Economic analysis has long been used to justify copyright regulation. Long before the Statute of Anne, the Stationer’s Guild told the story of the copying competitor, who in the absence of regulation, would copy every original book and offer it for less. In the story, the coping competitor would, in the absence of regulation, deprive the original author of an opportunity to recoup their authorship investment, and so lead to a world where no books at all would be published. To ensure sufficient incentives for authorship, some degree of copyright regulation was thought essential. At the same time, in the …

Should regulators set performance thresholds for AI tools used in the criminal legal system? This Article draws on U.S. evidence law for guidance. Its answer is ... don’t. Instead of gatekeeping with ex ante performance thresholds, regulators should require or incentivize metrics of reliability that can be clearly communicated to end-user decisionmakers.

The purpose of this qualitative study was to explore the world of educational legislation and how it is crafted, molded, and signed into law in the state of Indiana. The study examined the key legislative players, the machinations of the Statehouse, the educational organizations and their lobbyists, the national landscape, and other factors at play. To find the answers to the research questions in this study, the researcher interviewed multiple Indiana legislators. This thesis seeks to create empirical results to ground what has been a largely theoretical discussion about the effect of artificial intelligence (AI) on copyright law in the United States. AI has disrupted traditional ideas of creativity and expression, which are vital communication tools. Copyright is a regulatory agent to encourage the production of unique communication products by giving owners complete rights to their work. Copyright principles conflict with current AI model training practices. The researcher seeks to understand the gender wage gap in the United States. The research question studied is “Why do women in the United States on average earn less income than men?” Women gain less power and resources as they earn less income than men. The researcher explores the phenomenon in this paper. This research proposal utilizes qualitative methods via interviews, and analysis through coding. Environmental Movements In El Paso And Ciudad Juarez: Possibilities And Limitations Of Cross-Border Organization At The U.S.-Mexico Border, Vanessa Maria Almada

At the U.S.-Mexico border, the anthropogenic and nationalistic construction of the landscape has accelerated urbanization and unequal development without establishing effective binational institutions for governance over a shared commons. Borderlanders, then, contest unsustainable development with the added complexity of navigating a barrier which creates diverse socioeconomic and political realities that challenge cross-border cooperation. This qualitative research analyzes environmental organizations in El Paso and Ciudad Juarez. Through ethnographic study of mobilization in response to environmental legislation and administrative action in each city, the immediate barriers to cross-border cooperation and limitations of nationalistic institutions in the borderlands can be better understood.

The Functions of Role-Playing Games: How Participants Create Community, Solve Problems and Explore Identity, by Sarah Lynne Bowman, is an ambitious, wide-ranging, and still necessary work for role-playing game studies. Published in 2010, the book proposes that role-playing and roleplaying games fulfill three main social and psychological functions: creating community, facilitating problem solving, and enabling the exploration of identity. Bowman develops this thesis through a combination of theoretical review, cultural reflection, and participant-observer ethnography, based on interviews with players of tabletop role-playing games, live-action roleplaying games, and virtual environments. Improving Judicial Reasoning In Constitutional Rights Cases: The Case For A Structured Proportionality Test In The Indonesian Constitutional Court, Muhamad Dzadit Taqwa

