The 1973 Obscenity-Pornography Decisions: Analysis, Impact, And Legislative Alternatives, David M. Hunsaker
San Diego Law Review
The purpose of this Article is to examine critically the rationale of those decisions and to assess their actual and potential impact. An exhaustive review of the history of obscenity in the courts is not contemplated nor necessary. Abler attempts at comprehensive treatment have, on occasion, been performed by members of the Court, as well as by scholars in the field. Constitutional history will be employed only insofar as it has a direct bearing upon the new guidelines announced by the Court and what one can expect from their subsequent application.
Incarceration For Civil Contempt: An Asserted Eighth Amendment Challenge Faces A Semantical Defense, Seth J. Kelsey
Incarceration For Civil Contempt: An Asserted Eighth Amendment Challenge Faces A Semantical Defense, Seth J. Kelsey
San Diego Law Review
The recent decisions that have attempted to explain the scope of the Cruel and Unusual Punishments Clause suggest that, abstractly, there may be some merit in the asserted eighth amendment challenge. Before the challenge can be argued from a position of strength, however, there is at least one prerequisite. The "distinction according to purpose" accepted by the courts must be recognized for what it is in many instances-a semantical distinction that fails to look at the coercive imprisonment any further than the locking of the jailhouse door. What strength there is in the challenge, in the context of coercion to …

General Information:
The Law School was established as a department of Richmond College in 1870. In 1890 the family of the late T. C. Williams, who had been a devoted and valued Trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to the T. C. Williams School of Law. At various times the School has received further generous gifts from members of the family of Mr. Williams. A substantial gift came through a bequest from Mr. T. C. Constitutional Law - "State Action" - Racial Discrimination - Taxation - Charitable Deduction - Foundation, David Whitney
Duquesne Law Review
The United States Court of Appeals for the Second Circuit has held that a private foundation's practice of racial discrimination could be, because of its tax-exempt status and other government contracts, "state action" sufficient to invoke the prohibitions of the fourteenth amendment.

The Right Of Married Women To Assert Their Own Surnames, Roslyn Goodman Daum
University of Michigan Journal of Law Reform
This article, then, will attempt to frame the issues involved in the name change controversy and to suggest not only ways to implement reforms, but also the consequences attending these measures. Massachusetts has been chosen as the setting for an in-depth analysis of each problem, and examples of legislative, judicial, and administrative action in that state will be interspersed throughout. The results of the efforts in Massachusetts may be politically and legally instructive for people with similar interests in other jurisdictions.
Toward International Freedom Of Religion: A Proposal For Change In Fcn Treaty Practice, Bruce F. Howell
Toward International Freedom Of Religion: A Proposal For Change In Fcn Treaty Practice, Bruce F. Howell
University of Michigan Journal of Law Reform
Since the founding of this nation, Americans have relied on fundamental constitutional principles for the ultimate protection of their religious liberty. These guarantees have been extended to all persons in the United States, not just citizens. American nationals traveling or living abroad may discover, however, that religious freedom is not regarded as a fundamental right elsewhere. Although most nations do, at least in principle, adhere to the basic idea of freedom of religious belief and exercise, religious freedom may be denied either to a state's own citizens or to foreign nationals within its boundaries.
