The note examines the regulatory challenges posed by the rise of cryptocurrency platforms like Celsius and FTX, which have faced significant financial difficulties and bankruptcy. These platforms operate similarly to traditional banks and brokerages but lack the same regulatory oversight, leaving customers vulnerable without protections like FDIC insurance. The note argues that adopting legislation akin to the Banking Act of 1933 or the Securities Investor Protection Act (SIPA) could provide necessary safeguards, such as insurance mechanisms similar to FDIC or SIPC. False information poses a threat to individuals, groups, and society. Many people struggle to judge the veracity of the information around them, whether that information travels through newspapers, talk radio, TV, or social media. Concerned with the spread of misinformation and harmful falsehoods, much of the policy, popular, and scholarly conversation today revolves around proposals to expand the regulation of individuals, platforms, and the media. While more regulation may seem inevitable, it faces constitutional and political hurdles. In the last four decades, average temperatures have risen significantly across the United States, with Alaska and New Mexico among the fastest warming states. Since 1970, average temperatures in New Mexico have risen 3.5 degrees Fahrenheit (°F)—or nearly 2 degrees Celsius (°C). The international scientific community has urged world leaders to contain global warming above pre-industrial levels to 1.5°C ideally, and to 2°C at worst. Few definitions of the mid-twentieth century have survived into the twenty-first century. It is worth asking, then, why the definition of "health," articulated seventy-five years ago by the World Health Organization, has endured into the present. The 1948 definition reads as follows: "[h]ealth is a state of complete physical, mental[,] and social well-being and not merely the absence of disease or infirmity." Aspirational in tone, the definition resonates with the surge among consumers towards healthier foods and overall well-being. Part I of this essay describes what is currently understood about the relative health risks of ENDS [electronic nicotine delivery systems] and other vaping products, particularly as compared to combustible cigarettes.

Part II of this essay describes the current regulatory regime governing tobacco products and how this regime has been applied to ENDS and other vaping products.

Part III of this essay explains how the FDA’s regulatory regime hampers the ability of ENDS manufacturers to inform consumers about the relative risks of their products and the potential use of ENDS as smoking cessation aids.

When Kentucky and Arkansas instituted work requirements in 2018 as a condition to receiving Medicaid benefits, residents from both states sued the Trump Administration to block the program, arguing that the requirements were contrary to the Medicaid statute. In Gresham v. Azar, the DC Circuit agreed, holding that "the objective of Medicaid was to furnish medical assistance." Even though the Secretary of Health and Human Services determined that the work requirements were "likely to assist in improving health outcomes," the court concluded that "better health outcomes as [an] objective of Medicaid… lacks textual support. Per- and polyfluoroalkyl substances (“PFAS”) are devastating our food systems and our health. Recent studies link even small exposure to PFAS to a host of adverse health outcomes, including cancer, autoimmune diseases, thyroid disease, liver damage, childhood obesity, infertility, and birth defects.

Food consumption is a primary route of PFAS exposure. PFAS are omnipresent at dangerous levels in our marine and agricultural environments, including in water, soil, fertilizers, compost, and air. From there, they can find their way into virtually every plant, fish, animal, and animal product, and ultimately (in the greatest concentration) into the consumer. In addition, PFAS-laden food …

The average person who menstruates will bleed for an average of five days, every twenty-four to thirty-eight days, over several decades and could use thousands of disposable menstrual products in their lifetime. Menstrual products line retail shelves. They can be found in homes, bags, and bodies—but until 2021, manufacturers were not required to disclose the ingredients used to make these products to consumers at all. In fact, they still are not federally required to disclose menstrual product ingredients on product packaging. Matthew Desmond made the claim in Evicted, his powerful work on housing insecurity, that those concerned with alleviating poverty should focus not merely on ensuring that poor people have higher disposable incomes, but on countering the exploitative price gouging that depresses the value of whatever income they have. This suggests the possibility that it might be a worthwhile anti-poverty strategy for courts to use the unconscionability doctrine to regulate exploitative contracts.

