Union Political Involvement And Reform Of Campaign Financing Regulation, George P. Macdonald
Union Political Involvement And Reform Of Campaign Financing Regulation, George P. Macdonald
University of Michigan Journal of Law Reform
The spiraling costs of political campaigns 5 and the continuing significant role played by unions and corporations in the financing of those campaigns call for an examination of section 610's efficacy as a prohibitory statute. This article will focus on the use of labor union funds in the financial aspects of national politics. It will first discuss the loopholes in section 610: those loopholes created through narrow judicial interpretation of the statute and those resulting from its imprecise drafting. Particular emphasis will be placed upon an analysis of the sources of funds available to unions for political activities and the …

Personal Privacy In The Computer Age: The Challenge Of A New Technology In An Information-Oriented Society, Arthur R. Miller
Michigan Law Review
The purpose of this Article is to survey the new technology's implications for personal privacy and to evaluate the contemporary common-law and statutory pattern relating to data-handling. In the course of this examination, it will appraise the existing framework's capacity to deal with the problems created by society's growing awareness of the primordial character of information. The Article is intended to be suggestive; any attempt at definitiveness would be premature. Avowedly, it was written with the bias of one who believes that the new information technology has enormous long-range societal implications and who is concerned about the consequences of the …

"Just Compensation" For Lessor And Less, John D. Johnston, Jr.
"Just Compensation" For Lessor And Less, John D. Johnston, Jr.
Vanderbilt Law Review
The increase in large-scale federal and state programs utilizing the power of eminent domain have made evident the lack of eminent domain concepts and procedures which will facilitate the completion of these programs without undue delay, while concurrently providing adequate compensation for the damage inflicted upon individual property owners. In focusing upon the measure of compensation payable when the interests of lessors and lessees are taken, Professor Johnston questions the validity of two generally accepted concepts of existing doctrine, the market value approach to compensation and the unit valuation approach to apportionment. He points out that, although a judicial reassessment …

Copyright Fair Use—Case Law And Legislation
Copyright Fair Use—Case Law And Legislation
Duke Law Journal
Fair use is a judicially formulated concept which allows persons other than the copyright owner to use copyrighted material without permission. The present comment sets forth the rather unsettled case law definition of fair use, and recommends an analyser for delineating the relationship between fair use and an equally amorphous copyright concept, substantial similarity. This delineation is then assessed in light of the codification of fair use proposed in the copyright legislation now pending before Congress.

Vietnam And Public International Law, Anthony D'Amato
Vietnam And Public International Law, Anthony D'Amato
Faculty Working Papers
With each international crisis inevitably come the selfstyled "realists" proclaiming that there is no such thing as public international law. The Vietnam war is no exception, although here, due to the unusual complexity of the facts and the controversy over the applicable rules of international law, many of the published replies to the "realist's" positions have themselves been insubstantial and unconvincing. Let us look first, briefly, at the arguments of one of the realists, and then, with equal brevity, at some of the counterclaims. The remainder of this comment will be addressed to the larger issues involved and some suggested …
