Labor And The Secondary Boycott, Robert C. Barnard, Robert W. Graham Jul 1940

Labor And The Secondary Boycott, Robert C. Barnard, Robert W. Graham

Washington Law Review

Advisedly has the "boycott"' been characterized as "a chameleon that is impossible of definition." Only the epithet "secondary boycott has perhaps occasioned more intricate judicial gymnastics. Justice Steinert, writing for the Washington Supreme Court, has recently observed with perspicacity that "the term 'secondary boycott' is of somewhat vague signification and has no precise and exclusive denotation." In the field of labor relations, as in other branches of the law, bench and bar have leaned on the comforting pillar of "lump concept" thinking which has more than once done yeoman's service for judicial reasoning and analysis. Truly has there been more …

Future Interests - Class Gift - Distribution Where Fund Is Insufficient To Give Specified Sum To Each Intended Member - Closing Of Class, James D. Ritchie

Michigan Law Review

To each grandnephew and grandniece, "now living or hereafter born during the continuance of this trust" (which was not to last longer than "twenty years after the death of the survivor" of testator's nephews and nieces), there was to be paid from a trust of the residue of the estate $2,000 "as each shall arrive at the age of twenty-five," "as his or her absolute property." At testator's death thirteen nephews and nieces, ranging from nineteen to fifty-five years of age, and nineteen grandnephews and grandnieces, from two months to thirty-two years, were living. Four of the latter group, who …

University Of Richmond Bulletin: The T.C. Williams School Of Law In The University Of Richmond Catalogue Of 1939-1940, University Of Richmond

Law School Catalogues

A Law School was first established in Richmond College in 1870. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to the T. C. WILLIAMS SCHOOL OF LAW. At various times the School has received further generous gifts from members of the family of Mr. Williams. The largest of these gifts came through a bequest from Mr. T. C. Williams, Jr., who like his father, was …

Inconsistencies In Public Utility Depreciation: Deduction Of Depreciation For Rate Base Purposes, Robert D. Haun

Michigan Law Review

When considering depreciation for rate base purposes the courts and the commissions speak of accrued depreciation, existing depreciation, actual depreciation, complete depreciation, realized depreciation, incomplete depreciation, and observed depreciation. Accrued, existing and actual depreciation all have the same meaning.

Woe Unto You Lawyers: A Review, Max Radin Feb 1940

Woe Unto You Lawyers: A Review, Max Radin

Michigan Law Review

The blurb on the cover twice calls this book a "lusty, gusty attack on The Law." No writer can be held responsible for the blurbs with which his book is commended to the public by those whose business it is to sell it. But many who read it--there will undoubtedly be many--will do so in the hope that it is precisely what the cover describes, since lusty, gusty attacks on anything make juicy reading and law and lawyers have been fair game almost ever since either word became a term of common speech. Professor Rodell's title is taken from the …

A Lawyer Looks At Liberty, Clarence Emmett Manion Jan 1940

A Lawyer Looks At Liberty, Clarence Emmett Manion

Journal Articles

The Law has been defined as "The Perfection of Human Reason." This, of course, is a highly idealized definition. The Law often falls short of perfect reasonableness. Nevertheless reason and logic constitute the warp and woof of the whole fabric of our jurisprudence. In the strict determination and application of the Law, emotion-the natural enemy of reason-plays not part at all. In the courtroom, oratorical pyrotechnics are seldom permitted to obscure the real points that are at issue in a particular case. The trial of a lawsuit is predicated upon the pleadings and the art of formal pleading is as …
