The International Regulation Of Small Cetaceans, Cynthia E. Carlson

San Diego Law Review

This Article examines the current international regulatory regime for the conservation and management of cetaceans. The author argues that there are approximately sixty species of small cetaceans, but because the primary focus of the International Whaling Commission (IWC) has been the setting of commercial harvest levels and conservation measures for large cetaceans, nations have assumed that the IWC's jurisdiction is limited to the regulation of larger species, although nowhere in the IWC Convention or in any rule or regulation is the term "whale" defined. In Toyko recently I called upon an official of the Ministry of International Trade and Industry (MITI) to discuss trade frictions between the United States and Japan. On the way to my appointment I passed by Hibiya Park in the center of the city. About 10,000 people were gathered in a peaceful demonstration against any lifting of Japan's quotas on imports of agricultural products. The passage of the World Health Organization (WHO) "International Code of Marketing of Breastmilk Substitutes" (Code of Breastmilk Substitutes) in May of 1981 marked a great achievement in the fight for improved infant health, but did not signify a lasting solution to the problem of poor marketing practices of infant formula manufacturers. The implementation of the Code of Breastmilk Substitutes is a long and difficult process because the Code was adopted as a recommendation under article 23 of the WHO Constitution, rather than as a regulation. Tort Law - Product Liability - Manufacturer's Duty To Provide Necessary Safety Equipment - Effect Of Purchaser's Request That Safety Equipment Be Removed, William A. Behare

The United States Court of Appeals for the Third Circuit has held that under Pennsylvania law where a knowledgeable purchaser of equipment instructs the manufacturer to remove a standard safety device prior to the equipment's delivery the manufacturer is liable for injuries resulting from the lack of the safety device even where the equipment was used by an experienced operator.

Hammond v. International Harvester, 691 F.2d 646 (3d Cir. 1982).

A Matter Of The Quality Of Birth: Mothers And Midwives Shackled By The Medical Establishment And Pennsylvania Law, Dale Elizabeth Walker

Duquesne Law Review

Recent studies have revealed that advances in medical technology, when indiscriminately applied, increase the risk of complications for mothers and infants during labor and delivery. This comment explores the historical development of midwifery regulation in Pennsylvania, and suggests that it is ripe for challenge on constitutional grounds to counter the dangers posed by a pathological approach to childbirth which is associated with the medical establishment. The author contends that a legal environment conducive to the practice of midwifery would solve the problems created by high cost, high-tech birthing techniques.

This Article will suggest an approach to facilitate decision-making where the concepts of quality of life and sanctity of life appear to clash. It is hoped that a reconciliation of these two ideas will provide an alternative to the increasing federal intervention in the process of family decision-making vis-a-vis handicapped infants.

The United Nations has responded to marine pollution by charging its specialized agency, the Inter-Governmental Maritime Consultative Organization ("IMCO"), with the dual obligations of improving mari- time safety and preventing marine pollution. Yet, despite several major conventions intended to eliminate outmoded tanker designs and pollut- ing practices, oil spills and discharges continue. This article will address the question of compliance with and en- forcement of international agreements concerning oil pollution by tank- ers. This article seeks to illuminate the difficulties in finding causation between cancer development and toxic substances. Section II gives a brief history of cancer in society as well as an introduction to the biological cancer mechanism, and highlights our general lack of knowledge about cancer. Section III takes a brief look at some occupations and environmental factors that have been suggested causes of cancer. Section IV discusses in depth the problems with establishing association between toxic substances and cancer, especially in establishing causal significance. United States pesticide manufacturers are exporting increasingly large amounts of pesticides which are banned or restricted for use in the United States. The use of these pesticides presents dire health and environmental consequences in the developing countries which import the pesticides. Current United States policy dealing with the problems raised by pesticide export stresses notification of recipient countries when such pesticides are exported. This Note contends that the notification policy is fundamentally flawed in that developing countries cannot make use of the information provided by the notification process. The international pharmaceutical trade is important to both exporting and importing countries. Exporting countries are concerned with maintaining and further expanding their foreign pharmaceutical markets.1 Importing countries, especially developing or less developed countries (LDC's),2 are concerned with the price and quality of drugs that they import.3 Poor and newly independent states that have no pharmaceutical industry of their own are the most vulnerable in the international pharmaceutical trade.
