In November 1977, the Supreme Court of Georgia rendered a decision in City of Atlanta v. Myers which invalidated a municipal ordinance requiring that police officers and firefighters be residents of the municipality. The public media, in its discussion of the decision, primariily pointed out the residency requirement, the policy behind it, and its advantages and disadvantages to the cause of good government--all important matters. As frequently happens, however, even more crucial considerations in the case may have gone unheralded. From the legal perspective, that is, the importance of the decision and its implications may considerably transcend the factual context …

In the course of his eloquent commentary upon New York Times Co. v. Sullivan, the late Professor Kalven enthused that the Court had written "an opinion that may prove to be the best and most important it has ever produced in the realm of freedom of speech." This excitement was generated not by the Court's rather narrow holding but rather by the hope that Sullivan would serve as the opening wedge to dislodge the clear and present danger test, to dismantle the "two-level" approach to first amendment analysis (reflected in cases such as Chaplinsky, Beauharnais, and Roth …

Individual Liability Of Agents For Corporate Crimes Under The Proposed Federal Criminal Code, Stephen D. Goodwin
Individual Liability Of Agents For Corporate Crimes Under The Proposed Federal Criminal Code, Stephen D. Goodwin
Vanderbilt Law Review
In discussing the contours of individual liability under section 403, this Note has not attempted to criticize the section's draftsmanship or counsel against its adoption. The philosophy of liability reflected in section 403 wisely avoids the imposition of vicarious liability on corporate officials. The defendant's personal misconduct, failure to act, or reckless failure to supervise invoke the sanctions of the provisions. In addition, subsections (b) and (c) provide a theoretical underpinning for punishing omissions that is preferable to the indicia of artificial "participation" relied upon in former state and federal cases.
This Note has also attempted to establish some limitations …
Human Rights In Canadian Society: Mechanisms For Raising The Issues And Providing Redress, A. Wayne Mackay
Human Rights In Canadian Society: Mechanisms For Raising The Issues And Providing Redress, A. Wayne Mackay
Dalhousie Law Journal
To the great body of the people, the whole mass of right is without remedy. Selling justice to the favoured few, denying it to the many, the system gives the rights in outward show; takes them away in effect; gives rights by what it says, takes them away by what it does. 1 Society has changed since Jeremy Bentham made the above observation. However, the problem he identified has not been eliminated. The gap between what governments say about human rights and what they do about violations of human rights is wide. In spite of occasional verbal protests from other …

Governmental Regulation Of The Press: A Study Of Israel's Press Ordinance - Part I, Pnina Lahav
Governmental Regulation Of The Press: A Study Of Israel's Press Ordinance - Part I, Pnina Lahav
Faculty Scholarship
This article is part of a broader effort to analyse the relationship between the press and the legal system in Israel. Being only a segment of a larger project, it is devoted in its entirely to one component of Israel's press law: the Press Ordinance of 1933 (hereafter Pr. Ord.). Although antiquated and considered by certain circles as merely a "dead letter", the Pr. Ord. still forms the backbone of Israel's press law, since it regulates so many aspects of the press. Beyond its relevance as positive law, the Pr. Ord. is of interest for a number of reasons. Having …
