Justice Story On The Common Law Of Evidence, John C. Hogan Dec 1955

Justice Story On The Common Law Of Evidence, John C. Hogan

Vanderbilt Law Review

In our system of jurisprudence it is the province of the jury to decide all matters of fact. The trial is held and the verdict of the jury is delivered in the presence of a judge who is bound to decide matters of law which arise in the course of the trial. Whenever a thing offered as proof is questioned as not proper to go before the jury as evidence, that question is to be resolved by the judge, and unless he permits it to be introduced as evidence at the trial, it can not legally come to the consideration …

Evolution Of Legislation On Proof Of Title To Land, R. G. Patton Aug 1955

Evolution Of Legislation On Proof Of Title To Land, R. G. Patton

Washington Law Review

Possessory titles are recognized by the courts when they protect a first trespassing squatter against acts of a subsequent trespasser. They are given priority over the claims of the conventional title holder when the latter has lost his right to judicial assistance by reason of acts which raise an estoppel or for failure to act within a period of time which the courts or the legislature have fixed as a limitation of action. In these cases the holder of the possessory title may by court action secure a documentary title in the form of a judgment which confirms a title …

Evidence Of Speed—Highway Radar, Sally Campbell Feb 1955

Evidence Of Speed—Highway Radar, Sally Campbell

Washington Law Review

The problem of the highway speeder is almost as old as the automobile itself. With this problem came two others—one, the detection of the speeding motorist, and two, the use of the means of detection as evidence in convicting the offender. Through the years many devices have been invented to determine the speed of an automobile. Some of these have succeeded m the courtroom and are still used; others have been determined inadmissible in evidence. Some of the means most commonly used at the present time met with difficulty at first and in some instances are still not enough in …

The Coverage Of Unemployment Compensation Laws, Alanson W. Willcox Feb 1955

The Coverage Of Unemployment Compensation Laws, Alanson W. Willcox

Vanderbilt Law Review

The federal tax which induced the states to enact unemployment compensation laws set a pattern of coverage which the states were under pressure to meet, but which they were wholly free to exceed. With notable exceptions, state coverage is shaped to conform with federal law. In this matter, indeed, federal leadership is so far accepted that the charge of federal "dictation" has not, as it has in other aspects of unemployment compensation, prevented some expansion of the system by federal initiative.

Coverage of the Federal Unemployment Tax Act starts with the concept of "employment" as the determinant of tax liability, …

The Guaranteed Annual Wage And Unemployment Compensation, Ernest J. Eberling Feb 1955

The Guaranteed Annual Wage And Unemployment Compensation, Ernest J. Eberling

Vanderbilt Law Review

The recent demands of the CIO unions for the guaranteed annual wage have aroused considerable interest in this issue among those concerned with labor-management relations. Several factors have accentuated this interest. First, during 1954 when these demands were being pressed with considerable vigor, a recession had developed, resulting in a considerable increase in unemployment levels. Second, these demands were made on mass production industries manufacturing durable goods which are subject to wide variations in demand and output during periods of cyclical change. Third, the recent proposals are taking a form quite different from the existing plans, namely, they propose an integration …
