Compulsory Commitment: The Rights Of The Incarcerated Mentally Ill Aug 1969

Compulsory Commitment: The Rights Of The Incarcerated Mentally Ill

Duke Law Journal

The passage of the District of Columbia Hospitalization of the Mentally Ill Act in 1965 and more recent legislative re-evaluations of state mental health laws manifest a developing concern over the plight of the mentally ill. However, though much attention has been focused on the commitment process, it has been noted that legislative and public concern often has stopped at the asylum door and has left the incarcerated mentally ill at the mercy of inadequate facilities, deficient treatment, and at times antiquated philosophies about mental illness. In addition to reviewing the commitment process as it now exists, this comment examines …

The Federal Fair Housing Requirements: Title Viii Of The 1968 Civil Rights Act Aug 1969

The Federal Fair Housing Requirements: Title Viii Of The 1968 Civil Rights Act

Duke Law Journal

A combination of economics and racial discrimination has over many years forced Negroes into unequal and inadequate housing and living conditions. The Federal Fair Housing Act of 1968 attempted to contribute to the arsenal of legislation with which the federal government hopes to eliminate the ghetto from the American scene. This comment examines this most controversial of recent civil rights laws in light of the social context from which it arose. Areas of potential difficulty in interpretation and construction of the statute are analyzed and conclusions drawn as to the probable effectiveness of the Act in relieving the social evils …

Racial Imbalance, Black Separatism, And Permissible Classification By Race, Norman Vieira Jun 1969

Racial Imbalance, Black Separatism, And Permissible Classification By Race, Norman Vieira

Michigan Law Review

The Article will begin with a discussion of the School Segregation Cases which have been invoked both to sustain and to invalidate corrective racial classification. It will then review federal discrimination against Japanese-Americans and against Indians, as well as the more obscure discrimination found in immigration and naturalization laws. It will also consider, in some detail, the paradoxical rules governing the discriminatory selection of jurors and, in lesser detail, the cases dealing with domestic relations and racial designations. A concluding section will discuss black separatism and general policy matters relating to the correction of imbalance in the schools. The Article …

The Council-Of- Governments Approach To Governmental Fragmentation, Louis F. Comus, Jr. May 1969

The Council-Of- Governments Approach To Governmental Fragmentation, Louis F. Comus, Jr.

Vanderbilt Law Review

Much of the current literature in the field of metropolitan government either sets forth examples of governmental difficulties and inefficiencies which result from the urbanization of our population or merely assumes that such difficulties exist. In either case the prescription usually involves some sort of "metropolitanization" of urban governmental structure. Since such prescriptions are aimed either at metropolitan difficulties in general or at particular inefficiencies, it is useful to consider some of the more frequent complaints. One factor often cited as contributing to various urban ills is the archaic governmental structure of many county governments in metropolitan areas. Counties which …

Strikes And Impasse Resolution In Public Employment, Arvid Anderson Mar 1969

Strikes And Impasse Resolution In Public Employment, Arvid Anderson

Michigan Law Review

Experience indicates that in most instances the right to strike is not an essential part of the public employment collective bargaining process.18 Thus, the crucial issue is not really whether strikes should be permitted or prohibited in the public sector, but whether the collective bargaining process itself can be made so effective absent the right to strike that the need for work stoppages will be obviated. It is my conclusion that certain proven impasse resolution procedures--mediation, fact-finding, and in some cases, even arbitration--can be substituted for the strike weapon in public employment without substantial loss in the effectiveness of collective …

The Free Exercise Of Religion: A Sociological Approach, Joseph M. Dodge Ii Feb 1969

The Free Exercise Of Religion: A Sociological Approach, Joseph M. Dodge Ii

Michigan Law Review

No overriding theory has heretofore been proposed capable of allocating the various rules of decision in free exercise cases according to an appropriate classification of fact situations. This Article suggests an objective sociological approach to defining and weighing the governmental and religious interests inhering in a given free exercise claim in order to eliminate value preferences from the constitutional weighing process. Religious interests will be ranked according to functional criteria internal to all religious systems and not dependent upon the belief content of any given sect. State interests will be analyzed in terms of formalized modes of governmental action involving …

Human Rights: A Tide In The Affairs Of Men, Paul G. Kauper Jan 1969

Human Rights: A Tide In The Affairs Of Men, Paul G. Kauper

Georgia Law Review

MANY movements are discernible in these turbulent days of social change and revolution. Not the least is a great tidal movement, global in its dimensions, for the articulation, extension and more effective vindication of human rights. The celebration in 1968 of the twentieth anniversary of the adoption by the United Nations Assembly of the Declaration of Human Rights riveted special attention on the human rights movement and makes this subject particularly appropriate. Since the phrasing is so apt to describe the situation, I hope I shall be forgiven for cribbing a part of Shakespeare's familiar sentence and using it in …
