Legal Status Of The Spite Fence In Ohio, Joseph O'Meara, Herman W. Santen Jan 1928

Legal Status Of The Spite Fence In Ohio, Joseph O'Meara, Herman W. Santen

Journal Articles

It is generally assumed, on the authority of Letts v. Kessler, that spite fences in Ohio are within the law. In two cases language has been used indicating an adherence to the obsolescent view that spite fences may be erected with impunity, but in neither case was the question before the court for decision, so that what was said must be classed as dicta. This, then is the situation: there is not a single decision in the last twenty-one years supporting the rule of Letts v. Kessler. A careful reading of the opinion in Letts v. Kessler will show that …

Juristic Idealism And Legal Practice, Joseph H. Drake Apr 1927

Juristic Idealism And Legal Practice, Joseph H. Drake

Michigan Law Review

The leading exponent of juristic idealism in Germany is Rudolf Stammler, Professor in the University of Berlin. He is uncompromising in his idealistic theory. He even resents being called a pragmatic idealist, possibly lest the chameleon like connotation of this word might seem to detract in any way from the absolute character of his conception of the idea. He is to be thought of rather as the third of that great triumvirate of juristic idealists; namely, Socrates-Kant-Stammler. It is then rather a curious phenomenon that wl1en his juristic philosophy is transplanted to alien soil, it is the pragmatic element in …

Law Of Zoning In Missouri, The, Frederick V. Wells May 1926

Law Of Zoning In Missouri, The, Frederick V. Wells

University of Missouri Bulletin Law Series

The term "Zoning" is used in this article only in its broad sense to mean a comprehensive scheme for the districting of a city by law to accomplish certain ends. Zoning for cities has been defined as: "The creation by law of districts, in which regulations, differing in different districts, prohibit injurious and unsuitable structures and uses of structures and land." The zone plan helps to coordinate the various parts of the city plan in accordance with a predetermined city-wide scheme for development.3 It is in the essence the exercise of the community right to regulate to a limited degree …

The Technique Of Judicial Appointment, Harold J. Laski Apr 1926

The Technique Of Judicial Appointment, Harold J. Laski

Michigan Law Review

It is difficult to overestimate the significance of the judiciary in the modern state. The work of the executive has become so vast, the powers delegated to it by the legislature are so wide, that judges are, perhaps more than at any previous time, the real safeguard of personal liberty. It is only necessary to recall cases like Coppage v. Kansas, or R. v. Halliday, to realize how nearly judicial activity goes to the very heart of freedom. That is, of course, even more the case when, as with America, the constitution of the state is written, and …