เอกัตศึกษาฉบับนี้ มีวัตถุประสงค์เพื่อมีมาตรการ หรือแนวคิดริเริ่มเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในประเทศไทยให้เติบโตมากขึ้น เพื่อสร้างประโยชน์ในระยะยาวให้กับเศรษฐกิจและสังคมไทยอย่างยั่งยืน ประโยชน์ของธุรกิจดังกล่าวส่งผลกระทบในด้านต่าง ๆ ดังนี้ (1) ประโยชน์ด้านสุขภาพ สามารถช่วยให้มีสุขภาพดีขึ้น รวมถึงลดความเสี่ยงต่อโรคต่าง ๆ (2) ประโยชน์ด้านสิ่งแวดล้อม การรับประทานอาหารทางเลือกจากพืชใช้ทรัพยากรต่าง ๆ เช่น ที่ดิน แหล่งน้ำ และพลังงาน น้อยกว่าอาหารที่มีส่วนผสมจากเนื้อสัตว์ จึงถือเป็นการประหยัดพลังงานและช่วยรักษาสิ่งแวดล้อมได้เป็นอย่างดี (3) ประโยชน์ด้านความมั่นคงทางอาหาร สามารถช่วยลดความเสี่ยงจากการขาดแคลนอาหาร เนื่องจากกระบวนการผลิตอาหารทางเลือกจากพืชใช้ทรัพยากรด้านต่าง ๆ น้อยกว่าผลิตภัณฑ์จากสัตว์ และ (4) ประโยชน์ด้านสวัสดิภาพสัตว์ การรับประทานอาหารทางเลือกจากพืชถือเป็นการคุ้มครองสัตว์ เพราะเป็นการลดการผลิตผลิตภัณฑ์จากเนื้อสัตว์ในฟาร์มเอกัตศึกษาฉบับนี้ มีการดำเนินการวิจัยด้วยวิธีการศึกษาเชิงเอกสาร (Documentary Research) โดยการศึกษาค้นคว้า รวบรวม วิเคราะห์ข้อมูล จากหนังสือ บทความ ตำรา วิทยานิพนธ์ เอกัตศึกษา เอกสารสิ่งพิมพ์ หลักภาษีอากร โดยมีการใช้ฐานข้อมูลออนไลน์ ที่มีบุคคลอื่นได้บันทึกหรือตีพิมพ์เผยแพร่ไว้เกี่ยวกับมาตรการเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในประเทศไทยและต่างประเทศ จากนั้นนำข้อมูลที่รวบรวมได้มาทำการศึกษา เรียบเรียง และวิเคราะห์อย่างเป็นระบบ เพื่อเสนอแนวทางการสร้างแรงจูงใจให้กับผู้ประกอบธุรกิจอาหารทางเลือกจากพืชจากการศึกษา พบว่า ในปัจจุบัน ไทยยังขาดมาตรการส่งเสริมธุรกิจอาหารทางเลือกจากพืชที่ชัดเจนและครอบคลุม เมื่อเทียบกับหลายประเทศที่ให้ความสำคัญกับเรื่องนี้ เช่น สหรัฐอเมริกา สหภาพยุโรป และสิงคโปร์ ทั้งนี้ เพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในไทยให้เติบโตอย่างยั่งยืน ควรมีการดำเนินการดังนี้ (1) จัดทำแผนยุทธศาสตร์ระดับชาติ และกฎหมายเฉพาะเพื่อส่งเสริมอาหารทางเลือกจากพืช: กำหนดเป้าหมายและแนวทางการดำเนินงานที่ชัดเจน (2) บูรณาการนโยบาย เชื่อมโยงนโยบายด้านอาหารกับนโยบายอื่น ๆ เช่น สุขภาพ สิ่งแวดล้อม และเศรษฐกิจ รวมถึงการสนับสนุนการวิจัยและพัฒนา เพื่อส่งเสริมการพัฒนานวัตกรรม ซึ่งจะเป็นองค์ประกอบสำคัญในการพัฒนาผลิตภัณฑ์ใหม่ ๆ และเทคโนโลยีที่เกี่ยวข้อง (3) ส่งเสริมด้านสิทธิประโยชน์ทางภาษีเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในส่วนที่ส่งผลกับอาหารทางเลือกจากพืชโดยตรง เช่น การพิจารณาปรับลดอัตราภาษีมูลค่าเพิ่มสำหรับอาหารทางเลือกจากพืช และส่วนที่เกี่ยวข้องกับการให้สิทธิประโยชน์ทางภาษีทางอ้อม เช่น การหักค่าใช้จ่ายที่ใช้สำหรับการวิจัย (4) สร้างความตระหนักรู้ และประชาสัมพันธ์ข้อมูลเกี่ยวกับประโยชน์ของอาหารจากพืช ทั้งต่อผู้บริโภคเอง และต่อสังคมในภาพรวม (5) สนับสนุนเกษตรกร และส่งเสริมการปลูกพืชที่ใช้เป็นวัตถุดิบในการผลิตอาหารจากพืชการดำเนินการเหล่านี้จะช่วยให้ไทยมีอุตสาหกรรมอาหารทางเลือกจากพืชที่แข็งแกร่ง สามารถแข่งขันในตลาดโลก และตอบสนองความต้องการของผู้บริโภคที่ใส่ใจสุขภาพและสิ่งแวดล้อมมากขึ้น นอกจากนี้ …

