Contractual Control Over Adjective Law, Nathan Isaacs Nov 1922

Contractual Control Over Adjective Law, Nathan Isaacs

West Virginia Law Review

Adjective law, it is generally assumed, is a matter for the courts. The only reference to any attempt to control questions of practice and procedure contained in the ordinary treatises on contract law comes under the general proposition that it is against public policy and therefore beyond the power of contracting parties to interfere with the ordinary course of justice. To this proposition there are, of course, exceptions. But the authors generally do not feel called upon systematically to present these exceptions so as to inform the draftsman of a contract just exactly what, if anything, can be done towards …

Cause, Legal Cause And Proximate Cause, Albert Levitt Nov 1922

Cause, Legal Cause And Proximate Cause, Albert Levitt

Michigan Law Review

Man is a social being; but neither by instinct nor through training does he always express himself so that no one is hurt through his self-expression. Each individual at some time or other acts in such a way that the result of his activity is an injury to himself, to another, or to the social organization of which he is a part. His activities, therefore, need to be watched and controlled. It is the function of the legal ordering of society to exercise such watchfulness and control. The law is a method of social control, and legal principles, concepts, standards …

Net Income And Judicial Economics, Henry Rottschaefer Apr 1922

Net Income And Judicial Economics, Henry Rottschaefer

Michigan Law Review

A legal system does not function in a vacuum of abstractions. It is part of a general institutional framework of an organized society. Its content is determined by concrete individual and social needs and activities. Hence modern jurisprudence conceives of law as a means for securing interests. The appraisal of its rules and principles requires an evaluation of the significant elements of the situation to which they apply. A narrow, complacent formalism is the penalty of failure in this regard. No one would deny the emphasis modern society places upor its commercial and industrial interests, nor the many points of …

Note And Comment, Edgar N. Durfee, Cyril E. Bailey, Edwin B. Stason, William C. O'Keefe, Clyde Y. Morris

Michigan Law Review

The Basis of Relief from Penalties and Forfeitures - The equitable principle of relief from penalties and forfeitures is so far elementary as almost to defy analysis. Many, perhaps most, of the judicial explanations of the principle have based it upon interpretation or construction, appealing to the doctrine that equity regards intent rather than form. Yet a logical application of this doctrine would lead to results very different from those which have actually been arrived at in the decisions. Thus, a stipulation in a mortgage that the mortgagor waives his equity of redemption can hardly be interpreted as meaning that …

What does a judge do when he decides a case? It would be interesting to collect the answers ranging from those furnished by primitive systems of law in which the judge was supposed to consult the gods to the ultra-modern, rather profane system described to me recently by a retrospective judge: "I make up my mind which way the case ought to be decided, and then I see if I can't get some legal ground to make it stick." Perhaps the widespread impression is the curiously erroneous one lampooned by Gnaeus Flavius (Kantorowitz). The judge is supposed to sit at …

Objective Law Examinations, George P. Costigan Jr Mar 1922

Objective Law Examinations, George P. Costigan Jr

Michigan Law Review

In an article on "Objective Law Examinations" in the December, 1921, number of the ILIINOIS LAW REvIww,' Professor Albert Kocourek gives a somewhat idealistic, and to the present writer an unconvincing, argument for that kind of law school examination where the student is to answer merely Yes, No, or-this last to a limited number of questions-O, (unanswered). The argument is largely statistical, being based on an experiment with fifty-three (53) law students, mainly, if not entirely, of the first year, in the course known at Northwestern as Chattels I, and with fifty-six (56) college students, unacquainted presumably with any but …

Emotional Disturbance As Legal Damage, Herbert F. Goodrich Mar 1922

Emotional Disturbance As Legal Damage, Herbert F. Goodrich

Michigan Law Review

Mental pain or anxiety the law cannot value, and does not pretend to redress, when the unlawful act complained of causes that alone." Lord Wensleydale's famous dictum in Lynch v. Knight1 will serve as a starting point for this discussion. His lordship's notion of mental pain is evidently that of a "state of mind" or feeling, hidden in the inner consciousness of the individual; an intangible, evanescent something too elusive for the hardheaded workaday common law to handle. Likewise, in that very interesting problem regarding recovery for damages sustained through fright, it is always assumed, tacitly or expressly, that mere …
