Rap Snitches: A New Framework To Evaluate Rap Lyrics And Creative Expressions As Evidence, Chris Kenefick Dec 2025

Rap Snitches: A New Framework To Evaluate Rap Lyrics And Creative Expressions As Evidence, Chris Kenefick

UC Law Journal

Rap music has earned its prominent place in American music culture.1 It provides a unique creative outlet for artists to share their experiences and criticize the systems in which they live. Rap lyrics, often metaphorical or exaggerated, have been weaponized by prosecutors to attack the character of artist-defendants at a level not seen with other modes of creative expression. The lyrics of an artist are turned against them in a manner that invites unfair prejudice and improper character evidence into legal proceedings. In the 2020s, major progress has been made to curb this practice, with several jurisdictions introducing legislation that …

From Medical Exceptions To Reproductive Freedom, David S. Cohen, Greer Donley Dec 2025

From Medical Exceptions To Reproductive Freedom, David S. Cohen, Greer Donley

Michigan Law Review

Since the Supreme Court overruled Roe v. Wade in 2022, there has been a significant focus on pregnancy complications. This focus has created some risks. Highlighting medically indicated abortion stories could stigmatize the vast majority of abortion seekers who lack medical reasons for abortion and result in narrow remedies that do nothing to undermine abortion bans. This Article presents a way to convert these risks into an opportunity: to use pregnancy complications as a wedge to challenge abortion bans more generally and make abortion more accessible for everyone. We present a long-term strategy to dismantle abortion bans, using several legal …

Presumption Of Creditworthiness, Nakita Q. Cuttino Dec 2025

Presumption Of Creditworthiness, Nakita Q. Cuttino

Michigan Law Review

Creditworthiness, or the likelihood that one will repay one’s debts, is typically signaled through a three-digit number known as a credit score. Yet, over thirty-two million adult-aged consumers lack adequate consumer credit reports and therefore do not have a traditional credit score. As a result of being unscored, these consumers are generally presumed uncreditworthy and foreclosed from mainstream credit markets. Unscored consumers are often relegated to extractive, fringe credit markets that neither require nor build credit scores. More insidiously, however, a growing number of non-credit contexts, including rental housing, utility services, and employment markets, look to creditworthiness to determine eligibility …

The Road To Regulation: A Literature Review Of The Influences On The Updated Silica Standards, Skye M. Medcraft Dec 2025

The Road To Regulation: A Literature Review Of The Influences On The Updated Silica Standards, Skye M. Medcraft

Capstone Experience: Master of Public Health

Silica is a hazardous compound that poses a risk to human health resulting from dust creating activities across various industries. Several agencies, including OSHA (Occupational Health and Safety Administration) and MSHA (Mine Safety and Health Administration) have adopted regulatory oversight of silica exposure in the workplace. As more research has been conducted on silica exposure, the health effects are becoming better described, which has led to the creation and updating of exposure regulations to protect worker health. The objective of this literature study is to review the data presented to the Department of Labor and discuss how the factors that …

The Disaster Management Complex: Law’S Adaptations In Times Of Climate Disaster, Michael Burger, Jeffrey Schlegelmilch, Lucia Bragg Dec 2025

The Disaster Management Complex: Law’S Adaptations In Times Of Climate Disaster, Michael Burger, Jeffrey Schlegelmilch, Lucia Bragg

Sabin Center for Climate Change Law

The Anthropocene is marked by constant climate-related disasters and defined by the urgent need to foster and implement adaptations to future climate impacts that reduce disaster risk. The intensity, frequency, and severity of extreme weather events continue to rise even as nations and corporations alike miss their emissions targets, all promising a hotter, wetter, and more extreme future. A number of federal agencies, including the Federal Emergency Management Agency (FEMA), have, at times, sought to adapt their own famously fragmented responses to these changing circumstances. However, federal disaster response is conducted against a backdrop of authorizing legislation that is designed …

