The Parole Board's Duty Of Self-Regulation, John P. Quinn Jan 1972

The Parole Board's Duty Of Self-Regulation, John P. Quinn

University of Michigan Journal of Law Reform

This article examines the Michigan Parole Board in terms of its structure, mode of operation, and certain legal issues raised by its procedures. The note argues that the Board's and the legislature's concept of professional, scientific decision-making is not an adequate substitute for the checks and balances which confine and control the discretion of other governmental agencies, and furthermore, that this concept is inconsistent with both the letter and spirit of the Michigan Administrative Procedures Act (MAPA or Act). Thereafter, an approach is suggested by which the Act can be used as a tool to legitimate and rationalize Parole Board …

Constitutional Law-Loyalty Oaths-The United States Supreme Court Relaxes Its Stringent Safeguards

University of Richmond Law Review

Loyalty oaths have long been imposed upon citizens of both monarchies and republics as conditions precedent to the granting of certain governmental favors or to the withholding of certain punishments. But whether the oath is taken to gain a benefit or to avoid a criminal sanction, the aftermath of refusing to take a loyalty oath is that the citizen is penalized. This is not to suggest that a loyalty oath is dangerous per se, although some Justices of the United States Supreme Court have taken this view., Certainly a governmental body should not be denied the power to protect itself …

Constitutional Law-Utility Shutoffs-A Violation Of Due Process Under Color Of State Law?

University of Richmond Law Review

Past judicial decisions concerning the right of a private utility to terminate-service for nonpayment of bills have consistently favored the utility. Yet victims of shutoffs, whether poor or merely outraged and inconvenienced, continue to attack shutoff actions through the regulatory commissions, legislation, and the courts. Their efforts have met with failure in all forums.

Damnum Absque Injuria: When Private Property May Be Damaged Without Compensation In Missouri, J. Nelson Happy

Missouri Law Review

In perhaps no area of the law are the rules more contradictory, confusing and difficult to retain than in eminent domain, and one of the most puzzling concepts in this area is damnum absqua injuria, damage without legal injury. Almost everyone is familiar with the constitutional provisions which guarantee that private property shall not be taken or damaged for public purposes without payment of just compensation to its owner.1 However, there are many factual situations in which tangible damage is done to real property as a result of the state's exercise, or threat of exercising, the power of eminent domain, …

Introduction—The Evolution Of Washington Siting Legislation, Joseph L. Mccarthy

Washington Law Review

In the state of Washington, ground was broken on April 6, 1943, for the construction of the Hanford Engineer Works. The Hanford plant was to produce plutonium, the component of one type of atom bomb. Smyth reported in the summer of 1945 that "the piles are operating at designed power, producing plutonium, and heating the Columbia River." In a footnote of particular interest today, Smyth added: "The actual rise in temperature is so tiny that no effect on fish life could be expected." During the years since World War II increasing emphasis has been placed upon development of peacetime uses …
