Judge And The Crime Burden, John Barker Waite Dec 1955

Judge And The Crime Burden, John Barker Waite

Michigan Law Review

One does not happily charge the judiciary with responsibility for the country's burden of crime, but the responsibility does in fact exist. Judges, though they may not encourage crime, interfere with its prevention in various ways. They deliberately restrict police efficiency in the discovery of criminals. They exempt from punishment many criminals who are discovered and whose guilt is evident. More seriously still, they so warp and alter the public's attitude toward crime and criminals as gravely to weaken the country's most effective crime preventive.

The Public Employee And His Government: Conditions And Disabilities Of Public Employment, Jerome J. Shestack Jun 1955

The Public Employee And His Government: Conditions And Disabilities Of Public Employment, Jerome J. Shestack

Vanderbilt Law Review

Even before Mr. Marbury, the public employee and his government have frequently found themselves on opposite sides of the counsel table. Not that public employees are a particularly litigious lot. Faced, however, with the willingness of administrators to deal with them politically and the unwillingness of legislators to protect them adequately, their resort to the courts was inevitable. But the courts also often provided inadequate protection. Decisions which combined ancient concepts with more than a touch of political realism accorded scant recognition to the substantial interests of the ever-growing number of public employees.

In recent years, the traditional cliches in …

An Inquiry Into The Principles Of Municipal Responsibility In General Assumpsit And Tort, George K. Gardner, Leslie M. Geller, John F. Mcgrory, William B. Shaffer Jr.

Vanderbilt Law Review

This paper is written in the conviction that the world is governed by natural law. It is our ambition to describe an analytical method by which the true responsibility of a municipality in respect to any given claim in general assumpsit or tort may be ascertained. It is not pretended that the method which we shall offer will yield a result in harmony with every reported judicial decision and statute, nor even that it may not differ rather widely from the system of legal rules prevailing currently in many states. It is our hope to present an exposition of basic …

Taft-Hartley And State Power To Regulate Labor Unions, Donald H. Wollett

While the United States Supreme Court has in recent years held that the states have wide powers under the Fourteenth Amendment to regulate labor relations, it has during the same period circumscribed state authority over matters falling within the purview of Title I of Taft-Hartley viz., the National Labor Relations Act.
