The Case For Provincial Regulation Of Community Antenna Television Systems In The Wake Of Capital Cities And Dionne, Robert P. Doherty
The Case For Provincial Regulation Of Community Antenna Television Systems In The Wake Of Capital Cities And Dionne, Robert P. Doherty
Dalhousie Law Journal
While observers of the Canadian Constitution may believe that jurisdiction over cable television in this country was finally and clearly given to the federal government and its Canadian Radio-Television and Telecommunications Commission, by the Capital Cities and Dionne cases, there is still much to be decided. If there are any doubts, then consider news reports of November 1978, and January and February 1979 which highlighted the prominence of cable television as a negotiable federal/provincial subject at several conferences. Vibrations from several provincial governments 4 indicate that cable television and data communications are two areas of communications that provinces would dearly …

A Sense Of Proportion And A Sense Of Priorities: Reflections On The Report Of The Task Force On Canadian Unity, J. Stefan Dupré, Paul C. Weiler
Articles & Book Chapters
The elegantly written Report of the Task Force on Canadian Unity is the most recent product of our constitutional reform industry. In many respects it is the most impressive. It deserves attention if for no other reason than the make-up of the group which produced it. The Task Force was composed of both men and women, politicians and scholars, persons with experience in the business community and in the union movement, and representatives of each of our far-flung regions. Its co-chairmen, Jean-Luc Pepin and John Robarts, are two of the most experienced and respected public figures in Canada. The Commissioners …

Exhibitionism: A Psycho-Legal Perspective, Marilyn Ruth Riley
Exhibitionism: A Psycho-Legal Perspective, Marilyn Ruth Riley
San Diego Law Review
The criminalization of exhibitionism is indicative of our society's unwillingness to deal rationally with sex offenses. As a result of this attitude, present treatment of exhibitionists is ineffective and even harmful. Ms. Riley argues that in order to encourage a more appropriate response to these men, their condition must be viewed from a psycho-legal perspective, which considers the presence of emotional disorders in individuals caught up in the penal system. Applying this perspective, the author proposes a diversion program that incorporates medical understanding of the disorder and therefore offers the possibility of curing exhibitionists and restoring them as productive members …

Income Tax Aspects Of The Vow Of Poverty, Nancy H. Wilberding
University of Dayton Law Review
Religious orders, which by their nature are typically under the jurisdiction and control of a church, were present in the United States long before the enactment of the sixteenth amendment which authorized the present federal income tax. The Internal Revenue Code generally defines gross income for individuals and organizations alike as income from whatever source derived. Nevertheless, certain organizations which are tax-exempt are not required to pay tax on their income, unless the income is from a business unrelated to the exempt purposes of that organization. It is typical for many religious orders to require a member to take a …

Rationalizing Administrative Searches, Michigan Law Review
Rationalizing Administrative Searches, Michigan Law Review
Michigan Law Review
At the outset, this Note examines the major decisions concerning administrative searches. Specifically, it traces the development of a warrant requirement and of the corresponding lower standard of probable cause announced in the Camara and See decisions. Subsequent modifications of that seemingly absolute rule are then analyzed. To develop a framework for evaluating administrative search cases, Section II groups those principal Supreme Court cases, along with pertinent lower court opinions, into three tiers of fourth amendment protection: administrative searches that require a warrant based on a traditional criminal standard of probable cause; administrative searches that require a warrant based on …

The spread of contagious diseases has been a major problem that has plagued society throughout history. In the recent past, smallpox and polio have struck down thousands of individuals, and today German Measles and other serious viruses continue to threaten the health of our population. Fortunately vaccines have been developed that help prevent these diseases from spreading through our population, and presently a large number of the communicable diseases can be combatted.
Schools are the most likely place for the spread of contagious diseases because of the daily contact of large numbers of students and teachers. The states have developed …
