Anticommandeering Climate Action: Defending The Necessity Of Subfederal Planet-Saving Legislation, Tyler Hall
Anticommandeering Climate Action: Defending The Necessity Of Subfederal Planet-Saving Legislation, Tyler Hall
San Diego Journal of Climate & Energy Law
Humanity is on the defensive against climate change, and state and local governments are the front line. Regrettably, Americans have waited too long for air cover in the form of federal climate regulations despite an established history of federal environmental action only emerging from the ashes of headline-grabbing catastrophes. Americans cannot wait on federal legislation to tackle the global and unprecedented problem of climate change. It will come far too late.
State and local governments’ historic police power includes protecting environmental health and public welfare, but decades of successful federal regulation have atrophied its use. Delayed by federal success, state …
Playing With Fire: California Homeowners Risk High Insurance Costs Or Losing Homes To Climate Change Disasters, Emily Serleth
Playing With Fire: California Homeowners Risk High Insurance Costs Or Losing Homes To Climate Change Disasters, Emily Serleth
San Diego Journal of Climate & Energy Law
California should continue to further the policy of protecting generational homeowners’ right to their property. To do this, insurance rates should be set in a way that avoids unfair premium increases that violate Proposition 103 and unfairly burden consumers. Utilizing CAT models will increase the cost of home insurance premiums due to overestimations of risk, enable bias on the part of insurance companies, and promote a lack of public scrutiny for insurance rates. This creates a confiscatory rate, which violates Proposition 103 and the California Constitution.
Generational homeowners should not be forced to adopt the FAIR plan just to maintain …
How Experts View The Legal System's Use Of Scientific Evidence, Shari Seidman Diamond, Richard Lempert
How Experts View The Legal System's Use Of Scientific Evidence, Shari Seidman Diamond, Richard Lempert
Articles
Legal scholars and courts frequently write about how scientific evidence is vetted and presented in legal proceedings, but the views of experts themselves have received little attention. Our research aims to fill that gap. This paper reports some of what we learned from a series of surveys we conducted, beginning with a survey in 2016 of scientists who had been elected to membership in the American Academy of Arts and Sciences.3 Subsequent surveys were directed to subscribers of the journal Science who identified as scientists and engineers and to self-identified experts who advertised their availability as experts to lawyers or …

Selected Artificial Intelligence Provisions In U.S. Fiscal Year 2025 National Defense Authorization Act, Bert Chapman
Libraries Faculty and Staff Presentations
The 2025 Fiscal Year National Defense Authorization Act contains multiple provisions relating to artificial intelligence (AI). These congressionally mandated provisions direct various sections of the Department of Defense (DOD) and individual U.S. armed service branches to execute congressional intent for AI policymaking. Examples of such intent include identifying and planning DOD's AI workforce, demonstrating AI biotechnology applications for national security, improving the human usability of AI systems, and establishing an AI security center. This presentation will note that reports on these initiatives must be prepared for relevant congressional oversight committees, and, in many cases, are in many cases, publicly released …

Enhancing Digital Accessibility For Deaf Or Hard Of Hearing Learners- Innovative Strategies For Inclusive Education, Felicia Rutledge Ph.D.
Enhancing Digital Accessibility For Deaf Or Hard Of Hearing Learners- Innovative Strategies For Inclusive Education, Felicia Rutledge Ph.D.
Developmental Disabilities Network Journal
This research-to-practice brief explores innovative strategies to enhance digital accessibility for Deaf or Hard of Hearing (D/HH) learners, focusing on practical applications for inclusive K-12 education. Despite advances in digital learning, D/HH learners face unique barriers due to auditory-centered designs. Accessibility legislation such as the ADA, Section 504, and IDEA mandate educational inclusion for these learners. Key strategies include the integration of assistive technologies (e.g., captioning, ASL video interpretation), the application of the Universal Design for Learning (UDL) 3.0 guidelines, and adherence to WCAG 2.1 principles for accessible content design. The research-to-practice brief provides actionable insights for educators, administrators, and …

