Freedom To Hear: A Political Justification Of The First Amendment, John M. Steel
Freedom To Hear: A Political Justification Of The First Amendment, John M. Steel
Washington Law Review
Historical analysis of the first amendment reveals that it was adopted primarily to safeguard and promote self-government through the communication of political ideas and attitudes among citizens. The author argues that these political underpinnings support the recognition of a freedom to hear corresponding to the freedoms of speech and press. Implementation of this freedom, recognizing its political basis, would eliminate many infringements on activity the Framers intended to protect. A freedom to hear would also provide a useful analytic tool in alleviating much of the repressive influence on political activity exerted by the private sector.

Common Law Copyright, And Conversation, Frank J. Nawalanic
Cleveland State Law Review
Assume that "A" is a well known author and literary figure and that "B" is an author in his own right, but far less known than "A". "A" and "B" meet socially and engage in a stimulating conversation wherein thoughts and ideas are freely expressed and conclusions drawn. Sometime thereafter, "B" publishes excerpts from this conversation and "A" strongly desires to prevent such from being published and receiving publicity. To prevent publication of their conversation, "A" could proceed against "B" under several different causes of action. He could possibly allege breach of a fiduciary relationship, breach of implied contract, invasion …

Regulation Of Pharmaceutical Advertising, Anthony S. Zito Jr.
Cleveland State Law Review
Federal trade commission regulation of pharmaceutical advertising is a subject of considerable current interest. Nevertheless certain trends are developing.' One of the major objectives of this paper is to predict the ultimate form of these rules.
Prisoner's Clothing During Trial, Christine Mukai
Prisoner's Clothing During Trial, Christine Mukai
Cleveland State Law Review
This paper will deal with the appearance, vis-a-vis clothing, of a criminal defendant and the right of that defendant not to be attired in prison garb during judicial proceedings. The purpose here is not to consider the practices of the various jurisdictions; rather this shall be an attempt to display the existence and implications of the right to stand trial in non-criminating clothing.

Plea Bargaining: A Model Court Rule, Kenneth A. Kraus
Plea Bargaining: A Model Court Rule, Kenneth A. Kraus
University of Michigan Journal of Law Reform
It is not the purpose of this note to discuss the justification for the plea bargaining process, for it is clear that this system will of necessity be continued in the foreseeable future. Instead, this analysis is designed first to present the functional role, constitutional status and existing abuses in the plea bargaining process, and then to discuss the goals and the proposed standards relevant to reform of the present plea bargaining procedures. The culmination of this analysis is the proposed Model Court Rule for Plea Agreements in part III.
The Emerging Constitutional Privilege To Conceal Confidential News Sources
The Emerging Constitutional Privilege To Conceal Confidential News Sources
University of Richmond Law Review
In furtherance of the national interest in an informed populace, the American press has evolved into a sophisticated and complex system of news reporting that is universal in scope. Although methods of accumulating and disseminating data have changed with technological advancement, the people have continued to be the primary source of news reports. Communications from source to media frequently are conducted in confidence, with the anonymity of the informant being a condition precedent to disclosure of the information. Legal problems develop when the newsman is called upon to reveal the identity of his confidential source in a judicial or legislative …
