Walking A Gray Line: The Color Of Law Test Governing Noncitizen Eligibility For Public Benefits, Robert Rubin

San Diego Law Review

This Article analyzes the color of law standard in determining eligibility of noncitizens for public benefits, and outlines the impact of the Immigration Reform and Control Act of 1986 on benefit eligibility. The author reviews the legislative history and judicial construction of the standard, and proposes a working definition of "permanently residing. . . under color of law" that would include those aliens with implied or express permission to remain in the country, but exclude undocumented aliens and those who are temporarily present.

Having successfully initiated and developed the legal aspects of the Exclusive Economic Zone (EEZ) the challenge which now arises for the developing coastal nations is to implement an ocean management system to more fully realize the potential benefits of extended jurisdiction. This study discusses the needs and problems developing nations may encounter in developing such a management system and also considers the ways and means to meet these needs and overcome these problems. The study suggests that coastal nations should adopt an integrated three phased ocean policy process consisting of a (1) priority establishment phase (policy formulation) (2) strategic phase …

Regulation Of The Export Of Pharmaceuticals To Developing Countries, Nancy E. Pirt

Duquesne Law Review

The advent of modern pharmaceuticals has markedly improved the public health in developed countries, yet in the developing world, disease is pandemic. In this article, the author outlines the difficulties inherent in regulating the export and production of drugs for less developed countries. The author first traces the history of anglo-american drug legislation as a prelude to discussion of the characteristics of the pharmaceutical industry. Next, the author sets forth the major problems as seen by the developing world regarding pharmaceutical imports. Lastly, the author offers proposals for ameliorative regulations in this area.