Shifting To A Culture Of Inclusion By Design: Applying A Mixed-Methods Approach To Advance Accessibility Of Public Health Emergency Information & Communication Technology, Jessica L. Franks, Erin Vinoski Thomas
Developmental Disabilities Network Journal
Adults with intellectual and developmental disabilities (IDD) experience inequities in access to timely, accurate, and understandable information and communication technology (ICT), which increases risk for public health emergency (PHE)-related health disparities and impedes opportunities to achieve optimal health. This study assessed federal COVID-19 webpage accessibility levels and explored existing knowledge of and experience with filing accessibility complaints for federal ICT among adults with IDD. Through a mixed-methods approach, we evaluated compliance with accessibility standards for 18 federal agencies’ COVID-19 webpages (study 1) and interviewed 16 adults with IDD about experiences accessing federal webpages and filing accessibility complaints (study 2). We …
Inclusive Workforce Development For An Equitable Low-Carbon Transition, Shannon Sanchez-Youngman, Gabriel Pacyniak, Melanie Sayuri Sonntag, Addison Fulton
Inclusive Workforce Development For An Equitable Low-Carbon Transition, Shannon Sanchez-Youngman, Gabriel Pacyniak, Melanie Sayuri Sonntag, Addison Fulton
Natural Resources Journal
The shift to a low-carbon economy will require a massive build out of low-carbon technologies, which in turn will require millions of new laborers with specific skills. Similarly, the decline of fossil-fuel industries will require retraining and new job opportunities for laborers in these fields. At the same time, there is an emerging scholarly focus on a “just transition” to a low-carbon economy. This essay conceptualizes inclusive workforce development as a key component of a just transition. Inclusive workforce development promotes policies that reach and effectively serve the broadest possible range of people and communities. In particular, inclusive workforce development …

Who Owns The Wind: The Absence Of Community Wind Farms In California, Sky Berry-Weiss
Who Owns The Wind: The Absence Of Community Wind Farms In California, Sky Berry-Weiss
Master's Projects and Capstones
Community ownership structures for wind farms have been around for decades, particularly in European countries, due to high socioeconomic benefits. Given these significant benefits, one might expect community wind to thrive in the United States—especially in a state like California, which prides itself on progressive climate policy and renewable energy leadership. Yet utility-scale community wind remains largely absent from research on California’s energy system, raising questions about its existence in the state. To pinpoint how many utility-scale community owned wind farms are in California, this study surveys every operational wind turbine in the state. After classifying each wind farm by …
Reconceptualization Of Corporate Governance For Fintech Firms, Isa Alade
Reconceptualization Of Corporate Governance For Fintech Firms, Isa Alade
Loyola of Los Angeles International and Comparative Law Review
The scandals involving some major fintech firms/platforms such as FTX, Wirecard, Celsius, TerraLuna and Lending Club raise questions about the efficacy of the current corporate governance architecture for fintech firms. Comparing some of the factors that contributed to these recent scandals in the fintech industry against the weaknesses in the corporate governance arrangements for traditional financial firms in the period leading to the global financial crisis (GFC), this paper argues that the unique characteristics of fintech firms amplify some of the weaknesses in the corporate governance arrangements in the financial services industry that contributed to the GFC. The ubiquitous nature …
Law Of Rebuttable Presumptions In Maine, Curtis L. Bourdon
Law Of Rebuttable Presumptions In Maine, Curtis L. Bourdon
Maine Law Review
In Hinds v. John Hancock Mut. Life Ins. Co., the Maine Supreme Judicial Court sought to clarify and simplify the law of rebuttable presumptions as to the quantum of evidence that must be introduced before a presumption is dispelled. The Maine court adopted a rule which states that a presumption is rebutted when the probability of the nonexistence of the presumed fact is as probable as its existence. Stated another way, a presumption is rebutted when the jurors' minds are placed in equilibrium. Ten years later, in State v. O'Clair, the court expressly incorporated the Hinds rule into criminal procedure. …

