Fordham Law Review
This transcript is part of the published proceedings of a symposium convened by the American Bar Association’s Special Committee on Election Reform, which the ABA formed in 1973 and was chaired by John D. Feerick. The symposium took place at Fordham Law School on December 3, 1976. It occurred in the wake of the Watergate era, which saw the resignation of one vice president, the appointment of two vice presidents pursuant to the Twenty-Fifth Amendment’s Section 2, and a vice president’s succession to the presidency. The symposium’s purpose was to assemble experts on the vice-presidency to develop reform proposals related …
American Bar Association Special Committee On Election Reform, Symposium On The Vice-Presidency, Panel Discussion, Supplementary Appendix A: American Bar Association Special Committee On Election Reform
Fordham Law Review
This Report describes recommendations related to the vice presidency from the American Bar Association Special Committee on Election Reform. The recommendations were issued after the committee held a symposium on the vice presidency at Fordham University School of Law on December 3, 1976. John D. Feerick chaired the committee.
The recommendations state “that the American Bar Association favors (1) retention of the constitutional office of Vice-President of the United States in its present form, but urges each President to involve the Vice-President intimately and productively in operations of the presidency, and (2) that in the nomination and election process the …

The Unconstitutionality Of Limitations Upon Donations To Political Committees In The 1976 Federal Election Campaign Act Amendments, David Skover
Faculty Articles
The Supreme Court's decision in Buckley v. Valeo partially dismantled the electoral reform program formulated in the 1974 Amendments to the Federal Election Campaign Act of 1971. The Court declared that the Act's limitations on expenditures by candidates and independent expenditures in federal elections unconstitutionally burdened political speech and association, while it upheld restrictions on contributions to candidates. After five months of deliberation, Congress attempted to salvage its design for electoral reform by enacting the Federal Election Campaign Act Amendments of 1976. Responding to Buckley's approval of restrictions on political contributions, Congress imposed new limits on "contributions" to political committees. …

Prior Restraints On Freedom Of Expression By Defendants And Defense Attorneys: Ratio Decidendi V. Obiter Dictum, Monroe H. Freedman, Janet Starwood
Hofstra Law Faculty Scholarship
Nebraska Press Association v. Stuart presents the Supreme Court's most strenuous disapproval of prior restraints on the press to date. Despite its concern for the first amendment rights of the press, however, the Court showed no such solicitude for the free speech rights of defendants and their attorneys. Instead, the two major opinions in Nebraska Press Association both contain unsupported, conclusory language suggesting that the special protection afforded the press might somehow be inapplicable to restraints against defendants and defense attorneys. The implication is that in order to secure their rights to fair trials defendants may have to sacrifice their …

Respa Revised And Revisited, Edward S. Hirschler
Respa Revised And Revisited, Edward S. Hirschler
University of Richmond Law Review
It is hard to believe that the Real Estate Settlement Procedures Act of 1974, which was signed by President Ford on December 22, 1974, and the revision that became effective on January 2, 1976,2 could have the same name-RESPA. It is even more remarkable that it took less than a year for the monstrosity which became effective on June 20, 1975, to evolve into what is now a reasonably workable statute with regulations which clarify rather than confuse. It is beyond the scope of this article to trace the history of RESPA in detail. Suffice it to say that in …

Arms Transfers By The United States: Merchant Of Death Or Arsenal Of Democracy, Archibald S. Alexander
Arms Transfers By The United States: Merchant Of Death Or Arsenal Of Democracy, Archibald S. Alexander
Vanderbilt Journal of Transnational Law
Controversial events of the last few years have presented the American public with the question whether arms transfers by the United States have gotten out of hand. Has our country become the chief "merchant of death," as believed by many at the time of Senator Nye's investigation soon after World War I, or is it the "arsenal of democracy," as generally believed during and after World War II? This article deals with transfers of all kinds of non-nuclear arms from or by the United States, and it examines all types of transfers including grants, transfers on credit, government to government …

Improving Police Discretion: Rationality In Handling Public Inebriates, David Aaronson, C. Dienes, Michael Musheno
Scholarly Articles in Law Reviews & Journals
This two-part article reports on the findings of the "prescriptive" phase of the American University Law School's Project on Public Inebriation.' First, we provide a framework or model designed to contribute to efforts to improve the rationality of police discretion and the quality of discretionary justice. Second, we seek to increase understanding of, and provide the basis for improving, the intake process whereby public inebriates are delivered to designated facilities-jails, detoxification centers, etc.-in criminal and decriminalized jurisdictions. While the article focuses on the discretionary power of police officers to remove street inebriates, it should increase awareness of problems of decriminalizing …