Defending Form Contract Consent, Wayne R. Barnes Dec 2025

Defending Form Contract Consent, Wayne R. Barnes

Faculty Scholarship

The issue of standard form contracts has bedeviled Contracts scholars for a century. The basic problem has long been known. Contract is supposed to be a quintessentially consensual activity, whereby both parties are operating with full knowledge and comprehension of the array of terms and conditions being negotiated and agreed to. But by employing standard forms replete with boilerplate fine print, companies have created a regime whereby it is most likely irrational for consumers to bother reading the terms before consenting to the transaction. The existing “duty to read” doctrine is that consumers fully consent to all terms when they …

Lawyers' Client-Inclusive Negotiations: The "New Mediation"?, Nancy A. Welsh, Donna Shestowsky Dec 2025

Lawyers' Client-Inclusive Negotiations: The "New Mediation"?, Nancy A. Welsh, Donna Shestowsky

Faculty Scholarship

When proponents initially urged the courts to institutionalize mediation for the resolution of general civil cases, they argued that the procedure would be superior to trial—and also to lawyers’ settlement negotiations—in terms of parties’ exercise of self-determination, satisfaction with outcomes, and opportunity for voice. These claims, however, rested on certain assumptions, particularly regarding the implementation of mediation and lawyers’ settlement negotiations. In mediation, the parties were to take center stage, with the mediator assisting them by facilitating their communication and negotiation so that they could reach a customized resolution. Lawyers’ settlement negotiations in general civil litigation, meanwhile, were assumed to …

Local Government Standing As State Standing, Katharine Cooney, Katherine Mims Crocker Dec 2025

Local Government Standing As State Standing, Katharine Cooney, Katherine Mims Crocker

Faculty Scholarship

It is increasingly common, and controversial, for local governments to bring lawsuits as plaintiffs in federal court. Many questions about this practice raise matters that sound in policy. But some, including the issue of standing to sue, also raise issues of constitutional law. How local governments fit into standing rules should reflect how they fit into the U.S. constitutional system more broadly. As the Supreme Court put it in the famous (and infamous) 1907 case Hunter v. City of Pittsburgh, "[m]unicipal corporations are political subdivisions of the State, created as convenient agencies for exercising such of the governmental powers of …

Mda Insurance: Offer Group Health Insurance To Entice Recruits, Retain Valuable Staff, Craig Start Dec 2025

Mda Insurance: Offer Group Health Insurance To Entice Recruits, Retain Valuable Staff, Craig Start

The Journal of the Michigan Dental Association

Amidst a competitive labor market, offering group health insurance is critical for attracting and retaining qualified dental staff, as it is the most highly valued employee benefit. Dentists can establish an employment policy stipulating cost-sharing for premiums, rather than paying the entire cost. The MDA strongly encourages investigating the exclusive MDA Health Plan, which offers 11 distinct plan designs powered by Priority Health. For 2026, the MDA Health Plan is increasing rates by only 4%, significantly lower than commercial group plans requesting double-digit increases (10% to 18%). Plans can be started at any time during the year, requiring about 30 …

Understanding Mental Health Crisis Response Through The Lens Of First Responders, Ella Gibson Dec 2025

Understanding Mental Health Crisis Response Through The Lens Of First Responders, Ella Gibson

Student Theses

Responses to mental health crises are becoming an increasingly contentious topic as cases of extreme police violence or fatality during a crisis are publicized in the media. Although first responders’ experiences with mental health crisis response have been explored in prior literature, there remains a lack of research that gathers data from multiple first responder roles and compares their experiences across groups. There is also a significant gap in research examining the perspectives of co-response teams. This study sought to gather qualitative data on the experiences of police officers, EMTs/paramedics, and co-response team members, and to explore their perceptions of …

Eyewitness Consent To Be Video Recorded: Implications For Identification Accuracy And Confidence, Sarah Argüelles Dec 2025

Eyewitness Consent To Be Video Recorded: Implications For Identification Accuracy And Confidence, Sarah Argüelles

