Taxation-Technical Changes Act Of 1949-"Possession Or Enjoyment" Clause Of I.R.C. 811 ( C), Paul A. Anderson S.Ed., Stephen A. Bryant S. Ed. Mar 1950

Taxation-Technical Changes Act Of 1949-"Possession Or Enjoyment" Clause Of I.R.C. 811 ( C), Paul A. Anderson S.Ed., Stephen A. Bryant S. Ed.

Michigan Law Review

For the past decade Congress has been urged to define specifically the scope of I.R.C. 811(c), which subjects to the estate tax an inter vivas transfer intended to take effect in possession or enjoyment at or after the donor's death. Until 1949 proposed amendments were largely directed at legislative rejection of the doctrine of Helvering v. Hallock, but with the decisions in the Church and Spiegel cases last year, it became apparent that more extensive revision and clarification was needed. Sections 7 and 8 of the Technical Changes Act of 1949, which became law on October 25, 1949, represent …

Mimeograph 6209 And The Ceiling On Bad-Debt Reserves For Banks, Joseph O'Meara

Journal Articles

Instead of deducting "debts which become worthless" taxpayers may deduct "a reasonable addition to a reserve for bad debts." "Prior to the publication of [Mimeograph 6209 on December 8, 1947] it was the consistent position of the Bureau [of Internal Revenue] . . . that deductions for additions to bad debt reserves were allowable in amounts sufficient to bring such reserves up to a measure of the bad debt risk at the close of each taxable year based solely on the facts and circumstances at such time." In practice a reserve for bad debts was limited in amount to the …

The Unwary Purchaser In Unfair Trade Cases, Julius R. Lunsford Jr. Dec 1949

The Unwary Purchaser In Unfair Trade Cases, Julius R. Lunsford Jr.

Mercer Law Review

In cases involving the sale of real estate, the legal maxim "Caveat Emptor" (Let the buyer beware) is applicable. In sales of personal property substantially the same rule applies.' The buyer in unfair trade cases is not confronted with such a burden and assumes the status of a "bona fide purchaser for value" in its true and literal meaning. Generally speaking courts do not decide unfair trade cases by the caveat emptor rule of buyer and seller.
