To Vacate Or Not To Vacate: Partial Remedies And Mootness In Federal Habeas Of State Convictions, Jeffrey Greenbaum
To Vacate Or Not To Vacate: Partial Remedies And Mootness In Federal Habeas Of State Convictions, Jeffrey Greenbaum
University of Cincinnati Law Review
This Article addresses two related issues in the federal habeas of state convictions. First, it analyzes a circuit split that recently emerged over whether a state’s appeal would be moot after a federal district court grants habeas and a state vacates its own judgment. One view is that the state vacatur would render the appeal moot because the prisoner is no longer in custody. A second view is that the appeal would not necessarily be moot because a partial remedy could be available. Second, this Article identifies some courts conflating the language of a state’s vacatur in habeas and evaluates …

Civil Rights Microviolations, Alissa Cooley Yonesawa, Michael Kagan
Civil Rights Microviolations, Alissa Cooley Yonesawa, Michael Kagan
University of Cincinnati Law Review
This essay is an attempt to name and define a certain kind of civil rights problem. Namely: Rights violations that are small enough that the rational thing for the victim to do might be to just cope with them, but when allowed to fester and repeat, do significant damage. We call these problems microviolations. To define them, we borrow from the idea of a microaggression, a concept that developed to understand an analogous challenge in workplace and school discrimination. We offer a diagnosis of why microviolations are both problematic and difficult to address, and arguments that they should be a …

Destabilization Or Clarification: The Potential Impact Of Chiles V. Salazar On Nifla And Other First Amendment Jurisprudence, Zhihan Xu
Duke Journal of Constitutional Law & Public Policy Sidebar
In 2019, the Colorado General Assembly passed the Minor Conversion Therapy Law (MCTL), a statute which prohibits mental health professionals from engaging in conversion therapy for minors. Three years later, Kaley Chiles, a licensed professional counselor and addiction counselor, filed a pre-enforcement challenge and sought a preliminary injunction, alleging that the MCTL improperly abridges her First Amendment right to free speech. Colorado challenged her claim, arguing that the MCTL merely regulates professional conduct and only incidentally (and permissibly) burdens speech. Chiles v. Salazar will decide whether the MCTL is a speech restriction or professional regulation, and, if it is a …
Reflections On Judging At The Intersection Of Constitutional Claims And Public Policy, Kimberly J. Mueller
Reflections On Judging At The Intersection Of Constitutional Claims And Public Policy, Kimberly J. Mueller
Duke Journal of Constitutional Law & Public Policy Sidebar
Trial courts play an essential role in our judicial system. At the trial level, lived realities meet legal theories, and generalist judges must resolve constitutional disputes, develop the factual record, and administer justice. However, institutions, especially courts, face increasing pressure. This Keynote Address draws on cases over which I have presided to illustrate how careful process in trial courts helps maintain public trust in our institutions. These experiences reveal three lessons that trial courts teach us. First, the people bringing claims matter; they are real individuals seeking relief by telling authentic stories. Second, pleadings matter because they frame and shape …

Rethinking Legal Education: Demystifying Neurodiversity And Building An Inclusive Future, Jennifer Kindred Mitchell, Charlie Amiot
Rethinking Legal Education: Demystifying Neurodiversity And Building An Inclusive Future, Jennifer Kindred Mitchell, Charlie Amiot
The Journal of Law Teaching and Learning
This article contributes significantly to the discourse on legal education by arguing that embracing neurodiversity not only enhances the learning environment for all students but also cultivates a legal profession that is truly reflective of societal diversity. Ultimately, neurodiversity should be embraced as an asset. By adopting inclusive practices, legal education can nurture the promise of ND students and improve outcomes for all. This article seeks to inspire a new paradigm that celebrates neurocognitive diversity’s contributions to the legal profession.
Neurodivergent (ND) students comprise approximately a quarter of the law school population, yet traditional legal education often fails to meet …
The House Of Ai: Intellectual Property Law As It Relates To Generative Ai And Fashion, Abhilasha Praveen
The House Of Ai: Intellectual Property Law As It Relates To Generative Ai And Fashion, Abhilasha Praveen
Pursuit - The Journal of Undergraduate Research at The University of Tennessee
Over the past decade, artificial intelligence has permeated nearly every aspect of society, yet American legislation in this field remains largely archaic. The absence of specific legislation governing generative AI in the United States has led to numerous intellectual property (IP) and copyright disputes, infringing on both creator’s rights and discouraging innovation. Given the rapid evolution of generative AI in society, comprehensive legislative action is necessary to establish clear guidelines balancing intellectual property rights with the need for innovation through technological advancement. While this issue spans multiple industries, this article focuses on fashion, examining how AI regulation can foster innovation …

The Human Rights Fulcrum: Using Environmental Rights As Leverage For Change, Rebecca Bratspies
The Human Rights Fulcrum: Using Environmental Rights As Leverage For Change, Rebecca Bratspies
Pace International Law Review
“Give me a lever long enough and a firm place on which to stand and I will move the earth." That is how Archimedes famously described the power of levers and the possibility they create for moving something that otherwise seems immovable. His point was that with the use of distance, a fulcrum, and a lever, nothing is really immovable. This same characterization has been applied to human rights law, and its attempts to disrupt patterns of structural dispossession, discrimination and oppression that bedevil human society. Indeed, the metaphor that human rights are a lever for change is relatively common …
The (Non-) Protection Of Indigenous Rights In Isds, Dr. Kevin W. Gray
The (Non-) Protection Of Indigenous Rights In Isds, Dr. Kevin W. Gray
Pace International Law Review
International investment law largely flows from the protections afforded foreign investors under bilateral and multilateral investment treaties. Until recently, few of these treaties required investors to comply with human rights provisions in national constitutions or in international law, or preserved the ability of states to regulate to protect constitutional rights. As a result, critics have argued, investor-state dispute settlement fails to protect human rights or preserve the ability of states to regulate in the public interest, and that arbitral awards rarely consider, let alone give effect to, rules of human rights.
This article considers the question of how Indigenous rights, …
Decoding Chinese Law In U.S. Courts: The Logic Of Extra-Legality, Tian Xie
Decoding Chinese Law In U.S. Courts: The Logic Of Extra-Legality, Tian Xie
Pace International Law Review
U.S. courts and regulators often face challenges in interpreting Chinese law, as actual regulatory practices frequently diverge from formal legal provisions. This article argues that a strictly formalist approach that relies solely on legal text is inadequate. Instead, U.S. authorities should adopt an extra-legality framework, which considers how Chinese law functions to reinforce political authority while maintaining a legal façade. The article further illustrates the application of this approach through a case study of the Holding Foreign Companies Accountable Act (HFCAA), which pro- vides a more nuanced and realistic understanding of Chinese regulatory practices surrounding U.S. access to audit work …

Minimum Wages And Workplace Injuries, Michael Davies, R. Jisung Park, Anna Stansbury
Upjohn Institute Working Papers
How do minimum wage changes affect workplace amenities? Using the universe of claims from California, the US’ largest workers’ compensation system, over 2000-2019, we exploit geographic variation in state- and city-level minimum wages and local occupation-level variation in exposure to minimum wage changes to estimate whether minimum wage increases affect the rate of workplace injuries. We find a large adverse effect of raising minimum wages on injuries. A 10% increase in the minimum wage increases the injury rate by 7.2% in an occupation-metro area labor market which is fully exposed to the minimum wage increase. Our results imply an elasticity …