Student Theses

Recently, a recommendation has emerged for law enforcement to record the full eyewitness identification procedure, recognizing the critical role eyewitness testimony plays in the justice system (Wells et al., 2020). However, in some states, such as New York, law enforcement is required to seek consent from witnesses before recording (Municipal Police Training Council & Division of Criminal Justice Services, 2017). Since this practice is relatively new, there has been limited research on how obtaining consent may affect eyewitness accuracy. It was hypothesized that obtaining consent to video record could be linked to a witness’s confidence in their identification, with higher …

Frankenstein Sinatra: The Argument For A Federal Postmortem Right Of Publicity In The Ai-Era, Ian Samide Dec 2025

Frankenstein Sinatra: The Argument For A Federal Postmortem Right Of Publicity In The Ai-Era, Ian Samide

Brooklyn Journal of Corporate, Financial & Commercial Law

Artificial Intelligence has fundamentally revolutionized the way media is generated and presents new and unique threats to the right of publicity. By enabling users to create high-quality, realistic deep fakes of individuals’ voices, images, or likenesses, Artificial Intelligence has created novel risks to the right of publicity. Additionally, right of publicity is currently governed by state law. This system is proving to be flawed in the internet age, as content is rarely confined to a single jurisdiction, resulting in unpredictability and juridical disputes. This note argues that a federal right of publicity is necessary to regulate Artificial Intelligence effectively and …

Oh, Oh, No Ozempic: The Dangers Of Ozempic’S Direct-To-Consumer Advertisements, Taylor Blicht Dec 2025

Oh, Oh, No Ozempic: The Dangers Of Ozempic’S Direct-To-Consumer Advertisements, Taylor Blicht

Journal of Law and Policy

On average, viewers are exposed to about nine drug advertisements a day. Direct-to-consumer pharmaceutical advertising (“DTCPA”) is when pharmaceutical companies market their prescription drugs straight to consumers. Ozempic is a weekly injection of semaglutide, developed by the pharmaceutical company Novo Nordisk in 2017 for adults with Type-2 diabetes. After people started to show signs of weight loss on Ozempic, Novo Nordisk created Wegovy in June 2021, targeting towards people with obesity. Due to the exploding weight-loss effect of Wegovy, celebrities and social media influencers started taking the medication and sharing their weight loss journeys. DTCPA can be harmful to consumers …

Democratic Integrity Under Threat: Confronting Disinformation With Legislative And Structural Reforms, Sophia Brociner Dec 2025

Democratic Integrity Under Threat: Confronting Disinformation With Legislative And Structural Reforms, Sophia Brociner

Journal of Law and Policy

In the modern digital era, disinformation has evolved from a political strategy into a fundamental threat to democratic governance. This Note contends that the absence of comprehensive federal legislation addressing political disinformation on social media has compromised both the integrity of elections and the public’s trust in government institutions. By analyzing the disinformation campaigns that shaped the 2016, 2020, and 2024 presidential elections, this Note demonstrates how false and AI-generated content, amplified by both foreign and domestic actors, has manipulated voters, deepened political polarization, and destabilized public confidence in democratic processes. The discussion examines how rapid technological development, insufficient regulatory …

Signaling Through National Security Lawmaking, Weijia Rao Dec 2025

Signaling Through National Security Lawmaking, Weijia Rao

Faculty Scholarship

An often-overlooked element of the ongoing TikTok saga is China’s export control law, which prohibits the sale of TikTok’s core content recommendation algorithm without prior approval from the Chinese government. This law is just one example of the extensive national security lawmaking China has undertaken in recent years. Closely paralleling similar institutions in the U.S., China has established a comprehensive national security legal framework that authorizes the government to restrict exports, sanction foreign entities, screen foreign investments, and block transactions involving cyber infrastructure.

