The Third World And The Protection Of National Patrimony: Oil, Art And Orchids, Michael W. Gordon
UC Law SF International Law Review
The author analyzes various means of protecting national patrimony, concentrating on three general subject areas of concern: a nation's natural resources, its cultural heritage, and its fauna and flora. The author discusses the interrelatedness of the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illict Import, Export and Transfer of Ownership of Cultural Property, the 1973 Convention on International Trade in Endangered Species of Wild Fauna and Flora, and the 1974 United Nations General Assembly Charter of Economic Rights and Duties of States, viewing these multilateral pronouncements as part of a broad Third World response to the …

Human Rights In The Wake Of The Helsinki Accords, Arthur J. Goldberg, James S. Fay
UC Law SF International Law Review
Since the ratification in Helsinki in 1975 of the Final Act of the Conference on Security and Cooperation in Europe (CSCE), the Soviet bloc nations have resisted effective implementation of many agreed upon provisions of the Act, particularly those dealing with Human Rights. In the process of outlining the flaws in the Soviet position, the authors suggest specific steps to guide Western negotiators at the 1980 CSCE meeting in Madrid.

Comment: The Constitutionality Of Medical Malpractice Mediation Panels: A Maryland Perspective, Matthew Zimmerman
University of Baltimore Law Review
The recent rapid rise in medical malpractice insurance rates has engendered a proliferation of state activity designed to cope with the problem. This Comment analyzes the Constitutional challenges made to the medical malpractice mediation panels adopted by various state legislatures. The author concludes, in light of the decision in Attorney General v. Johnson upholding the somewhat unique Maryland Health Care Malpractice Claims Act, that it is likely that most such plans could withstand Constitutional attack.
The Implicit Teaching Of Utopian Speculations: Rousseau's Contribution To The Natural Law Tradition, Thomas E. Carbonneau
The Implicit Teaching Of Utopian Speculations: Rousseau's Contribution To The Natural Law Tradition, Thomas E. Carbonneau
Seattle University Law Review
Legal philosophers, especially of the positivist variety, traditionally have assumed that the proponents of natural law theory present too facile an answer to the vexed question of whether an unjust law can be said to exist when it is duly sanctioned by legal and political authority. If not disappointed by the answer itself, they have been most unhappy with the explanation that accompanies it and, indeed, are prepared to challenge the very foundations of a theory of law which pays so little heed—either empirically or in terms of pure logic—to the actual operations of existing legal systems. Kant initiated the …

Urban decline and its impact upon American society have been national concerns for nearly three decades. Although the causes of urban decline are numerous and diverse, a key factor is the in adequacy of the financial resources available to resolve the massive problems associated with urban decay. In the residential mortgage market, funds for home mortgage loans and home repair loans in declining neighborhoods are conspicuously absent. As a result, urban decline accelerates, and any realistic hopes for the revitalization of urban neighborhoods are eliminated.
During the 1970s, national attention has focused on redlining - the term used to describe …