A State Approach To Effluent Charge, Orlando E. Delogu
A State Approach To Effluent Charge, Orlando E. Delogu
Maine Law Review
Although the concept of effluent charge as a means of dealing with water pollution has been widely discussed in this country for more than a decade and widely used with documented success in parts of Europe for over fifty years, there is a surprising lack of specific material on methods of implementation. We are, after all, a complex society with overlaying levels of government and close working relationships between the public and private sectors of the economy. Furthermore, the statutory, constitutional, and institutional framework of the federal government and that of each state government are different in varying degree from …
Comparative Negligence And Comparative Contribution In Maine: The Need For Guidelines, Maine Law Review
Comparative Negligence And Comparative Contribution In Maine: The Need For Guidelines, Maine Law Review
Maine Law Review
In the recent case of Packard v. Whitten, Maine became the second state to adopt the doctrine of comparative contribution among joint tortfeasors. The decision stressed the point that comparative contribution was merely a logical outgrowth of Maine's Comparative Negligence Statute and that, in particular, the 1969 amendment to that law "would appear to have little purpose except to lay the basis for a comparative contribution." The court concluded that the implementation of this new doctrine would pose no major problems: "More than five years' experience in apportioning causal fault under our Comparative Negligence Law convinces us that this change …
Graduated Responsibility As An Alternative To Current Tests Of Determining Criminal Capacity, Maine Law Review
Graduated Responsibility As An Alternative To Current Tests Of Determining Criminal Capacity, Maine Law Review
Maine Law Review
When a person breaks the law, inquiry may be made into why he acted in an illegal manner and, if he satisfies the relevant test of criminal exculpation, he will be held blameless under the law. Although a range of explanations of behavior is possible, when examining criminal responsibility, the law is concerned only with those excuses which bear on moral culpability. This comment suggests an alternative to the absolutist notion that the defendant is either completely responsible or completely irresponsible for his unlawful act. It is contended that cognitive and volitive capacities exist by degrees and that a fairer, …

Chatgpt Didn’T Write This . . . Or Did It? The Emergence Of Generative Ai In The Legal Field And Lessons From Mata V. Avianca, James H. Curlin Iv
Arkansas Law Review
It’s no secret: Artificial Intelligence (“AI”), for better or worse, is revolutionizing the world. The legal field and legal education at large are not immune to this explosion of possible uses for AI technology. However, as with any technological advancement, AI and Generative Language Models bring with them many challenges, including the implications of their use. One such challenge was vividly presented in the case of Mata v. Avianca, often referred to as “The ChatGPT Case.” Mata is a cautionary tale of the potential missteps that can trip up the unwitting user who naively relies on the lofty promises of …
Recent U.S. Government Policy Literature On Critical And Strategic Minerals, Bert Chapman
Recent U.S. Government Policy Literature On Critical And Strategic Minerals, Bert Chapman
Libraries Faculty and Staff Scholarship and Research
Critical and strategic minerals have become increasingly important in U.S. government civilian and military policymaking in recent years. This is demonstrated by the heavy use of such minerals in many critical civilian and military infrastructures. This work will discuss how this subject has been addressed in laws, presidential documents, and works by government agencies along with congressional oversight committees and support agencies. It will stress how the United States is heavily dependent on strategic minerals from adversarial foreign countries such as China and will examine U.S. efforts to increase its ability to produce such materials in the United States by …
Layered Alignment, Spencer Williams
Layered Alignment, Spencer Williams
The University of New Hampshire Law Review
Most artificial intelligence (ai) researchers now believe that ai represents an existential threat to humanity. The most dangerous threat posed by ai is an issue known as the alignment problem: the risk that a sufficiently intelligent and capable ai system could become misaligned with the goals and values of its human creators and instead pursue its own objectives to the detriment of humanity, including the possibility of extinction. The tension at the heart of the alignment problem is familiar to scholars of agency, contracts, and corporate law, though it goes by a different name: the principal-agent problem. In the traditional …

Generative Ai's Illusory Case For Fair Use, Jacqueline C. Charlesworth
Vanderbilt Journal of Entertainment & Technology Law
Pointing to Authors Guild, Inc. v. Google Inc., Authors Guild, Inc. v. HathiTrust, Sega Enterprises Ltd. v. Accolade, Inc. and other leading technology-driven fair use precedents, artificial intelligence (AI) companies and those who advocate for their interests claim that mass unauthorized reproduction of books, music, photographs, visual art, news articles, and other copyrighted works to train generative AI systems is a fair use of those works. Though acknowledging that works are copied without permission for the training process, the proponents of fair use maintain that an AI machine learns only uncopyrightable information about the works during that process. Once trained, …
Ai Governance: Overcoming Policy Barriers To Fairness And Privacy, Michael Akinwumi
Ai Governance: Overcoming Policy Barriers To Fairness And Privacy, Michael Akinwumi
Connecticut Law Review
Artificial intelligence (“AI”) is increasingly influencing critical sectors such as housing and finance, and raising concerns about fairness, bias, and regulatory compliance. This Essay explores the policy considerations essential for operationalizing AI fairness, particularly in regulated industries. It examines the interplay between algorithmic transparency, privacy, and the responsible use of protected class data under existing legal frameworks such as the Equal Credit Opportunity Act (“ECOA”) and the Fair Housing Act (“FHA”). The Essay identifies key policy gaps and challenges in implementing fairness-enhancing techniques, offering actionable recommendations for policymakers, regulators, and AI practitioners. These recommendations propose a holistic framework that integrates …