Why turn towards legality when China has the ability to employ these actions without a formal legal …

Genocidal Accusation, Steven Arrigg Koh Dec 2025

Genocidal Accusation, Steven Arrigg Koh

Faculty Scholarship

To accuse of genocide — what does it mean? Genocidal accusation is ubiquitous today, evident more in the public square than in any courtroom. At first glance, such accusation seemingly relies on a central assumption: genocidal accusation is critical to preventing atrocity. This Article argues that this widespread assumption is incomplete, obscuring genocidal accusation’s dual nature. In fact, genocidal accusation encompasses not only laudable atrocity prevention (for example, the Rwandan genocide), but also problematic punitive, carceral discourse that brands the “other” as morally polluted (such as President Putin’s Ukraine invasion). It is thus challenging to evaluate such accusation in the …

What Makes A Con Law "Doctrine" And Why Does It Matter?, Allison Orr Larsen Dec 2025

What Makes A Con Law "Doctrine" And Why Does It Matter?, Allison Orr Larsen

William & Mary Bill of Rights Journal

A few years ago, I started wondering about the “major questions doctrine” (or MQD) in administrative law, and I found myself asking: “When did that become a thing?” I was familiar with the cases that stand for the proposition that Congress does not lightly delegate high stakes questions to administrative agencies—cases that date back to 2000 and specifically to a decision about cigarette advertising and the FDA. But up until 2022, it was rare for courts and commentators to refer to that collection of cases as a “doctrine.” Today, by contrast, the major questions doctrine is bread and butter administrative …

The Silent Sound Of Drowning: Human Rights Justifications And Complex Intersectionality, Maria Grahn-Farley Dec 2025

The Silent Sound Of Drowning: Human Rights Justifications And Complex Intersectionality, Maria Grahn-Farley

Brooklyn Journal of International Law

This Article presents a new concept, “Human Rights Justifications,” which captures instances in which states invoke human rights to defend and legitimize their own actions. Human Rights Justifications stand in contrast to cases in which human rights are activated by an individual holding the state accountable for its actions. The difference between when a state and when an individual is the activating subject is that with the former, human rights risk serving the state in legitimizing its actions, instead of serving the individual as a protection from the state. This occurs because, when the state activates human rights, it also …

International Trade And Climate Policy: Revising The Benefit Analysis For Countervailing Duties, Michael J. Havens Dec 2025

International Trade And Climate Policy: Revising The Benefit Analysis For Countervailing Duties, Michael J. Havens

Brooklyn Journal of International Law

The United States’ Countervailing Duties Law protects domestic markets by offsetting any benefit foreign manufacturers receive from their domestic governments’ subsidy programs. The benefit analysis the Department of Commerce uses under the Countervailing Duties Law, however, is too vague. Moreover, the sole environmental exemption for otherwise countervailable subsidies is too narrow. As a result, Commerce assesses duties on an array of manufacturers burdened by foreign governments’ climate policies. The case study BGH Edelstahl v. US underscores the issue of the Countervailing Duties Law’s definition of “benefits conferred” and the limited environmental exemption. This Note compares the shortcomings of the Countervailing …

National Values Matter For Ai: Comparative Analysis Of Ai Regulations In The Us, The Eu, And China, Kaori (Furuya) Kawaguchi

Brooklyn Journal of International Law

As artificial intelligence (AI) continues to evolve rapidly, governments worldwide face increasing pressure to regulate it. This Article focuses on regulatory approaches to AI in the United States, the European Union, and China, examining the underlying rationales: why have they taken these approaches? Each jurisdiction’s unique political institutions, historical preferences, and strategic priorities shape its approach to governance. In particular, the values the jurisdiction expects in technology shape its regulation. The US adopts a decentralized, innovation-friendly model rooted in reliance on market and self-regulation in industries with its strong trust in laissez-faire philosophy; the EU asserts global leadership in regulations …

Ai Procurement As Regulatory Reconnaissance, Sam Adler Dec 2025

Ai Procurement As Regulatory Reconnaissance, Sam Adler

Fordham Law Review

Artificial intelligence (AI) is a black box technology in a black box industry. Some view AI as a life-changing technology capable of advancing society and perhaps even saving the world, while others fear its capacity to harm. Like Dr. Frankenstein, developers fear the unpredictability of their own creations; deployers fear the unknown risks of third-party AI tools that market pressures drive them to assume; members of civil society fear AI’s capacity to oppress the already oppressed and degrade trust in institutions; and everyday users fear the undisclosed potential of AI to cause harm by means they cannot readily comprehend. These …