การควบคุมการปิดฉลากสารก่อภูมิแพ้ในเครื่องดื่มแอลกอฮอล์, ธนภรณ์ รองทิม

ปัจจุบันแนวโน้มของผู้ป่วยโรคภูมิแพ้อาหารเพิ่มสูงขึ้นทั่วโลก ส่งผลให้หน่วยงานด้านอาหารในหลายประเทศให้ความสำคัญกับมาตรการในการป้องกันโดยเฉพาะการแสดงข้อมูลสำหรับผู้แพ้อาหารบนฉลากผลิตภัณฑ์เพื่อแจ้งให้แก่ผู้บริโภค โดยองค์กรมาตรฐานอาหารระหว่างประเทศ (Codex Alimentarius) ได้กำหนดมาตรฐานกลางขึ้นเพื่อให้ประเทศสมาชิกใช้เป็นแนวทางปฏิบัติที่สอดคล้องกันในประเทศไทย สำนักงานคณะกรรมการอาหารและยา (อย.) ได้ออกประกาศกำหนดให้ผู้ผลิตหรือนำเข้าเพื่อจำหน่ายจะต้องแสดงข้อความ “ข้อมูลสำหรับผู้แพ้อาหาร" บนฉลากผลิตภัณฑ์ หากมีการใช้เป็นส่วนประกอบหรืออาจมีการปนเปื้อนในกระบวนการผลิต อย่างไรก็ตาม กฎหมายเฉพาะที่เกี่ยวข้องกับเครื่องดื่มแอลกอฮอล์ กล่าวคือ กฎหมายว่าด้วยสุราและกฎหมายว่าด้วยการควบคุมเครื่องดื่มแอลกอฮอล์ ยังไม่มีข้อบังคับให้ต้องแสดงข้อมูลสำหรับผู้แพ้อาหาร ส่งผลให้ผู้บริโภคที่มีภาวะภูมิแพ้หรือภาวะภูมิไวเกินอาจไม่ได้รับข้อมูลที่สำคัญอย่างเพียงพอในการตัดสินใจเลือกซื้อสินค้าโดยปัญหาดังกล่าวสามารถแบ่งออกเป็น 2 ประเด็นหลัก ได้แก่ 1) ด้านหน่วยงานผู้บังคับใช้กฎหมาย ซึ่งทำให้เกิดช่องว่างในการกำหนดข้อปฏิบัติที่มุ่งเน้นการคุ้มครองผู้บริโภคในมิติที่แตกต่างกัน และ 2) ด้านการบังคับใช้กฎหมาย ซึ่งมิได้นำหลักของกฎหมายทั่วไปมาบังคับใช้อย่างครอบคลุมในเครื่องดื่มแอลกอฮอล์ แม้ว่าในประเทศอื่น เช่น สหภาพยุโรป ออสเตรเลีย นิวซีแลนด์ และแคนาดา จะมีมาตรการกำหนดให้ต้องปิดฉลากสารก่อภูมิแพ้ในเครื่องดื่มแอลกอฮอล์เช่นเดียวกับอาหารทั่วไปดังนั้น เพื่อให้ประเทศไทยมีแนวทางการควบคุมการปิดฉลากสารก่อภูมิแพ้ในเครื่องดื่มแอลกอฮอล์ที่คุ้มครองผู้บริโภคได้อย่างมีประสิทธิภาพ ควรดำเนินการผ่านกลไกทางกฎหมาย 2 แนวทาง ได้แก่ 1) แนวทางการควบคุมผ่านกฎหมายเฉพาะ โดยเพิ่มข้อกำหนดให้ต้องแสดงข้อมูลสำหรับผู้แพ้อาหารบนฉลากเครื่องดื่มแอลกอฮอล์ และ 2) แนวทางการควบคุมผ่านกฎหมายทั่วไป โดยบังคับใช้กฎหมายทั่วไปให้เคร่งครัดมากขึ้น นอกจากนี้ ควรจัดทำแนวทางการปฏิบัติ (Guideline) เพื่ออำนวยความสะดวกแก่ผู้ประกอบการและผู้บริโภคให้เข้าถึงข้อมูลและปฏิบัติตามกฎหมายได้สะดวกยิ่งขึ้นหากประเทศไทยดำเนินมาตรการตามแนวทางดังกล่าวแล้ว นอกจากจะช่วยคุ้มครองผู้บริโภคให้ได้รับความปลอดภัยและข้อมูลที่จำเป็นอย่างครบถ้วนก่อนตัดสินใจเลือกซื้อเครื่องดื่มแอลกอฮอล์ให้เหมาะสมกับตนเอง ยังช่วยสร้างผลกระทบในเชิงบวกต่อทั้งผู้ประกอบการ ภาครัฐ และเศรษฐกิจของประเทศในระยะยาวได้อีกด้วย

