพัฒนากลไกกฎหมายและนโยบายที่ช่วยลดความเหลื่อมล้ำและสร้างระบบบริการที่เป็นมิตร เพื่อยกระดับกลไกทางกฎหมายและนโยบายสาธารณะของไทยให้สามารถส่งเสริมและสนับสนุนสิทธิอนามัยเจริญพันธุ์เกิดขึ้นจริง ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน และบรรลุเป้าหมายการพัฒนาอย่างยั่งยืนได้ต่อไป

บทความนี้มีวัตถุประสงค์เพื่อศึกษาขอบเขตความรับผิดทางกฎหมายของกรรมการตรวจสอบในบริษัทจดทะเบียนของไทย โดยครอบคลุมทั้งความรับผิดทางแพ่งและความรับผิดทางอาญา ทั้งในช่วงระหว่างดำรงตำแหน่งและภายหลังพ้นจากตำแหน่ง โดยมุ่งวิเคราะห์ฐานความรับผิดภายใต้พระราชบัญญัติบริษัทมหาชนจำกัด พ.ศ. 2535 และพระราชบัญญัติหลักทรัพย์และตลาดหลักทรัพย์ พ.ศ. 2535 ตลอดจนหลักกฎหมายทั่วไปเกี่ยวกับหน้าที่และความรับผิดของกรรมการบริษัท งานวิจัยนี้ใช้วิธีการศึกษาวิเคราะห์เชิงนิติศาสตร์ (doctrinal research) โดยพิจารณาบทบัญญัติกฎหมาย แนวคำพิพากษา และหลักเกณฑ์กำกับดูแลกิจการที่ดี ผลการศึกษาพบว่า กรรมการตรวจสอบอาจต้องรับผิดทั้งในทางแพ่งและทางอาญา หากการกระทำหรือการละเลยต่อหน้าที่ในระหว่างดำรงตำแหน่งก่อให้เกิดความเสียหายแก่บริษัท ผู้ถือหุ้น หรือบุคคล ภายนอก โดยความรับผิดดังกล่าวมิได้สิ้นสุดลงโดยอัตโนมัติเมื่อพ้นจากตำแหน่ง ทั้งนี้ ความรับผิดทางแพ่งอาจเกิดจากการฝ่าฝืนหน้าที่ความระมัดระวังและความซื่อสัตย์สุจริต ส่วนความรับผิดทางอาญาอาจเกิดขึ้นในกรณีที่มีการกระทำอันเป็นความผิดตามกฎหมายหลักทรัพย์ เช่น การเปิดเผยข้อมูลอันเป็นเท็จหรือปกปิดข้อเท็จจริงอันควรต้องแจ้ง อย่างไรก็ดี กฎหมายไทยยังขาดบทบัญญัติที่กำหนดขอบเขตความรับผิดของกรรมการตรวจสอบอย่างชัดเจน โดยเฉพาะในกรณีภายหลังพ้นตำแหน่ง ส่งผลให้เกิดความไม่แน่นอนในการบังคับใช้กฎหมาย บทความวิจัยนี้เสนอให้มีการกำหนดหลักเกณฑ์ที่ชัดเจนเกี่ยวกับขอบเขตและระยะเวลาความรับผิดทั้งทางแพ่งและทางอาญาของกรรมการตรวจสอบ รวมถึงการพัฒนามาตรฐานการใช้ดุลพินิจและกลไกคุ้มครองกรรมการที่ปฏิบัติหน้าที่โดยสุจริต เพื่อสร้างความสมดุลระหว่างการคุ้มครองผู้ลงทุนและการส่งเสริมธรรมาภิบาลในบริษัทจดทะเบียน

วิจัยฉบับนี้พบว่า บทบัญญัติของพระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 เป็นอุปสรรคต่อการร่วมกันเพื่อพัฒนาเงื่อนไขการทำงานของผู้ทำงานผ่านทางแพลตฟอร์มแรงงานดิจิตัล จึงมีความจำเป็นที่จะต้องมีการแก้ไขปรับปรุงพระราชบัญญัติฉบับนี้เพื่อเป็นการรื้อถอนอุปสรรคดังกล่าว โดยการเพิ่มเติมมาตรา 56/1 อันเป็นบทบัญญัติที่ยกเว้นการบังคับใช้มาตรา 54 และ 55 ให้แก่การร่วมกันอันมีวัตถุประสงค์ในการพัฒนาเงื่อนไขการทำงานของผู้ทำงานผ่านทางแพลตฟอร์มแรงงานดิจิตัล
