Michigan Law Review

This essay concerns itself with a basic premise and three problems concerning investment securities under Article Eight of the Uniform Commercial Code (Code). Direct Restraint On The Press, Thomas L. Shaffer Jan 1967

Direct Restraint On The Press, Thomas L. Shaffer

Journal Articles

If I were to suggest that the public force be used to silence and hide sources of information about government as Mr. Cooper's committee, the Supreme Court of New Jersey, the United States Attorney General, and United States Senator Morse have suggested, I could begin with impressive authority. If I were to suggest nothing at all, as the organized press has done, I could begin with swelling rhetoric on the nature of man. But for my suggestion, direct restraint on the press, the only thing at hand is a fable, the story of a crisis that nearly prevented the marriage …

California's Urging To Riot Law, Robert R. Royse Jan 1967

California's Urging To Riot Law, Robert R. Royse

San Diego Law Review

On July 7, 1966, the California Legislature added to the Penal Code section 404.6 proscribing urging to riot. Ostensibly, the new section is intended to create a first line of defense against riots. It is meant to be an aggressive measure, designed to prevent the eruption of physical force or violence. It should be contrasted to the more restricted method of control, which goes into effect only after physical force or violence has erupted, or after a threat of such force or violence, accompanied by immediate power of execution. Section 404 of the Penal Code, which defines riot, embodies this …

Peace-Keeping And Peace-Making--The Un In The Middle East, Robert D. Kamenshine Jan 1967

Peace-Keeping And Peace-Making--The Un In The Middle East, Robert D. Kamenshine

Vanderbilt Journal of Transnational Law

A UN official, commenting on the designation of Swedish diplomat Gunnar Jarring as the Security Council's representative to work for a Middle East peace, observed that both Ralph Bunche and Lester B. Pearson had already received Nobel Prizes for bringing peace to this region. If anything is to be learned from the most recent Middle East conflict, it is that a cessation of hostilities cannot be equated with a peace; that a true peace involves the resolution of basic conflicts of interests.

Almost from its very inception, the United Nations has been deeply involved in Middle East problems. Just over …

THE FUTURE OF GERMANY

It is significant that the most brilliant and penetrating analysis of the West German democracy comes from the pen of the leading German philosopher, Karl Jaspers. This fact demonstrates that German philosophy which used to be exclusively an "ivory tower" affair has finally come to grips with contemporary social problems. The English edition contains not only the translation of Jaspers' German bestseller, but also of the philosopher's just published "Answer to My Critics."

One Civil Libertarian Among Many: The Case Of Mr. Justice Goldberg, Ira H. Carmen Dec 1966

One Civil Libertarian Among Many: The Case Of Mr. Justice Goldberg, Ira H. Carmen

Michigan Law Review

It is common knowledge that in recent times the constitutional issues of greatest magnitude and of greatest public interest lie in the area of civil liberties. These cases almost always call for the delicate balancing of the rights of the individual, allegedly protected by a specific clause in the Constitution, and the duties that state or federal authority can exact from citizens in order that society may maintain a minimum standard of peace and security. It follows, therefore, that it is these often dramatic decisions which will largely color the images we have of participating Justices. Assume a free speech …

Miranda--Some History, Some Observations, And Some Questions, Karl P. Warden Dec 1966

Miranda--Some History, Some Observations, And Some Questions, Karl P. Warden

Vanderbilt Law Review

At this writing Miranda v. Arizona' is less than four months old. Although its place in the annals of leading constitutional decisions is assured, its meaning for, and influence upon, the criminal law process in the United States is not at all certain. It will require years of data accumulation and analysis to determine how profound an effect it will have and to evaluate that effect in terms of social impact. It is too soon to know whether the Miranda case has started a new revolution in the administration of criminal justice or has merely ended an old one. Is …