This study evaluates the structured proportionality test modelled after the German approach. It argues that the Indonesian Constitutional Court should adopt this test when reviewing statutory limitations on constitutional rights under the amended 1945 Constitution. While the structurally weak protection of constitutional rights in the Constitution provides the contextual motivation for this inquiry, the central focus is instrumental: to assess the benefits and challenges of proportionality as a tool for improving judicial reasoning in constitutional rights adjudication. The analysis identifies three key benefits, including enhanced problem identification, improved justification of legislative limitations, and strengthened methodological rigor in judicial decision-making. Human dignity is integral to modern discussions of human rights and liberties, but this connection can be found stretching back through history to the early developments of human rights. This paper begins with modern philosophical definitions of human dignity, especially from Rosen and Kateb. Rosen discusses four “strands” of dignity- Intrinsic Dignity, Status Dignity, Manner Dignity, and Respect Dignity. "Hallucination" has become the common term for errors by AI systems, yet it implies a misleading analogy to human perception. LLM's process tokens. They do not have conscious experience or conscious perception. A hallucination is an experience, and (to our knowledge, to date) LLM's do not experience anything. This paper suggests that legal scholars follow the lead of a small number of AI researchers who have suggested that "confabulation" is a more accurate term, a metaphor grounded in psychology. The purpose of this transcendental-phenomenological study was to understand the lived experiences of reading teachers who implement policy-driven reading practices in elementary schools within urban school districts in Maryland. The theory guiding this study was Bandura’s theory of self-efficacy. The policies governing how teachers teach reading in Maryland's elementary schools informed this study. The Central Research Question was, " How do elementary teachers’ lived experiences of implementing reading policy in the classroom affect reading instruction? A transcendental-phenomenological research design was combined with purposive sampling and involved responses from 10 participants from urban school districts in Maryland. In this comment, the author argues that theatrical stage directions should be recognized as copyrightable material under the U.S. Copyright Act, primarily by categorizing them as "choreographic works". Sakin highlights that while the 1976 Copyright Act explicitly protects choreography and pantomimes, stage directions—which serve as the "blueprints" for a production's blocking, technical cues, and artistic mood—currently exist in a legal gray area. This article explores writing as a process of inquiry and meaning-making in the autoethnographic tradition, offering reflections on the recursive, emergent, and dialogical/dialectical nature of writing, along with some points for consideration. Drawing on perspectives from qualitative research and narrative inquiry (Riessman, 2008), I argue that autoethnographic writing serves as a method of inquiry and/or discovery, generating ontological, epistemological, and axiological-driven cultural meaning that functions as a site of reflection, interrogation, and re-storying of lived experiences. This recursive, often messy, and reflexive act allows researchers to excavate, analyze, and interpret their lived experiences. Rather than viewing writing as a final-stage …

As disputes over public land access intensify, “corner crossing” (the act of stepping from one parcel of public land to another at a shared corner with private property) has ignited legal and political battles across the West. At stake is not just the meaning of trespass, but the public’s right to enjoy land it lawfully owns. This Article argues that corner crossing is lawful and should be recognized as such under existing property law principles. The Marxist theory of the law is underdeveloped compared to the rest of Marx and Engels works. This can be chalked up to legal systems merely being part of the superstructure, by which the ruling class use to maintain power. In this essay I push back on this notion that the rule of law can be dismissed, arguing that if Marx's true community is to be as such then the addition of a just legal system is not an issue. ● State and federal policies targeting divisive concepts or DEI are shaping research agendas at scale and across disciplines. Twenty percent of all respondents, and 29 percent of researchers working in states with divisive concepts or similar laws, reported having avoided certain research topics because of state laws and policies.
● Eight percent of respondents representing a wide range of disciplines reported having had a federal grant cancelled in 2025.

This Essay examines the fundamental tension between originalism and cost-benefit analysis—the two dominant methodologies shaping modern, public law decision-making. Originalism, currently triumphant, prioritizes historical meaning and textual fidelity. It operates in stark contrast to cost-benefit analysis, the byword of the administrative state since 1982, which focuses on the future and efficiency. Descriptively, the two methodologies are irreconcilable. Nor is it possible to pair them by claiming they serve different purposes; originalism and cost-benefit analysis conflict when assessing agency design, constitutional rights, and judicial review of administrative action. Artificial intelligence (AI) is integrating rapidly into daily practice, including in the national security sector. AI has the potential to improve bureaucratic efficiency, enhance military intelligence and threat assessment, and develop autonomous vehicles and weapons, making it a revolutionary tool in national security. Since AI implementation is a relatively recent phenomenon, there is currently limited governmental regulation in place to safeguard against potential violations of civil liberties and other legal risks.
