Caveat Viator: The Duty To Wear Seat Belts Under Comparative Negligence Law, John A. Hoglund, A. Peter Parsons
Caveat Viator: The Duty To Wear Seat Belts Under Comparative Negligence Law, John A. Hoglund, A. Peter Parsons
Washington Law Review
The first portion of this article will attempt to show that neither judicial nor legislative reluctance, nor its underlying reasoning, is justifiable in light of the current state of law and society. Substantial evidence will be presented to demonstrate the need for our society to adopt the seat belt habit and for the law to recognize and respond to this societal need. Reactions of courts and legislative bodies to suggestions of mandated use are then explored as a preliminary to an analysis of the common law basis for adoption of the seat belt rule. A careful explanation will then be …

Privacy And The Press Since Time, Inc. V. Hill, Don R. Pember, Dwight L. Teeter, Jr.
Washington Law Review
In this article, the authors do not propose to discuss the innumerable ways in which one's privacy is invaded or to survey the entire sweep of the law of privacy, but rather attempt to trace briefly its development, with particular emphasis on how the law has affected the mass media since the Supreme Court decided its first privacy case, Time, Inc. v. Hill, in 1967. In so doing, we hope to add somewhat to the understanding of this unsettled area of law.

Reaffirming The Freedom Of The Press: Another Look At Miami Herald Publishing Co. V. Tornillo, Michigan Law Review
Michigan Law Review
This note does not take issue with the result of the decision. Rather, the argument herein is that the access theory deserves more complete consideration. The Court used first amendment precedents to strike down the reply statute without exploring whether the rationale behind these precedents mandated such a result. In an effort to justify more fully the Court's conclusion, this note will first present the underlying rationale of the pro-access argument. It will then analyze the constitutionality of statutes that would implement a right of access. Finally, the note will discuss several practical difficulties that access legislation would present.
The Legal Status Of A National Bank's Automatic Stock Investment Service Under Sections 16 & 21 Of The Glass-Steagall Act Of 1933, H. Lee Barfield
The Legal Status Of A National Bank's Automatic Stock Investment Service Under Sections 16 & 21 Of The Glass-Steagall Act Of 1933, H. Lee Barfield
Vanderbilt Law Review
For many years, commercial banks bought and sold common stock while acting in an agency capacity for their customers. Frequently, these transactions were made while the bank was acting as trustee or as custodian for its beneficiaries or principals. Generally, the banks did not advertise this service extensively, but limited promotional activities to prior bank customers. In 1973, a dramatic change began as several commercial banks, notably Security Pacific National Bank of Los Angeles and Chase Manhattan of New York, began to promote this service vigorously in advertising addressed to the general public through the various media. Threatened by the increased competition …
Private Markets And Social Control, Lloyd D. Orr
Private Markets And Social Control, Lloyd D. Orr
IUSTITIA
The continuing failure of society to deal adequately with its problems has led to criticism that goes beyond the imperfections of a fundamentally sound social organization. Individual economic incentive and private markets, the basics of our economic organization, are condemned as inherently destructive of desirable social goals. It may be that such criticism is naive with respect to the basic history of economic organization and the prospects for meaningful alternatives. It also may be that the "solutions" offered are frequently more authoritarian than the critics allege the present system to be. We are still left to ponder the vital, long-standing, …

From Stockholm To Nairobi To Caracas: Route Toward A New International Law?, Lynton K. Caldwell
IUSTITIA
In the future, as in the past, one function of international law will be to formalize and clarify procedures to deal with emergent problems. The international environmental developments noted in this paper, e.g. global monitoring, supervision of the seabed, protection of endangered species, resource allocation, and many others, will require institutional arrangements differing from those with which nations have had experience. Innovation in legal principles and procedures is an almost certain consequence of such developments. Innovations in principle have been among the more obvious outputs of the international environmental conferences and programs since 1968. As these principles are translated, often …
