Michigan Environmental Protection Act, Roger L. Conner
Michigan Environmental Protection Act, Roger L. Conner
University of Michigan Journal of Law Reform
Each of the questions discussed in this note revolve around the same basic issue: the propriety of vesting broad power in the courts to prevent environmental destruction, and to develop an environmental common law. The need for the broad standard of the Act derives from the complexity of the problem. The clear authority of the courts to decide cases which have been, or should have been dealt with by an administrative agency is important both for the relationship it establishes between citizens and agencies, and to insure that the policies of the Act will be implemented. In responding to these …
Law And Anarchy, Sidney Hook
Law And Anarchy, Sidney Hook
University of Richmond Law Review
I wish to consider certain views and attitudes about law and government that seem widely held today, that encourage contempt for law and at least indirectly bear on current political behavior.

Catv Regulation: A Jumble Of Jurisdictions, Michael Botein
Catv Regulation: A Jumble Of Jurisdictions, Michael Botein
Articles & Chapters
The community antenna television (CATV) industry is rapidly becoming a major element of the communications media. Unfortunately, attempts to regulate the industry have not kept pace. Local, state and federal authorities were slow to recognize the need for CATV regulation and, when they finally entered the field, their efforts were uncoordinated and inadequate. But, recent activity in the field by city and state authorities, the Federal Communications Commission and the Congress signals the emergence of a multi-jurisdictional system of CATV regulation. The author describes this system and suggests improvements that will encourage CATV to realize its full potential.

The Machinery Of Criminal Justice In England And The United States, William Burns Lawless
The Machinery Of Criminal Justice In England And The United States, William Burns Lawless
Journal Articles
This article will lay side by side the major structures of the English and American criminal law procedures and will attempt to draw some conclusions helpful to strengthening American technique. Such a comparison is relevant at this time because of the mounting concern of the American people with the problem of crime and the particular feeling that, in some mysterious way, our courts or the men who man them have not properly responded to the cruel waves of lawlessness which engulf us. In other quarters, there is a feeling that the police are either inept or inadequate to the challenge …

Is Violence An "American" Nightmare?, Morris D. Forkosch
Is Violence An "American" Nightmare?, Morris D. Forkosch
Georgia Law Review
HAVE civil disobedience and violence of all kinds in the United States crested, so that a decline appears in the offing? Does the mood of the country's college presidents and deans, that they can now deal with the student upheavals of the past few years, truly reflect not only their own campus situations but also the general picture in this country? Or is this mood a chimera: is optimism unfounded and continued violence to be expected because Western democracy was molded by violence, the United States was founded in violence, and man is by nature a violent creature? And even …
Labor-Management Relations In The Federal Service And The New Executive Order 11491, W. J. Usery, Jr.
Labor-Management Relations In The Federal Service And The New Executive Order 11491, W. J. Usery, Jr.
Georgia Law Review
ON October 29, 1969, President Richard Nixon signed Executive Order 11491 entitled "Labor-Management Relations in the Federal Service."' This Order marks a significant change in employee- management relations in the federal government. It replaces Executive Order 10988, issued in January 1962, which established the initial formal federal employee-management relations policy. The new Order was the result of extensive study and a lengthy review process which commenced in the fall of 1967 and was brought to a close in August 1969. It reflects a major advance toward the realization of a truly bilateral relationship between federal agency managers and federal employees …

Better Days In Court For A New Day's Problems, Roger J. Traynor
Better Days In Court For A New Day's Problems, Roger J. Traynor
Vanderbilt Law Review
We do not lack first-rate proposals for court organization and administration and procedures that would befit a new day. Neither do we lack well-conceived plans for the selection and retention of judges that would attract able and independent men to the bench. Nevertheless, the few states that have undertaken substantial reforms are far outnumbered by those that have not. It is high time to inquire why there has been such a woeful lack of will in the legal profession throughout the country to have done with ways so antiquated as chronically to impede the just operation of the laws. It …
The News And The Accused, Lawrence W. Schad
The News And The Accused, Lawrence W. Schad
University of Michigan Journal of Law Reform
The author believes that the Reardon Standards, if implemented, would provide an effective solution to the problem of prejudicial information, and that this potential can be best realized through adoption and enforcement of the Standards by the courts. This conclusion is based upon analysis of the following issues: (1) The nature of the problem, including an examination of (a) the nature of prejudicial information, (b) those who create the problem either by initially releasing or subsequently disseminating such information, and (c) the related effect of courtroom procedure upon the impact of such information. An analysis of these issues suggests …
Pre-Trial Publicity, Michael L. Boicourt
Pre-Trial Publicity, Michael L. Boicourt
Missouri Law Review
One of the most controversial problems in the criminal law field during the 1960's has centered around the apparent contradiction between detailed reporting of events about which there is pending criminal litigation and the sixth amendment right of the criminally accused to a public trial "by an impartial jury." The impartiality of our criminal process is one of the most highly regarded of American legal traditions. The difficulty in maintaining this tradition, in a society permeated with every form of mass information media, of catering to a curious public is one of the vital issues of our time. This comment …
The One-Bank Holding Company Conglomerate, Franklin R. Edwards
The One-Bank Holding Company Conglomerate, Franklin R. Edwards
Vanderbilt Law Review
In response to strong opposition, the political tide is slowly moving towards restrictive legislation that may well spell the demise of the one-bank holding company movement. But regardless of its form, the legislation ultimately adopted is certain to have an important influence on the future of our financial structure since many of the basic structural aspects are at issue. It therefore provides Congress with a golden opportunity to make fundamental changes. In effect, Congress's task is to reappraise our financial system with a view towards determining whether its underlying structure is still compatible with present goals and contemporary needs and, if …
