United States Policy Toward The Transfer Of Proprietary Technology: Licenses, Taxes, And Finance, Gary C. Hufbauer, George N. Carlson

Vanderbilt Journal of Transnational Law

Much of the nation's technology is developed in public institutions, especially universities and government research laboratories, and is freely available through libraries and classrooms. Roughly one-half of total United States research and development expenditures are funded by the United States Government, and the findings from this research are generally available to citizens and foreigners at little or no charge. In addition, a great deal of technology that was once guarded by patents or trade secrets has since passed into the public domain. This paper ignores these freely available segments of the national technology base and discusses proprietary technology.

The Article concludes that neither the impartial mission of the rule of law nor the neatly tooled goal of individual justice has been served by the governmental response to conjugal violence, and suggests the elements from which a valid approach may be constructed.

The Elderly Have Spoken: Is Anybody Listening? The Impact Of Fuel Costs On The Elderly, Scott A. Bass, Richard Rowland

This report contains the findings of a study carried out by the Gerontology Program at the University of Massachusetts Boston concerning the effects of the escalating fuel costs on the lives of the elderly who must pay for their own heat. Through the use of an interview format known as "modified critical incident" technique, a team of mostly elderly students spent several weeks during the winter of 1980 eliciting responses from more than 100 elderly individuals from throughout the greater Boston area. This Comment examines the unilateral development of fishery or economic zone in the contiguous waters of coastal States, and attempts to address the question of whether, in the absence of a validating global treaty, legal rights and obligations are created in the international community through these claims. The author explores the use of the customary law formation process as an alternative to the creation of international law by convention at the Third United Nations Conference of the Law of the Sea. Global Conservation And Management Of Marine Mammals, James A.R. Nafzinger

San Diego Law Review

This Article examines the potential role that the Third United Nations Law of the Sea Conference has in the development of an ecologically sound global regime to conserve and manage marine mammals. The author first examines the current regime of municipal legislation, nongovernmental programs, bilateral agreements, regional agreements, and limited global authority. The author then discusses the emerging regime under UNCLOS III as an alternative to the present fragmented authority. Exportation Of Hazardous Products, Janet Berk

Syracuse Journal of International Law and Commerce

Allowing the exportation of hazardous products, even though they cannot be sold in the United States, creates a double standard. The exportation of domestically banned or restricted products also presents serious risks for 'American consumers.' Once a product is banned, there is no guarantee that it will not subsequently reenter the United States under the guise of an acceptable label. This Comment discusses why and how the double standard should be eliminated.
