A Study Of Adoption And Costs Of Nrcs Avoid, Control, And Trap (Act) Agricultural Conservation Practices In Arkansas, Samuel Edward King Aug 2021

A Study Of Adoption And Costs Of Nrcs Avoid, Control, And Trap (Act) Agricultural Conservation Practices In Arkansas, Samuel Edward King

Student Theses and Dissertations

The USDA NRCS provides technical and financial assistance to support farmers and landowners who implement conservation practices through land retirement and cost-share programs. We analyze NRCS cost-shared conservation activities in Arkansas to determine what has been conducted, when it occurred, and what may have led to the adoption of these conservation practices. We investigate temporal trends in conservation adoption based on changes following the 2002 Farm Bill using regression analysis and evaluate spatial hotspots at the HUC-12 watershed scale using the Getis-Ord Gi*. Results suggest that conservation adoption differs regionally by practice type and land use category, and adoptions increase …

Protecting Data Privacy For Mobile Payments Under The Chinese Law: Comparative Perspectives And Reform Suggestions, Robin Hui Huang, Qiang Han, Xiuwen Zhu Aug 2021

Protecting Data Privacy For Mobile Payments Under The Chinese Law: Comparative Perspectives And Reform Suggestions, Robin Hui Huang, Qiang Han, Xiuwen Zhu

Chicago-Kent Journal of Intellectual Property

China has become one of the largest mobile payment markets in the world. While mobile payments bring great benefits such as convenience, flexibility, and efficiency, they are not without risks. This article focuses on one of the major risks, namely the data privacy risk, which is in large part caused and exacerbated by the involvement of multiple players and the extensive collection of personal information. There were some difficulties in protecting data privacy under the traditional legal framework, which was developed in a piecemeal manner with relevant provisions scattered around many different laws. In response, China has been trying to …

Assessing Risk At The National Strategic Level: Visualization Tools For Military Planners, Wade A. Germann, Heather S. Gregg Aug 2021

Assessing Risk At The National Strategic Level: Visualization Tools For Military Planners, Wade A. Germann, Heather S. Gregg

The US Army War College Quarterly: Parameters

The reemergence of great power competition, conflict with near-peer competitor states below the level of armed conflict, and persisting threats from nonstate actors with transnational ambitions and global reach pose challenges for strategists planning, executing, and assessing military operations and strategy. Building on current visualization tools, two proposed models—the National Strategic Risk Abacus and the National Strategic Risk Radar Chart—address these challenges and better depict how the US military may inadvertently contribute to risk at the national strategic level.

The Challenges Of Applying Computational Legal Analysis To Mhealth Security And Privacy Regulations, Brian Tung Aug 2021

The Challenges Of Applying Computational Legal Analysis To Mhealth Security And Privacy Regulations, Brian Tung

McKelvey School of Engineering Graduate Student Theses & Dissertations

As our world has grown in complexity, so have our laws. By one measure, the United States Code has grown over 30x as long since 1935, and the 186,000-page Code of Federal Regulations has grown almost 10x in length since 1938. Our growing legal system is too complicated; it’s impossible for people to know all the laws that apply to them. However, people are still subject to the law, even if they are unfamiliar with it. Therein lies the need for computational legal analysis. Tools of computation (e.g., data visualization, algorithms, and artificial intelligence) have the potential to transform civic …

Autonomy And The Folk Concept Of Valid Consent, Joanna Demaree-Cotton, Roseanna Sommers Aug 2021

Autonomy And The Folk Concept Of Valid Consent, Joanna Demaree-Cotton, Roseanna Sommers

Law & Economics Working Papers

Consent governs innumerable everyday social interactions, including sex, medical exams, the use of property, and economic transactions. Yet little is known about how ordinary people reason about the validity of consent. Across the domains of sex, medicine, and police entry, Study 1 showed that when agents lack autonomous decision-making capacities, participants are less likely to view their consent as valid; however, failing to exercise this capacity and deciding in a nonautonomous way did not reduce consent judgments. Study 2 found that specific and concrete incapacities reduced judgments of valid consent, but failing to exercise these specific capacities did not, even …

Noise Pollution, Patrick Barry Aug 2021

Noise Pollution, Patrick Barry

Law & Economics Working Papers

The authors of Noise: A Flaw in Human Judgment are a trio of intellectual heavy hitters: Nobel-prize winner Daniel Kahneman, constitutional law scholar Cass Sunstein, and former McKinsey consultant (and current management professor) Olivier Sibony. As prolific as they are prominent, the three of them have collectively produced over fifty books and hundreds of articles, including some of the most cited research in social science. If academic publishing ever becomes an Olympic sport, they’ll be prime medal contenders, particularly if they get to compete as a team or on a relay. Their combined coverage of law, economics, psychology, medicine, education, …

Investing And Protection Of Investor In Stock Market, Adler Haymans Manurung Aug 2021

Investing And Protection Of Investor In Stock Market, Adler Haymans Manurung

Indonesian Journal of International Law

This paper discusses three areas, namely investment, investors’ characteristics, and a place of investment, which is stock market. In investing in stock market, investors need to utilize funds which are not currently used so they would not worry about the decrease value that may occur in a short term. Investors need to understand the risks which can be tolerated to invest. On the other hand, investors must be protected to prevent inappropriate transactions. Regulators must endorse rules regularly revised to suit the existing condition that can satisfy many parties.

