Torts 1978 Survey Of New York Law: Part Five: Miscellaneous, Michael M. Martin
Torts 1978 Survey Of New York Law: Part Five: Miscellaneous, Michael M. Martin
Faculty Scholarship
The principal torts decisions this Survey year, especially in the products liability area, seemed to leave as many questions unanswered as they resolved. The Court of Appeals held that a noncontracting user's claim for injuries from a defective product sounded in tort for limitations purposes, but the Court did not decide what limitation period would be applicable if a statutory breach of warranty claim were also asserted. The contributory negligence defense to a strict products liability claim was upheld by a reference to the appellate division's opinion in a second-collision case. The analytically suspect "sales"-"service" distinction was reaffirmed in an …

The Referendum: Democracy's Barrier To Racial Equality, Derrick A. Bell, Jr.
Washington Law Review
To criticize the trend toward direct democracy appears reactionary, if not un-American. Yet, as suggested earlier, the growing reliance on the referendum and initiative poses a threat to individual rights in general and in particular creates a crisis for the rights of racial and other discrete minorities. This article seeks to explain why this is so and how courts might use existing constitutional principles to recognize legitimate interests in direct legislation, yet protect minority rights against majoritarian abuse.

Consular Discretion In The Immigrant Visa-Issuing Process, Kim R. Anderson, David A. Gifford
Consular Discretion In The Immigrant Visa-Issuing Process, Kim R. Anderson, David A. Gifford
San Diego Law Review
This study examines the exercise of discretion by consular officers in deciding whether to issue or refuse immigrant visas in an effort to determine if these decisions are arbitrary or unlawful. The study begins by examining the procedures and factors mandated by the Immigration and Nationality Act for use in determining eligibility to immigrate. The study then discusses and compares the typical procedures and eligibility factors utilized by consular offices in the field. Next the study does an evaluation of extra-statutory factors affecting the consular officer's determination including personal background, the effect of intermediaries, lack of time, the promotion system, …

Living Probate: The Conservatorship Model, John H. Langbein
Living Probate: The Conservatorship Model, John H. Langbein
Michigan Law Review
The main purpose of the present Article is to suggest a somewhat different theoretical and practical approach to structuring the living probate procedure. I shall characterize the procedure called for in the North Dakota act and in similar proposals as the Contest Model of living probate, in distinction to a Conservatorship Model that I shall advocate to be the better way. Part I of this Article reviews briefly the problem to which living probate is addressed and the alternatives that can presently be employed to forestall post-mortem capacity litigation in the absence of a living probate system. In Part TI …
