Ai Race Between The Us And China, Kennedy Lyon-Lindersmith Aug 2026

Ai Race Between The Us And China, Kennedy Lyon-Lindersmith

Discovery Day - Daytona Beach

Technological leadership in AI and semiconductor manufacturing are both directly linked with military power and geopolitical influence. At the same time, the U.S. and China are currently defining the future of conflict in the cyber domain and are in strategic competition as China attempts to displace the U.S. as a global leader in AI. These factors contribute to an important national security threat that the U.S. is facing right now: An AI race between the U.S. and China, specifically regarding military cyber operations. This paper discusses some of the implications of a digital battlefield and analyzes international laws, international institutions, …

Beyond Walls And Wires: The Supreme Court’S Recognition Of Digital Privacy Under The Fourth Amendment, Joanna Morris Aug 2026

Beyond Walls And Wires: The Supreme Court’S Recognition Of Digital Privacy Under The Fourth Amendment, Joanna Morris

Discovery Day - Daytona Beach

The Founding Fathers included the Fourth Amendment in the Bill of Rights to protect individuals from unreasonable searches and seizures and their right to privacy. However, rapid advances in modern digital technology have challenged traditional definitions of privacy, raising constitutional questions about digital privacy rights. Smartphones and location tracking collects personal information that does not fit neatly within pre-digital era Fourth Amendment doctrines. This research examines how the United States Supreme Court has adapted interpretations of the Fourth Amendment to address digital privacy concerns, focusing on the tensions between Fourth Amendment doctrines and technology that enables extensive government access to …

Recommendations For An International Regulatory Regime For Commercial Space, Margaret O'Brien Aug 2026

Recommendations For An International Regulatory Regime For Commercial Space, Margaret O'Brien

Discovery Day - Daytona Beach

The rapid advancement of space technologies in both governmental and private sectors presents a significant challenge for existing space law frameworks. Emerging activities such as space mining are gaining international attention, yet lawmakers struggle to craft regulations for an industry that is still in development. Innovators and investors often hesitate to assume risk in the absence of clear international guidelines. This research explores the complex legal and policy considerations surrounding space resource utilization, including the lack of consensus with existing treaties, the unpredictability of potential hazards, and the widening technological gap between industrialized and developing nations. Historical frameworks, such as …

Deporting Disability, Tania Valdez Aug 2026

Deporting Disability, Tania Valdez

Faculty Publications

Since the enactment of the earliest migration laws in the United States, people with disabilities have been targeted for exclusion and expulsion based on stereotypes that they are either dangerous or not productive. Although some of the pejorative language regarding disability in the Immigration and Nationality Act (INA) has changed over time, certain statutory provisions and the very structure of the INA still allow ableism to operate broadly in immigration adjudications. This Article focuses on the subtle, but pervasive, ways that immigration law disfavors noncitizens with disabilities. In particular, this Article examines ableism in the context of removal (commonly known …

Coca-Cola Redux: The Problematic Absence Of Comparables, Reuven S. Avi-Yonah Aug 2026

Coca-Cola Redux: The Problematic Absence Of Comparables, Reuven S. Avi-Yonah

Articles

On June 25 a three-judge panel of the Eleventh Circuit Court of Appeals heard oral arguments in Coca-Cola v. Commissioner. It is very hard to predict outcomes from oral arguments, but two of the judges asked questions that suggested they were open to accepting the taxpayer’s “bait and switch” argument. They also seemed receptive to the treaty argument. Interestingly, there was less focus on the taxpayer’s marketing intangibles argument, which I regard as the better one.

Corruption In The Service Of The Common Good: The Legitimation Of Traditional Practitioners In Cameroon, Victorine Oyane Ossah Aug 2026

Corruption In The Service Of The Common Good: The Legitimation Of Traditional Practitioners In Cameroon, Victorine Oyane Ossah

Journal of Law and Public Policy

This article shows how health law and public policy, in seeking to regulate traditional medicine, without fully recognising it, paradoxically end up producing the very social conditions for the corruption that they are supposed to combat. The aim is to identify, based on the experience of traditional healers, the various factors that contribute to establishing corruption not as a moral choice, but as a pragmatic strategy for preserving their knowledge, resources, and place in the healthcare system. The analysis presented is based on a qualitative survey of 30 traditional medicine practitioners in Yaoundé and Douala between 2021 and 2026, in …

Zeus Network And The Commercialization Of Conflict: A Critical Analysis Of Exploitation, Representation, And Reality Television, Delante Clark Aug 2026

Zeus Network And The Commercialization Of Conflict: A Critical Analysis Of Exploitation, Representation, And Reality Television, Delante Clark

Graduate Scholarship and Creative Works

This study examines Zeus Network as a prominent example of the commercialization of conflict within contemporary digital media. Through reality based programming that frequently emphasizes confrontation, public humiliation, emotional volatility, and interpersonal disputes, the network has cultivated a profitable entertainment model built upon spectacle and controversy. Drawing upon conflict theory, critical race theory, and media sociology, this paper investigates whether Zeus functions as a platform for cultural representation and economic opportunity or as a system that monetizes dysfunction for audience consumption. Particular attention is given to the portrayal of Black women and Black communities, whose experiences often become central to …

Strings Attached: Science Regulation By Science Funders, Nicholson W. Price Ii Aug 2026

