On February 14, 1979, the Board issued an order dismissing the application [sic] for certification in this matter and stated that reasons were to follow. On April 11 the Board issued L.R.B. No. 2523, in which, with full reasons for our decision, we directed Michelin Tires (Canada) Limited to cease and desist from breaching Section 51 (1) (a) of the Nova Scotia Trade Union Act by committing the unfair labour practices specified in that order. Our intent here is to set out in similar detail our reasons for the order on February 14. Not all of the many issues of …

Abortion And The Presidential Election Of 1976: A Multivariate Analysis Of Voting Behavior, Maris A. Vinovskis
Abortion And The Presidential Election Of 1976: A Multivariate Analysis Of Voting Behavior, Maris A. Vinovskis
Michigan Law Review
Despite the widespread public interest in the role of the abortion controversy in American politics today, no one has attempted to analyze systematically its impact on the electorate. Some national opinion surveys have asked voters whether or not they would be influenced by a candidate's position on abortion, but they have not attempted to ascertain its relative importance, compared to other considerations, in the final deliberations of the electorate. In an effort to provide a more systematic study of the role of abortion in American politics today, this Article analyzes the campaign to elect the President of the United States …
The Politics Of Abortion In The House Of Representatives In 1976, Maris A. Vinovskis
The Politics Of Abortion In The House Of Representatives In 1976, Maris A. Vinovskis
Michigan Law Review
The battle over federal funds for abortions and the attempts to pass a constitutional amendment to prohibit all abortions have become annual events that most members of Congress privately dread but publicly welcome. As "pro-life" and "pro-choice" constituents descend upon their elected officials each year, representatives are forced to face an issue that has no easy legislative solution. Despite the intensity and disruptiveness of these confrontations, there have been no thorough and independent analyses of this phenomenon. Instead, most information on the abortion controversy in Congress has come from the understandably biased pens of the activists on both sides. Representatives …

Confidential Communication Between Parent And Child: A Constitutional Right, Jeff M. Sandlow
Confidential Communication Between Parent And Child: A Constitutional Right, Jeff M. Sandlow
San Diego Law Review
Prior to 1978 no jurisdiction, either by statute or common law decision, protected by a testimonial privilege the confidential communications shared between parents and their children. People v. Doe is the seminal case which recognized a constitutionally based privilege arising out of the developing federal right to privacy. This Comment explores the political theory, the psychological data, and the case law which mandates the protection of confidences born of this most intimate relationship.

Joint Trials Of Defendants In Criminal Cases: An Analysis Of Efficiencies And Prejudices, Robert O. Dawson
Joint Trials Of Defendants In Criminal Cases: An Analysis Of Efficiencies And Prejudices, Robert O. Dawson
Michigan Law Review
Legislatures and courts, in weighing the relative advantages of joint and separate trials, have unreasonably struck a balance in favor of joint trials. The strongest justification traditionally offered for joint trials is efficiency. This Article shows that courts have greatly exaggerated the supposed efficiencies of joint trials while grossly underestimating the impediments joint trials pose to fair and accurate determinations of individual guilt or innocence. The propriety of joint trials is more than a question of efficiencies. Joint trials usually, although not always, help the prosecutor to get convictions, and thereby modify the balance of advantage in criminal trials. Disputes …
Benign Solicitation Of Clients By Attorneys, Joe Wishcamper
Benign Solicitation Of Clients By Attorneys, Joe Wishcamper
Washington Law Review
The purpose of this comment is to discuss the social benefits offered by benign commercial solicitation, examine the weaknesses in the current ABA rules and court doctrine, and suggest arguments that could be presented to persuade a court to abandon the traditional doctrine and provide protection for such solicitation. An alternative approach is presented which suggests dealing with solicitation cases by applying a "circumstances" oriented test. The suggested test would avoid some of the infirmities of the present doctrine and would be more useful in predicting outcomes of such cases.

Private Law: Torts, William E. Crawford
The Law Of Contract, Paul Thomas
The Law Of Contract, Paul Thomas
Dalhousie Law Journal
There can be no denying the need for good Canadian legal textbooks. While recent years have seen more home-grown texts on the market there are many important areas left unserved. In the past year two Canadian text books on contract law have been published. One way of assessing these two books is to ask wehter they are suitable replacements for English contract texts which we have had to resort to for the want of anything Canadian. The heavy use of, and constant reference to, Canadian sources, both legislative and judicial, is, of course, a valuable asset. Needless to say, a …
The Ombudsman In Nova Scotia And Newfoundland, K. A. Friedmann
The Ombudsman In Nova Scotia And Newfoundland, K. A. Friedmann
Dalhousie Law Journal
The Ombudsman is a relative newcomer to Canadian provincial government.' The senior Canadian Ombudsman offices are located in Alberta and New Brunswick, both ten years old. The Nova Scotia Ombudsman has functioned for six years, and Newfoundland's Parliamentary Commissioner for a mere two years. It may therefore be too early to analyze their degree of institutionalization. The concept does enable us, however, to focus our attention on the most important questions regarding the early history of the Ombudsman institution in the Maritimes. According to S. P. Huntingdon, institutionalization may be resolved into two internal components, complexity and coherence, and two …