Growing Climate Solutions Act Of 2021, J. David Aiken Aug 2021

Growing Climate Solutions Act Of 2021, J. David Aiken

Cornhusker Economics

On June 24, 2021, the U.S. Senate adopted S. 1251, the  Growing Climate Solutions Act of 2021. Cosponsored by  54 senators, including Nebraska Senator Deb Fischer, S. 1251 seeks to make it easier for farmers and ranchers to participate in voluntary carbon credit markets and to get a fair share of the carbon credit revenue they generate. If  adopted by the U.S. House of Representatives and signed into law by the President, S. 1251 would go a long way in facilitating effective producer participation in U.S. carbon markets.

Medical Device Artificial Intelligence: The New Tort Frontier, Charlotte A. Tschider Aug 2021

Medical Device Artificial Intelligence: The New Tort Frontier, Charlotte A. Tschider

BYU Law Review

The medical device industry and new technology start-ups have dramatically increased investment in artificial intelligence (AI) applications, including diagnostic tools and AI-enabled devices. These technologies have been positioned to reduce climbing health costs while simultaneously improving health outcomes. Technologies like AI-enabled surgical robots, AI-enabled insulin pumps, and cancer detection applications hold tremendous promise, yet without appropriate oversight, they will likely pose major safety issues. While preventative safety measures may reduce risk to patients using these technologies, effective regulatory-tort regimes also permit recovery when preventative solutions are insufficient.

The Food and Drug Administration (FDA), the administrative agency responsible for overseeing the …

Mitigating The Effects Of Intellectual Property Colonialism On Budding Cannabis Markets, Hughie Kellner Aug 2021

Mitigating The Effects Of Intellectual Property Colonialism On Budding Cannabis Markets, Hughie Kellner

Indiana Journal of Global Legal Studies

Globalization has reduced barriers to trade, communication, and understanding, opening opportunities that extend far beyond national borders. However, in this bounty of opportunity lie obligations, and often those obligations tie a nation's hands when trying to deal with a problem that arises. One obligation nations face is upholding the United Nations' (UN) decision to prevent the illicit use of cannabis. Another is supporting and following the World Trade Organization's (WTO) near elimination of barriers for companies to bring patent and trademark protection with them into any country they do business with. In a modern globalized economy, if a nation fails …

Environmental Rhetoric And An Ecology Of Transcendence: A Rhetorical Criticism Of Awake, A Dream From Standing Rock, Alyssa Kahn Aug 2021

Environmental Rhetoric And An Ecology Of Transcendence: A Rhetorical Criticism Of Awake, A Dream From Standing Rock, Alyssa Kahn

UNLV Theses, Dissertations, Professional Papers, and Capstones

My project blends Burkean theory with Indigenous rhetoric to argue that the counter- story of Awake proposes an ecology of transcendence to make sense of human-nature relationships. I wanted to analyze Awake A Dream From Standing Rock. The documentary is explicitly about Indigenous peoples. This documentary tells the story of the peaceful protests and resistance led by Native people at the Standing Rock Sioux Reservation or Lakota Tribe in North Dakota. The activists were protecting the water otherwise known as water protectors/warriors from the construction of the Dakota Access Pipeline (DAPL). The assembly of DAPL is intended to carry perforated …

Associations Between Exposure To Air Pollution After A Dust Event And Hospitalizations., Estrella De Jesus Herrera-Molina Aug 2021

Associations Between Exposure To Air Pollution After A Dust Event And Hospitalizations., Estrella De Jesus Herrera-Molina

Open Access Theses & Dissertations

The Southwestern region has been identified as one of the most persistent dust producing regions of North America. Exposure to inhalable particulate matter (PM10) originating from desertic landscape during dust events/dust exposures (DEs) can reach hazardous levels. El Paso, Texas’s ambient air has reached hazardous levels of PM10 above 4000 μg/m3 with near zero visibility due to these natural events. There are very few prior studies in the southwestern United States pertaining to the associations between exposure to atmospheric aerosol after DEs and hospitalizations, nor are there many epidemiological studies globally in dusty environments where most of the atmospheric aerosol …

Climate And Transportation Policy Sequencing In California And Quebec, Sonya Ziaja, Mark Purdon, Julie Witcover, Colin Murphy, Mark Winfield, Genevieve Giuliano, Charles Séguin, Colleen Kaiser, Jacques Papy, Lewis Fulton Aug 2021