เอกัตศึกษานี้มีวัตถุประสงค์เพื่อศึกษาปัญหาและอุปสรรคการดำเนินการของสถาบันการเงินประชาชนตามพระราชบัญญัติสถาบันการเงินประชาชน พ.ศ. 2562 และกฎหมายที่เกี่ยวข้อง เพื่อเป็นแนวทางในการพัฒนาและปรับปรุงกฎหมายเพื่อให้เกิดประโยชน์สูงสุดในทางปฏิบัติ ผู้เขียนทำการศึกษามาตรการการกำกับดูแล หลักเกณฑ์ เงื่อนไขที่เกี่ยวข้องกับสถาบันการเงินประชาชน เทียบเคียงกับหลักเกณฑ์เงื่อนไขขององค์กรการเงินระดับฐานรากในประเทศไทยและต่างประเทศ และการวิเคราะห์ในเชิงเศรษฐศาสตร์เพื่อสะท้อนให้เห็นถึงข้อจำกัดของพระราชบัญญัติสถาบันการเงินประชาชน พ.ศ. 2562 และกฎหมายที่เกี่ยวข้องที่มีอยู่ในปัจจุบัน พร้อมทั้งนำหลักเกณฑ์ขององค์กรการเงินในระดับฐานรากต่างประเทศ มาเป็นแนวทางในการปรับปรุงและพัฒนาหลักเกณฑ์ให้มีความชัดเจนและเหมาะสมมากยิ่งขึ้น จากการศึกษาและวิเคราะห์พบว่าหลักเกณฑ์การกำกับดูแลของสถาบันการเงินประชาชนในปัจจุบันโดยเฉพาะในประเด็นหน่วยงานที่ทำหน้าที่กำกับดูแลสถาบันการเงินประชาชน และประเด็นการให้สินเชื่อแก่ลูกหนี้รายใหญ่ยังไม่มีความชัดเจน ไม่เหมาะสม มีข้อจำกัดในทางปฏิบัติบางประการ ส่งผลให้การดำเนินงานของสถาบันการเงินประชาชนมีข้อจำกัด ขาดประสิทธิภาพ สมาชิกไม่สามารถเข้าถึงแหล่งบริการทางการเงินได้ ไม่สามารถเป็นที่พึ่งของชุมชนได้อย่างแท้จริง เอกัตศึกษานี้เสนอให้ปรับปรุงหลักเกณฑ์ให้มีความชัดเจนและเกิดประสิทธิภาพมากยิ่งขึ้นโดยเสนอให้ (1) แยกหน่วยงานที่ทำหน้าที่ด้านกำกับดูแลสถาบันการเงินประชาชน กับด้านแผนและนโยบายของสถาบันการเงินประชาชนออกจากกัน (2) หลักเกณฑ์การให้สินเชื่อแก่ลูกหนี้รายใหญ่ เกณฑ์บุคคลพิจารณาเฉพาะผู้ขอสินเชื่อและคู่สมรสตามกฎหมาย และเพิ่มเกณฑ์ทุนกิจการโดยกำหนดมิให้ปล่อยสินเชื่อเกินรายได้จากการดำเนินงานเฉลี่ยย้อนหลัง 3 ปี * 15% * 12.5 สำหรับเกณฑ์เรื่องพื้นที่การดำเนินงานของสถาบันการเงินประชาชนต้องไม่เกินเขตตำบลหรือแขวงที่ตั้งของสถาบันการเงินประชาชนและเขตหมู่บ้านตามกฎหมายว่าด้วยลักษณะปกครองท้องที่ที่ติดกับตำบลหรือแขวงอันเป็นที่ตั้งของสถาบันการเงินประชาชนที่กำหนดในปัจจุบันมีความเหมาะสมแล้ว และมีข้อเสนอแนะหลักเกณฑ์เพิ่มเติมในประเด็น (1) เพิ่มมาตรการการกำกับดูแลสถาบันการเงินประชาชนที่ประสบปัญหาทางการเงิน และ(2) เพิ่มมาตรการการคุ้มครองเงินฝากของสมาชิกสถาบันการเงินประชาชนเพื่อประโยชน์ต่อสมาชิกสถาบันการเงินประชาชนอันสอดคล้องกับเจตนารมณ์ของกฎหมายฉบับนี้