Penambahan Jumlah Kementerian Negara: Analisis Terhadap Efektivitas Dan Efisiensi Pemerintahan, Bayu Saputro, Alfi Syahri Lubis, Renaldy Wijaksana Wibowo, M. Fariz Al-Qindi

Jurnal Hukum & Pembangunan

The revision of Law 39/2008 on State Ministries, which removes the maximum limit of 34 ministries, has become a polemic issue in society. Analysis shows that increasing the number of ministries is not urgent and runs counter to the spirit of bureaucratic reform. This policy also does not improve the effectiveness of government administration, because the main issue affecting the effectiveness of ministries lies in the quality of ministers, not the number of ministries. The addition of ministries has the potential to cause overlapping authorities, regulatory disharmony, and sectoral egos. From an efficiency perspective, this policy places a heavy burden …

Should The Army Be Involved In Divorce? Re-Examining The Pre-Divorce Defaults For Spousal Support, Artem M. Joukov, Thomas Godfrey Dec 2025

Should The Army Be Involved In Divorce? Re-Examining The Pre-Divorce Defaults For Spousal Support, Artem M. Joukov, Thomas Godfrey

MC Law Review

Army Regulation 608-99 assigns a large portion of a Soldier’s paycheck to the spouse upon marital separation. The assignment occurs without a hearing, discovery, or consideration of critical evidence which might moderate the amount of support. The obligation rests on the Soldier to obtain a court order or spousal agreement to reduce the financial burden. The adversarial nature of modern divorces renders these requirements unrealistic. Amending the regulation would ease the burden of the Soldier, which is desirable in light of the ongoing recruitment crisis and the need to attract recruits and retain those already in the service.

Using Political Privilege To Profit: Insider Trading In The Government And S. 2463'S Alleged Attempt To Stop It, Allison K. Dooling Dec 2025

Using Political Privilege To Profit: Insider Trading In The Government And S. 2463'S Alleged Attempt To Stop It, Allison K. Dooling

MC Law Review

Insider trading is generally illegal within the United States. However, members of Congress are notorious for regularly engaging in stock trades based on government information that mirrors insider trading. In 2023, Senators Gillibrand and Hawley proposed a bill, unlike any such proposed before, to put an ultimate ban on government insider trading: the “Ban Stock Trading for Government Officials Act” or S. 2463. On its face, S. 2463 appears to address the criticisms surrounding government insider trading. It not only increases regulation and reporting standards but also bans government officials, their spouses, and their dependents from owning any stock during …

The Impact Of Genai-Based Training On Developing Digital Skills And Achievement Motivation: A Quasi-Experimental Study On The Design Of E-Newspapers Among College Of Media Students At Taibah University, Sahar Salem Alghanmi

University of Tabuk Journal for Humanities and Social Sciences

This study aims to reveal such impact among female students in the College of Media at Taibah University. The study approached a quasi-experimental method with a single group of (42) female undergraduate students studying in courses related to designing electronic newspapers. The study materials included a training program designed according to the ADDIE instructional design model. It also relied on two tools for data collection: the first is a pre-and-post measure aimed at measuring achievement motivation, and the second is a performance evaluation card that focused on analysing the extent to which the students mastered the previously specified skills. The …

Executive Compensation In A New Era: Pouring Old Wine Into New Bottles?, Florence Shu-Blankson Dec 2025

Executive Compensation In A New Era: Pouring Old Wine Into New Bottles?, Florence Shu-Blankson

University of Dayton Law Review

The Author’s interest in executive compensation was sparked by the Delaware Court of Chancery’s decision to rescind the largest executive compensation package in U.S. history, awarded to Elon Musk by Tesla.1 Executive compensation has long been a contentious issue, and despite ongoing debates, efforts to regulate it effectively remain elusive. The process by which executive compensation committees and boards of directors determine these awards—along with their independence, the influence of controlling or dominant stockholders, and the transparency of decision-making— raises important questions about whether meaningful change is occurring or if the system remains fundamentally the same, merely repackaged as “old …