Climate And Transportation Policy Sequencing In California And Quebec, Sonya Ziaja, Mark Purdon, Julie Witcover, Colin Murphy, Mark Winfield, Genevieve Giuliano, Charles Séguin, Colleen Kaiser, Jacques Papy, Lewis Fulton

All Faculty Scholarship

We compare flexible low-carbon regulations in the transportation sector and their interaction and sequencing with greenhouse gas emissions trading systems in California and Quebec. As momentum builds for greater climate action, it is necessary to better understand how carbon markets and other low-carbon transportation policies influence one another. First, we demonstrate that emissions trading between California and Quebec has been asymmetric, with linking having little influence on carbon prices from California's perspective but leading to a considerable cost reduction from the point of view of Quebec. Second, we present evidence that Quebec has replicated many of California's low-carbon transportation policies …

Decades of research and policy interventions on biodiversity have insufficiently addressed the dual issues of biodiversity degradation and social justice. New approaches are therefore needed. We devised a research and action agenda that calls for a collective task of revisiting biodiversity toward the goal of sustaining diverse and just futures for life on Earth. Revisiting biodiversity involves critically reflecting on past and present research, policy, and practice concerning biodiversity to inspire creative thinking about the future. The agenda was developed through a 2-year dialogue process that involved close to 300 experts from diverse disciplines and locations. This process was informed …

Freedom Of Speech At Ursinus College, Benjamin Henwood

Business and Economics Summer Fellows

Freedom of speech is a hot topic issue on many college campuses across the United States. My research project’s goal is to find out how our community at Ursinus College feels about freedom of speech. My project is going to explore how well Ursinus holds itself to its standards of free and open inquiry and how the students on campus feel about free and open inquiry. In order to understand how the community feels about free speech on our campus, we borrowed a survey from the Foundation of Individual Rights in Education and distributed it to roughly half of the …

Human resources as state capital is determined by the quality of education. In the opening part of the 1945 Constitution, the Indonesian state has chosen one of its country's goals to educate the nation's life. Therefore, the government has the task of providing Guarantees for all citizens to get high-quality education. The constitution must issue a budget of 20% of the total budget (APBN) for the purpose of high quality national education. However, not the results obtained, received in accordance with those produced. Indonesia's PISA score is still far below the average PISA score achieved by OECD member countries. Also …

Gimme A Break: The Patent Term Restoration Act Should Give Environmental Innovators A Chance To Catch A (Cleaner) Breath, Gabrielle Gravel

Journal of Intellectual Property Law

There is an abundance of frightening data painting a grim picture of Earth’s future. Humans have undoubtedly left a carbon footprint so deep, it will take drastic measures to undo our damage. To continue enjoying life as we know it, we humans must shift our focus to the powerful minds of creators and engineers to find ways to untangle our manmade webs. To generate interest and attract the best and brightest to do the challenging and time-consuming work of environmental inventions, the first step is to provide a greater incentive. This note calls upon the U.S. Patent and Trademark Office …

Everyday Aesthetics, Space, And The Sensory: Fear Of Crime And Affect In Inner Sydney, Murray Lee, Jonathan Jackson, Justin R. Ellis

Qualitative Criminology (QC)

"In this paper we explore pre-conscious aesthetic and sensorial aspects of affect in fear of crime. Drawing on data from focus groups undertaken in inner Sydney, Australia, we link the sensory and aesthetic preconditions of fear of crime to its affective, behavioural and cognitive elements. We argue that fear is grounded in the structural, personal and inter-subjective components of individual’s lives and their interaction with physical and social environments, which then influence how individuals cognitively understand their own risks and react behaviourally to these emotional responses. By bringing alive the importance of environmental cues and the cultural and structural positions …

An Economical Method For Securely Disintegrating Solid-State Drives Using Blenders, Brandon J. Hopkins Phd, Kevin A. Riggle

Journal of Digital Forensics, Security and Law

Pulverizing solid-state drives (SSDs) down to particles no larger than 2 mm is required by the United States National Security Agency (NSA) to ensure the highest level of data security, but commercial disintegrators that achieve this standard are large, heavy, costly, and often difficult to access globally. Here, we present a portable, inexpensive, and accessible method of pulverizing SSDs using a household blender and other readily available materials. We verify this approach by pulverizing SSDs with a variety of household blenders for fixed periods of time and sieve the resulting powder to ensure appropriate particle size. Among the 6 household …

Courts Without Cases: The Law And Politics Of Advisory Opinions By Carissima Mathen And Seeking The Court’S Advice: The Politics Of The Canadian Reference Power By Kate Puddister, Jennah Khaled

Osgoode Hall Law Journal

THE REFERENCE POWER HAS, suddenly, become the fascination of the legal academic community in Canada. Two books on the subject were published in 2019 from different and complementary perspectives. Together, they represent a novel inquiry into a power that is exercised differently in Canada than it is in any other country.