Conventional wisdom has long perceived the patent and tort systems as separate legal entities, each tasked with a starkly different mission. Patent law rewards novel ideas; tort law deters harmful conduct. Against this backdrop, this Essay uncovers the opposing effects of patent and tort law on innovation, introducing the "injurer-innovator problem." Patent law incentivizes injurers --often uniquely positioned to make technological breakthroughs--by allowing them to profit from licensing their inventions to competitors. Over 1700 complete streets policies have been adopted by state and local government; these policies typically provide that streets shall be designed to benefit all users, not just motorists. This article analyzes some complete streets policies, and concludes that even above-average policies are often too vague and underfunded to significantly change the status quo. The article suggests a variety of reforms that might make complete streets policies more effective.

States increasingly use driver’s license laws to further policy objectives unrelated to road safety. This symposium contribution employs a health justice lens to focus on one manifestation of this trend—state schemes that prohibit noncitizen residents from accessing driver’s licenses and then impose criminal sanctions for driving without authorization. Status-based no-license laws not only facilitate legally questionable enforcement of local immigration priorities but also impose structural inequities with long-term health consequences for immigrants and their family members, including US citizen children. Child labour is prevalent in Ghana, especially in the agriculture industry where children engage in work that is harmful to their health, morals, and safety. Such harmful work has been defined by the ILO Convention No. 182 on the Worst Forms of Child Labour, 1999 as constituting the worst forms of child labour. These children have human rights stated in the laws of Ghana but have become victims of human rights violations because they cannot access the protections provided for under the international conventions and national laws of Ghana.

Congress first developed compassionate release in 1984, granting federal courts the authority to reduce sentences for “extraordinary and compelling” reasons. Compassionate release allows the Federal Bureau of Prisons (BOP) and inmates to apply for immediate early release on grounds of “particularly extraordinary or compelling circumstances which could not reasonably have been foreseen by the court at the time of sentencing.” Questions remain about how the BOP and the courts grant compassionate release and whether the courts apply the compassionate release guidelines consistently.
