Law Reviews And Full Disclosure, William O. Douglas

Washington Law Review

Rather I propose an editorial policy that puts in footnote number one the relevant affiliations of the author. If the article is paid for, I would not necessarily require the disclosure of the amount of the fee; the fact that there was a fee would be sufficient. If there were no fee but a client's interest was reflected in the article, I would want disclosure of that client's identity. If the author was a freelancer in a particular field, I would want a general statement that his professional interest lay in the direction of certain types of litigation. That kind …

The Experience Of State Fair Employment Commissions: A Comparative Study, Arnold H. Sutin Jun 1965

The Experience Of State Fair Employment Commissions: A Comparative Study, Arnold H. Sutin

Vanderbilt Law Review

Passage of the new federal civil rights law in 1964 might have been expected to decrease the importance of the state fair employment practices (FEP) laws. Congress, however, chose not merely to permit these laws to continue in force to deal with purely local problems, but went further to entrust the primary administration of title VII, the federal fair employment statute, to state agencies where they exist. Thus the experience of these state agencies is of even greater importance now than formerly, for they will perform the day to day work of carrying out our nation's policy to prohibit discrimination in …

Justice William 0. Douglas And The Concept Of A "Fair Trial", Helen S. Thomas

Vanderbilt Law Review

This article seeks briefly to demonstrate the ways in which this basic commitment of Justice Douglas bear on particular constitutional issues, particularly with regard to criminal cases. The article treats these issues under five general headings: detention; the right to counsel; bail; the right to trial by jury; and trial procedures. Some overlapping between sections cannot be avoided; but it is hoped that this organization will bring the problems more sharply into focus.

Justice Murphy: The Freshman Years, Woodford Howard Mar 1965

Justice Murphy: The Freshman Years, Woodford Howard

Vanderbilt Law Review

Justice Murphy is commonly regarded as having been a libertarian activist. He was not highly regarded as a Justice during his lifetime and this opinion prevails today. Here Professor Howard sees Justice Murphy during his early years on the Supreme Court as a man of indecision rather than an uncompromising libertarian. Through an examination of first amendment cases between 1940-42, the author finds that Murphy displayed a common reaction to the responsibilities of a new Supreme Court Justice which differed from most only in intensity.

The Federal Aid To Private School Controversy: A Look, Walter A. Rafalko Jan 1965

The Federal Aid To Private School Controversy: A Look, Walter A. Rafalko

Duquesne Law Review

Pressure for federal aid to education still continues and, by certain organized groups, the pressure is on especially for aid to private schools. The subject of federal aid to private schools has created confusion and uncertainty because of the fact that so much has been written by legal scholars but actually so little has been adjudicated by the United States Supreme Court. Indubitably, the limited number of such adjudications may, in part, be explained by the doctrine prevailing in the federal courts that a federal taxpayer, as such, has no standing to argue that a federal statute is unconstitutional. Thus, …

The Renaissance Of The Criminal Law: The Responsibility Of The Trial Lawyer, J. Skelly Wright Jan 1965

The Renaissance Of The Criminal Law: The Responsibility Of The Trial Lawyer, J. Skelly Wright

Duquesne Law Review

Criminal law, long the stepchild of the law school and the lawyer, is showing signs of a return to acceptability. Once law school freshmen dozed through this required course while freshmen law teachers, compelled by their lack of seniority to teach it, droned through their notes. Now bright-eyed young men and women, stimulated and directed by creative and provocative lecturers, debate the concepts of culpability, capacity, competence, equal justice, right to counsel, and the defendant's right to a fair trial in relation to the rights of television and the press to cover fully not only the trial itself but also …
