The Three-Judge District Court In Contemporary Federal Jurisdiction, Anon
The Three-Judge District Court In Contemporary Federal Jurisdiction, Anon
Washington Law Review
Congress has provided that in certain cases which are otherwise properly before a federal district court, a special district court composed of three judges, one of whom must be a circuit judge, is required. Theoretically, this requirement is procedural assurance that important litigation will receive commensurate consideration in the federal district courts. One type of litigation which Congress has deemed to merit this special treatment is a suit to enjoin enforcement of a state statute or administrative order on grounds of unconstitutionality. While the three-judge statute is relatively simple in theory, it has proven quite complex in practice and has …

Workmen's Compensation For Radiation Injuries In Tennessee, E. Blythe Stason
Vanderbilt Law Review
We lay to one side, so far as this article is concerned, the impact of the atom on general tort liability in Tennessee. Such important aspects of the total subject as strict liability, nuisance actions, third-party liability, and joint and several liability we reserve for another occasion. Hopefully radiation will be so well regulated that the injuries to outsiders will be few and far between. We also lay to one side possible injuries in Tennessee resulting from the extensive operations of the federal government in the nuclear field. Such injuries receive special handling either by federal agencies (e.g.,the Bureau of …
Federal Habeas Corpus And The State Court Criminal Defendant, Frank W. Wilson
Federal Habeas Corpus And The State Court Criminal Defendant, Frank W. Wilson

The removal of an action from a state to a federal court may sometimes cause ruffled feelings, but few judges remain long offended at being relieved of trying a lawsuit. On the other hand, when a federal judge reverses a state judge who has been affirmed by the state appellate courts, forcing him to …

Constitutional Law: Criminal Punishment Of Alcoholic For Public Drunkenness Held To Be Cruel And Unusual Under The Eighth And Fourteenth Amendments
Duke Law Journal
The Fourth Circuit unanimously held that criminal punishment of an alcoholic for public drunkenness violates the eighth and fourteenth amendments. This landmark decision, while apparently sound, leaves the states with many new problems in effecting the shift from the jail to the hospital. Some possible solutions to these problems are suggested herein. In addition, the possibility of applying the rationale of the holding to crimes other than public drunkenness is considered.