Strings Attached: Science Regulation By Science Funders, Nicholson W. Price Ii

Reviews

Who regulates the physical and informational risks of scientific research? Who makes sure that researchers keep intensely personal data secret, or lock their dangerous chemicals away safely, or don't haphazardly create superviruses that could kill us all? You could be forgiven for assuming it was, well, a regulator—OSHA or the CDC or some similar entity that can promulgate binding rules and enforce them. But as Doni Bloomfield shows in the fascinating How Science Grantmakers Govern, you’d be (mostly) wrong. Instead, a key substantive and procedural regulator of the risky business of scientific research is, in fact, the funder of that …

Who Controls The Block? How States Can Regulate Tokenized Residential Real Estate, David J. Reiss, Joseph Bizub, Justin Peralta Aug 2026

Who Controls The Block? How States Can Regulate Tokenized Residential Real Estate, David J. Reiss, Joseph Bizub, Justin Peralta

Cornell Law Faculty Working Papers

In July 2025, the City of Detroit filed a major nuisance abatement action against RealT, a fintech that had sold blockchain-based fractional interests in more than four hundred Detroit rental properties to some 22,000 investors around the world. Within a year, a court had ordered the company’s rents into escrow, the company had conceded to its investors that its “model no longer works,” and it had announced the liquidation of its portfolio -- leaving tenants without basic services and token holders facing steep losses.

This article uses the rise and collapse of RealT, together with case studies of the other …

Assessing The Impact Dynamics Of Less Lethal Ammunition, Steven Bermejo Aug 2026

Assessing The Impact Dynamics Of Less Lethal Ammunition, Steven Bermejo

Student Theses

Less-lethal ammunition is widely used by law enforcement as an alternative to lethal force during crowd control, on-street confrontations, and other situations requiring force. Although these projectiles are intended to reduce risk of fatal injury, serious injuries and fatalities have been reported, highlighting the need to better understand the factors that influence their impact behavior. This study evaluated the impact dynamics of four types of 12-gauge less-lethal ammunition, including rubber buckshot, single rubber ball, double rubber ball, and Byrna kinetic projectile, using kinetic energy calculations derived from projectile mass and velocity measurements. In addition, Attenuated Total Reflectance Fourier Transform Infrared …

Real Bullets, Plastic Guns: Evaluating The Strength Of 3-D Printed Gun Parts, Maria Latenia Mayol Aug 2026

Real Bullets, Plastic Guns: Evaluating The Strength Of 3-D Printed Gun Parts, Maria Latenia Mayol

Student Theses

Privately made firearms (PMFs), often referred to as “ghost guns,” are firearms manufactured or assembled by individuals rather than federally licensed manufacturers. Although the terms are frequently used interchangeably, “ghost gun” more specifically describes an unserialized firearm, whereas PMFs include a broader range of firearms produced through nontraditional manufacturing methods. PMFs may be entirely 3-D printed, assembled from partially completed firearm kits, or constructed by integrating additively manufactured components with commercially manufactured firearm parts. The increasing accessibility of additive manufacturing and widespread dissemination of computer-aided design files have raised concerns about concealment, regulation, and forensic evasion, particularly when factory-manufactured components …

From Global Principles To National Implementation: The 9th Un Conference And Its Product Safety Resolution, Suruchi ., Kumar Jyotish

International Journal on Consumer Law and Practice

The 9th United Nations Conference on Competition and Consumer Protection of 2025 advanced international consumer protection law by extending its scope. The Product Safety Resolution adopted at the Geneva-based conference is the first binding global resolution on product safety. Addressing the wide scope of problems associated with the emergence of more complex global and online markets, the Resolution presents a set of legal criteria to ensure the safety of goods, liability of defaulting manufacturers, rights of consumers, and the laying out of appropriate procedures. This paper presents a critical evaluation of the normative context of the Resolution and its variation …

Data Centers As Engines Of Corporate Tax Base Restructuring, Reuven S. Avi-Yonah, Domenico Imparato, Karen Sam Aug 2026

Data Centers As Engines Of Corporate Tax Base Restructuring, Reuven S. Avi-Yonah, Domenico Imparato, Karen Sam

Articles

Globalization has eroded the corporate income tax by undermining both source-and residence-based taxation. Before the 1980s, large capital-exporting countries could impose relatively high tax rates on multinationals and extend taxation to low-taxed foreign income earned through controlled foreign corporations, as exemplified by the U.S. adoption of subpart F in the Revenue Act of 1962. That regime supported corporate tax revenues that reached roughly 25 percent of total U.S. receipts in the mid-20th century.

Globalization changed that equilibrium. Multinational corporations gained the ability to arbitrage national tax systems by relocating and reporting profits in low-tax jurisdictions. Active income largely escaped source …

A Poetic Call For And A Reflection And Commentary On Clarity, Understanding, Hope, Courage, And Compassion, Carroy U. Ferguson Aug 2026

A Poetic Call For And A Reflection And Commentary On Clarity, Understanding, Hope, Courage, And Compassion, Carroy U. Ferguson

Psychology Faculty Publication Series

Finding a published poem I had written as a teenager, titled “The Heavens Weep.” this article uses that poem as the basis for a commentary that reflects on the state of the world today (2026),  As a commentary, the article uses the poetic and metaphoric words in the poem as a relevant "reality check" for what is still going on today.  In essence, the commentary is about a call for Clarity, Understanding, Hope, Courage, and Compassion, or what I call Archetypal Energies, Higher Vibrational Energies that operate deep within our individual and collective psyches to creatively urge us to "see" …
