Broadening Legal Education, Edgar Noble Durfee Dec 1932

Broadening Legal Education, Edgar Noble Durfee

Michigan Law Review

The adoption of the case-method was a wild venture into the unknown, and even now, after a half century of experience, its wisdom is not proved in any strict sense. I remind the reader of this in order that there may be between us a clear understanding that any discussion of legal education moves in the realm of opinion. And there are other difficulties. Legal education is an eminently practical business, a tangle of conflicting factors. Wisdom lies in compromise and patient shaping of details. I shall therefore concern myself not so much with formulation of principles as with details …

University Of Richmond Bulletin: Catalogue Of The T.C. Williams School Of Law For 1932-1933, University Of Richmond

Law School Catalogues

General Statement:

A Law School was first established in Richmond College in 1870. From the beginning there were able professors, but financial support was uncertain. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to the T. C. WILLIAMS SCHOOL OF LAW. At various times the School has received further generous gifts from members of the family of Mr. Williams. The largest of these gifts came …

Labor Injunctions-Federal Statute Defining And Limiting The Jurisdiction Of Courts Sitting In Equity Jun 1932

Labor Injunctions-Federal Statute Defining And Limiting The Jurisdiction Of Courts Sitting In Equity

Michigan Law Review

The latest effort of organized labor to protect itself against judicial interference in industrial disputes is to be found in the Norris anti-injunction bill, passed by Congress early this year and signed by the President on March 23, 1932. Its object is to limit the powers of federal courts at law and in equity, and chiefly to regulate the grant of federal injunctions in labor disputes. Similar legislation, state and federal, has encountered many obstacles, either by way of restrictive interpretation or through constitutional limitations. It is, therefore, interesting to examine not only the main provisions of the Norris Act …

Judicial Examination Of The Accused-A Remedy For The Third Degree, Paul G. Kauper Jun 1932

Judicial Examination Of The Accused-A Remedy For The Third Degree, Paul G. Kauper

Michigan Law Review

In its report on "Lawlessness in Law Enforcement" the Wickersham Commission concludes that in the police systems of a number of American municipalities the "third degree" is very generally practiced as a means of extorting from accused persons under arrest confessions, incriminating statements, and other information of value to the police. The conclusion of the Commission confirms the results of private investigation made in the same field. It is true that the. methods of inquiry pursued by the Commission leave doubt as to the accuracy of some of the facts reported. But the quality of the evidence submitted as the …

Equitable Limitations On Statutory Or Charter Powers Given To Majority Stockholders, Norman D. Lattin Mar 1932

Equitable Limitations On Statutory Or Charter Powers Given To Majority Stockholders, Norman D. Lattin

Michigan Law Review

The object of this paper is to examine certain fundamental corporate changes which statutes or articles frequently authorize majority stockholders, or a certain proportion of all, to bring about, and to ascertain whether courts have looked simply to the literal wording of the authority and have sanctioned the action if in accord with the statute or whether they have implied equitable restrictions in spite of apparently unlimited authority in the statute or articles. How far, for example, have courts gone in the direction of the business man's idea that the corporation, after all, is a democratic affair, and that the …

Protection Of Employees Against Abrupt Discharge, G. T. Schwenning Mar 1932

Protection Of Employees Against Abrupt Discharge, G. T. Schwenning

Michigan Law Review

The dismissal compensation law movement is a significant, though relatively new, effort on the part of industrial nations to minimize the hazards of employment uncertainty. It is a development in labor legislation of recent origin designed to stabilize employment contracts by limiting employers' freedom of arbitrary and abrupt discharge. Where such statutes have been enacted, employers are required to give their employees advance notice of the termination of the labor contract or to pay compensation in lieu of notice. The length of the time of notice ranges in different countries from five days to two years, while the discharge compensation …

Gifts Causa Mortis - Contemplation Of Suicide

Michigan Law Review

The testator, suffering from melancholia and contemplating suicide, purchased a certificate of stock in the name of his brother and caused it to be deposited in a bank by the latter. Over two months thereafter, the testator stated, in effect, that in the event of his death the certificate should become the brother's property. Held, in affirming the allowance of the final account of the executor, that the transfer of the certificate was a valid gift causa mortis. In re Van Wormer's Estate, 255 Mich. 399, 238 N.W. 210 (1931).