Butterfly Effects: Women And Criminal Law, Pavithra Rajendran
Washington International Law Journal
Through a comparative analysis of the criminal laws of Sri Lanka and the United States, this paper examines how Sri Lanka’s legal framework on sexual offenses often hinders women’s access to justice and reinforces systemic gender discrimination. Recognizing the structural constraints inherited from older common law traditions, it underscores the potential for reform through targeted, gradual changes, drawing on developments in modern common law in the United States and relevant international legal standards. The discussion unfolds in three parts: first, a feminist critique of exiting criminal laws in postcolonial; common law systems such as Sri Lanka’s; second, a comparative analysis …
China's Experiment Of Dual-Class Equity Structures: Regulatory Frameworks And Investor Protection, Sang Yop Kang, Terry Ling
China's Experiment Of Dual-Class Equity Structures: Regulatory Frameworks And Investor Protection, Sang Yop Kang, Terry Ling
Washington International Law Journal
Mainland China traditionally upheld the one-share-one-vote (OSOV) principle. Since 2019, however, Chinese authorities have introduced the dual-class equity structure (DCES) for innovative enterprises. Due to investor-protection concerns, China’s DCES operates on a “stringent approval system,” with only eight corporations listed under DCES as of December 31, 2024. This Article provides a comprehensive policy analysis of the Chinese DCES system, including empirical analyses of the eight existing cases. It explores legal and economic aspects of investor protection within China’s DCES, examining “three sets of investor safeguard measures”: (1) “three numerically specified rules” (e.g., 10% equity rule, 10-time voting-right rule, and 2/3 …

Deepfakes On Trial: Developing A High-Accuracy, Court-Admissible Ai Pipeline For Deepfake Detection In Corporate Fraud Litigation, Aiden J. Green
Honors College Theses
As deepfake technology advances, cybercriminals are increasingly using AI-generated videos and audios to impersonate executives and carry out sophisticated CEO fraud schemes. These synthetic forgeries target human trust and corporate communication systems, creating an urgent need for forensic tools capable of authenticating digital evidence with legal accuracy. This thesis presents a forensic-grade AI deepfake detection pipeline designed for this purpose, emphasizing courtroom admissibility, reproducibility, and evidentiary integrity. Built entirely with free, opensource tools, the framework combines metadata analysis, AI-powered spectrogram analysis, neural artifact detection, and facial manipulation recognition into a transparent workflow that accurately identifies synthetic media. It was trained …

The "Not Seen" Effect Of International Financial Centers: Innovation In The Global Financial Ecosystem, Charlotte Ku, Andrew P. Morriss
Faculty Scholarship
International Financial Centers (IFCs) are hubs of legal and financial innovation, developing specialized frameworks that facilitate cross-border investment, enhance global capital mobility, and support economic growth. Through jurisdictional competition, professional clustering, and adaptive regulatory frameworks, IFCs have pioneered legal structures that enable enterprises of all sizes to participate in the global economy. Using case studies of the International Business Company, the Limited Liability Company, the Protected Cell Company, and advances in trust law and applying the theoretical frameworks of social scientist Richard Florida and psychologist Mihalyi Csikszentmihalyi, this Article illustrates how IFCs serve as laboratories for financial experimentation, generating widely …

Political Threads In Legal Tapestry: A Computational Analysis Of Executive Branch Legal Interpretation, 1934–2022, Reilly S. Steel
Faculty Scholarship
How does the push and pull between law and politics shape the work of executive branch lawyers charged with providing “neutral” interpretations of the law? To shed light on this longstanding question, this Article undertakes the first large-scale computational analysis of legal interpretation in the executive branch of the United States federal government. Using a new dataset comprised of the texts of 12,879 pages of opinions issued by the Office of Legal Counsel (OLC) in the Department of Justice (DOJ), I use machine learning methods to explore markers of partisanship and ideology in these high-profile executive branch decisions.
