Chronic Alcoholic Court Offenders: An Alternative To The Drunk Tank, Jack H. Watson, Jr
Georgia Law Review
T HE social problem of alcoholism may be divided into two categories: (1) that of the "visible" alcoholic or "chronic alcoholic court offender" whose illness is manifested hundreds of thousands of times per year either on city streets, or in countless city and county stockades acoss the country; and (2) that of the "invisible" alcoholic whose illness is just as serious, but whose social and economic position permits him to suffer through years of alcoholism without being arrested or taken before a magistrate for being drunk in public. It is estimated that over 6,500,000 persons in the United States are …

A Seat On The Sidelines: The Georgia Appellate Judiciary And The Public Forum, D. Grier Stephenson, Jr
Georgia Law Review
THE use of streets and parks for expression of one's ideas has been a part of American political history since the early years of the Republic. The town meeting in New England and the courthouse rally in the South have brought citizens together to hear their neighbors and long-winded politicians speak on the issues, hopes, and fears of the day. The campaign barbecue, the sidewalk sermon, and the Fourth of July oration have reflected in a special way some aspect of the American culture. But the accessibility and the availability of this ready-made public forum provide more than a political …

The Fair Trial-Free Press Controversy - Where We Have Been And Where We Should Be Going, Paul C. Reardon
San Diego Law Review
On October 2, 1966, the report of the American Bar Association Advisory Committee on Fair Trial and Free Press was released as a tentative draft. The release culminated twenty months of intensive work by the Committee, its Reporter, and its research staff. Since then, many thousands of copies of the draft in printed form have been distributed to judges, lawyers, schools of law and journalism, and to persons in responsible positions in the press, radio and television whose all important function is to keep the American people informed. Post-Conviction Relief For Federal Prisoners: A Survey And A Suggestion Under 28 U.S.C. 2255, Gerald F. Uelmen
West Virginia Law Review
In answer to the complaints of numerous federal judges that they were being engulfed by a flood of habeas corpus petitions, Congress in 1948 enacted a complete revision of the habeas corpus provisions of the Judicial Code. Part of this revision was title 28, section 2255, of the United States Code which "restates, clarifies and simplifies the procedure in the nature of the ancient writ of error coram nobis." Adopted upon the recommendation of the Judicial Conference of the United States, its declared purpose was to provide "an expeditious remedy for correcting erroneous sentences without resort to habeas corpus." The …

Constitutional Law: Supreme Court Delineates The Relationship Between The Fourth And Fifth Amendments
Duke Law Journal
In Schmerber v. California the Supreme Court reaffirmed the admissibility of blood test evidence procured without consent of the accused. Rejecting petitioner's fourth and fifth amendment claims, the Court utilized a refined definition of the privilege against self-incrimination in determining the reasonableness of intracorporeal search and seizure. Moreover, the approach taken by the majority arguably presages the demise of the mere evidence rule.

The Defense Of Entrapment In The Federal Courts, Lester B. Orfield
Duke Law Journal
Since 1932, the defense of entrapment has been firmly established in the federal courts; however, the doctrine itself is replete with basic confusion. In recent years, this underlying confusion has prompted the development of disparate rules governing the scope and application of the defense.

The Development Of The Right Of Assembly: A Current Socio-Legal Investigation, George P. Smith Ii
Scholarly Articles
It will be the purpose of this article to assay the historical evolution of the freedom of assembly, noting first its development in England and later in America and finally its current position in the twentieth century. Even though the rights of free speech, association, and religion are inescapably drawn into case discussions of freedom of assembly, effort will be made to confine the consideration to the pertinent assembly problems. In addition to considering the fundamental legal propositions embodied in this right, as well as its raison d'etre, thought and discussion will be given to the sociological interpretations of the …
