Proposed Legislation Regarding State Supervision Of Charities, George Gleason Bogert Mar 1954

Proposed Legislation Regarding State Supervision Of Charities, George Gleason Bogert

Michigan Law Review

In the case of private trusts the dangers of long continued neglect or other breaches are not great. Definite or ascertainable persons have a financial interest in enforcement and can bring suit against the trustee. The beneficiaries are almost inevitably informed of their status soon after the creation of the trust. It is the duty of the trustee to notify them of the trust creation, and court notices, the receipt of benefits, and other incidents of trust administration bring home to the beneficiaries knowledge of their situations. Court accountings or voluntary reports generally keep the cestuis informed as to the …

Current Trends In State Legislation 1953-1954, University Of Michigan Law School

Michigan Legal Studies Series

In the preface to our first volume of this series we expressed an intent to publish subsequent volumes periodically, though not necessarily annually. A little over one year after the publication of that first volume we are ready to publish the second. Even though we do not have as many studies as in the first volume we have decided to publish them annually if possible. Our conclusion has been that if our research is to be of maximum value it should be available to the legislators and lawyers and teachers at the earliest practicable moment. Actually this volume is still …

A Report Concerning The Policy Of The Federal Communications Commission In Determining The Qualifications Of Applicants For Broadcast Facilities, Betsy Severson Jan 1954

A Report Concerning The Policy Of The Federal Communications Commission In Determining The Qualifications Of Applicants For Broadcast Facilities, Betsy Severson

Student Scholarship

This paper analyzes the historical development and regulatory policies of the Federal Communications Commission regarding the qualification of applicants for broadcast facilities. Established by the Communications Act of 1934, the commission was created to bring order to the chaotic early years of radio, which were characterized by uncontrolled growth and severe frequency interference. The primary mandate of the agency is to ensure that broadcast licenses are granted in a manner that serves the public interest, convenience, and necessity. However, the report notes that this standard is not precisely defined by statute, requiring the commission to rely on a case-to-case method …

Newspapers And The Courts, Marcus D. Gleisser Jan 1954

Newspapers And The Courts, Marcus D. Gleisser

Cleveland State Law Review

A problem of legal ethics that has been hovering over American courts, lawyers and newspapermen for more than half a century has finally landed in open debate in recent months. It is a problem that thus far has done little more than rouse recriminations and countercharges between two forced each of which, surprisingly enough, claims it avidly seeks what is in essence the same goal - justice. The problem is that of newspaper handling of court trials and their pre-trial developments.
