Constitutional Law-State and Local Tax-- Nondiscriminatory Ad Valorem Property Tax on Imports Stored in Warehouse Pending Sale Is Not Prohibited by Import-Export Clause

The framers of the Constitution enacted the import-export clause with the apparent intent that it remedy shortcomings of the Articles of Confederation and achieve specified national goals. Since the Articles of Confederation allowed individual states to regulate commerce as they saw fit, the seaboard stales, through whose ports goods in foreign commerce had to pass, were able to impose duties on imports destined for inland states. One reason for the import-export clause was to preserve harmony among …

Prospective Remedies In Constitutional Adjudication, Doug Rendleman Feb 1976

Prospective Remedies In Constitutional Adjudication, Doug Rendleman

West Virginia Law Review

The archetypal constitutional plaintiff represents a class, sues in federal court, and asks the court to declare something unconstitutional and to effect a remedy against a local or state government official. If this litigant succeeds, the court must accommodate its remedy to federalism's perquisites. The remedy should advance some substantive or constitutional purpose. The mutual respect compelled by federalism exacerbates the inherent difficulties of attaining a successful remedy. This article examines the remedial relationships between class actions, declaratory judgments, and injunctions. The remedial task is to convert law into results. Most people comply with the law when it is communicated …

Notes And Comments: Pretrial Detention In Maryland: The Aftermath Of Gerstein V. Pugh, Shelly E. Mintz

University of Baltimore Law Review

In Gerstein v. Pugh the United States Supreme Court held that although a suspect arrested without a warrant is entitled to a judicial determination of probable cause to detain, the procedure for such a determination is not a "critical stage" of the prosecution. The author examines the implementation of the Gerstein decision in Maryland and concludes that the present procedures are inadequate to safeguard Fourth Amendment rights of an accused.

Cargo Of Fire: A Call For Stricter Regulation Of Liquefied Natural Gas Shipment And Storage, Philip Weinberg Jan 1976

Cargo Of Fire: A Call For Stricter Regulation Of Liquefied Natural Gas Shipment And Storage, Philip Weinberg

Fordham Urban Law Journal

The imminent prospect of importation of large quantities of liquefied natural gas (LNG) through congested harbors and its storage in huge tanks in densely-populated urban areas provides a classic instance of our technological reach exceeding our grasp. The severe danger of widespread fire impels an exhaustive examination of the need to import LNG through busy harbors and to store it within cities. Such conveyance and storage expose millions of persons and millions of dollars of property to extraordinary harm. Three aspects of proposed importation of LNG are particularly disturbing: (1) the federal government's insistence on promoting LNG importation prior to …

Notes And Comments: Maryland Laws On Child Abuse And Neglect: History, Analysis And Reform, Barry L. Steelman

University of Baltimore Law Review

Children in our society are too often the victims of abusive and neglectful parents and guardians. Although Maryland was among the first jurisdictions to enact protective legislation for abused and neglected children, the Maryland legislature must continue to respond to the plight of these victims. The author traces the development of the Maryland child abuse and neglect laws, analyzes the effectiveness of these laws today, and discusses those changes necessary to afford Maryland children the fullest protection possible.
