Statute Prohibiting Maintenance Of Billboards Adjacent To Interstate Highway Is Valid As Applied To Existing Billboards- Ghaster Properties, Inc. V. Preston, Michigan Law Review

Michigan Law Review

In order to qualify for additional aid under the 1958 Federal-Aid Highway Program, the Ohio legislature prohibited the erection or maintenance of billboards for advertising purposes within 660 feet of an interstate highway and declared billboards in violation of the statute to be public nuisances subject to abatement. As the owner of seven signs which violated the statute, plaintiff sought an injunction against the enforcement of the statute on the ground that it bore no substantial relation to the public health, safety, morals, or general welfare. The trial court granted the injunction and the court of appeals affirmed, holding the …

Expanded Bases Of Jurisdiction -- An Examination Of Tennessee's New "Long-Arm" Statute, Harry G. Nichol, Jr. Jun 1965

Expanded Bases Of Jurisdiction -- An Examination Of Tennessee's New "Long-Arm" Statute, Harry G. Nichol, Jr.

Vanderbilt Law Review

A foreign corporation considering the consequences of its activity in relation to forums outside the state of its incorporation is faced with three basic legal problems. They are generally regarded as the different degrees of "doing business" for purposes of (1) qualification,(2) taxation, and (3) judicial jurisdiction. The purpose of this paper is to discuss a major recent development concerning the jurisdiction of Tennessee courts, in light of similar developments throughout the country.

Distributions By Charitable Organizations: Their Effect On Tax Exempt Status And Deductibility Of Donations Received, Thomas H. Belknap Jun 1965

Distributions By Charitable Organizations: Their Effect On Tax Exempt Status And Deductibility Of Donations Received, Thomas H. Belknap

Vanderbilt Law Review

The number and importance of tax exempt organizations has steadily grown in the past decade to the point where there were over 45,000 as of the beginning of 1963, as compared with 12,000 at the end of 1952. "Unquestionably, the economic life of our nation has be-come so intertwined with foundations that unless something is done about them, they will hold a dominant position in every phase of American life." This, according to the Patman Report, is because"multi-million-dollar foundations have replaced the trusts which were broken up during the Theodore Roosevelt administration." Both the Patman Report and the increased activity …

Constitutional Rights In The Public Sector: Justice Douglas On Liberty In The Welfare State, Hans A. Linde Apr 1965

Constitutional Rights In The Public Sector: Justice Douglas On Liberty In The Welfare State, Hans A. Linde

Washington Law Review

Although the needs of the national economy and national security have vastly expanded the public sector, it is the direct underwriting of individual living standards and social services that characterizes the welfare state. Inevitably, conflicts between the views and objectives of the welfare state's political management and the views of some claimants to welfare state benefits have put in issue the constitutional limitations on the power to deny, withdraw, or condition such benefits. And inevitably, the cry of "constitutional rights" in public programs has been countered with the cry of "privilege." The arguments were already familiar when Mr. Justice Douglas …

Controlling The Police: The Judge's Role In Making And Reviewing Law Enforcement Decisions, Wayne R. Lafave, Frank J. Remington

Michigan Law Review

We have chosen to focus here upon judicial involvement (1) in determining whether arrest and search warrants should issue and (2) in reviewing such decisions after they have been executed (and, perhaps, made) by police officials. A comparison of some recent findings respecting the actual practice at the trial level with the "ideal" as set forth in appellate opinions may allow some conclusions to be drawn both as to the present effectiveness of appellate rulings on these subjects and as to the ultimate feasibility of further implementation of those rulings. Finally, since the exclusionary rule is, theoretically at least, one …

Municipal Employees' Unions: The Climb Up Labor's Ladder, Frank A. Mysliwiec Jan 1965

Municipal Employees' Unions: The Climb Up Labor's Ladder, Frank A. Mysliwiec

Duquesne Law Review

For years municipal employees' unions have struggled to stand as equals beside their brother unions in private industry. Periodically, they have ascended many rungs in labor's ladder. However, in many instances their progress has been blocked, not by the municipal government but by courts, who, after considering all the factors involved, not only believed that it was in the public's best interests to have municipal employees join a less powerful union but also outlined the power of the municipality in dealing with the union.

At the present time, the court, the union and the municipality appear lost in a maze. …

Federal Procedure: Proposed Solutions To The Problem Of Proliferation Of Petitions For The Writ Of Habeas Corpus And 28 U.S.C. 2255 Proceedings In The Federal Courts, David Pitkin, Ray Shollenbarger

San Diego Law Review

The Writ of Habeas Corpus is a limit on arbitrary government. The proliferation of this writ has created a problem in the federal courts. The proliferation problem is due to the application of the Bill of Rights to the states through the Fourteenth Amendment, the changes in procedural rules involving hearing habeas petitions, and the fact that the doctrine of res judicata does not apply to habeas proceedings. Two U.S. Supreme Court cases dealt the final blow to this proliferation problem by requiring evidentiary hearings when a substantive constitutional question or § 2255 was presented. This Article proposes possible solutions …

Medical And Legal Aspects Of Human Organ Transplantation, Carl E. Wasmuth, Bruce H. Stewart Jan 1965

Medical And Legal Aspects Of Human Organ Transplantation, Carl E. Wasmuth, Bruce H. Stewart

Cleveland State Law Review

Medical science has now made it possible to transplant kidneys from one individual to another in order to save the lives of patients dying of kidney failure. The use of kidneys from recently deceased patients (so called cadaver donors) is increasing, creating special legal problems in regard to obtaining and using such organs. As techniques of heart, lung, and liver transplantation develop, these legal problems may become even more complex.

Initial Impressions Of The Treasury Report On Foundations, Marcus Schoenfeld Jan 1965

Initial Impressions Of The Treasury Report On Foundations, Marcus Schoenfeld

Cleveland State Law Review

Very recently in the United States Treasury Department submitted its study of private foundations to Congress. This is the most recent development in an attempt to delineate the proper role of foundations and their donors in our society, and more particularly their proper tax treatment. Although it is much too soon to predict the effect of the Treasury Report, since Congress itself asked for the study, it is quite likely that some more restrictive legislation will result.
