Report Of The Judicial Council On Expediting The Work Of The Supreme Court, Alfred J. Schweppe

Washington Law Review

The problem is the work load of the supreme court. According to the two most recent chief justices, Judge Hamley who has just left the rostrum, and Judge Donworth, who is here in the audience, the Supreme Court of the State of Washington is falling rather rapidly behind. In the May term of this year it was impossible for the court to set all of the cases that were ready for assignment. In the September term many cases now ready for assignment will go unset and cannot be set until the January term and the backlog of cases is increasing. …

Corporations - Statutes Providing For Both Cumulative Voting And Classified Boards, David W. Swanson S.Ed. Nov 1956

Corporations - Statutes Providing For Both Cumulative Voting And Classified Boards, David W. Swanson S.Ed.

Michigan Law Review

The shareholders of the Winous Company amended the articles of incorporation to provide for staggered elections whereby one of the three directors would be elected each year to serve a three-year term. The Ohio Code provides for classified boards, and contains a guarantee of the right to vote cumulatively which is not to be restricted by the articles of incorporation. The county court of appeals reversed the court of common pleas and held the amendment invalid because it nullified the right to vote cumulatively. They interpreted the cumulative voting provision as specific and therefore a limitation on the more general …

State And Local Taxation -- 1956 Tennessee Survey, Paul J. Hartman Aug 1956

State And Local Taxation -- 1956 Tennessee Survey, Paul J. Hartman

Vanderbilt Law Review

As indicative of the growing importance to the bench and bar of state and local taxation, the Tennessee Supreme Court was called upon to decide three significant tax cases during the period covered by this survey article. During this period, objecting taxpayers spear-headed vigorous assaults against various privilege taxes on commerce and due process clause grounds.

Social Interest In Rate Regulation In West Virginia, Karl P. Warden Jun 1956

Social Interest In Rate Regulation In West Virginia, Karl P. Warden

West Virginia Law Review

The purpose of this paper is to attempt to throw some small light upon the hitherto relatively unexplored and uncharted field concerning the desire of the State of West Virginia, through its Supreme Court of Appeals and its Public Service Commission, to act as a guardian of the social interests of the state and its people. This discussion will be limited in its scope to the determination of whether these two bodies have ever considered such social interests when determining the reasonableness of the rates to be charged to patrons by the public utilities in this state.

The Martial Deduction And Equalization Under The Federal Estate And Gift Taxes Between Common Law And Community Property States, Paul E. Anderson Jun 1956

The Martial Deduction And Equalization Under The Federal Estate And Gift Taxes Between Common Law And Community Property States, Paul E. Anderson

Michigan Law Review

In 1948, as the culmination of much dissatisfaction with the treatment of community property under the federal estate and gift tax laws, Congress adopted a new formula for the treatment of gifts and bequests between spouses; this formula was known as the marital deduction. It has remained practically unchanged since its adoption and still stands as an integral part of our federal estate and gift tax structure.

The basic purpose of the deduction was to provide equalization in estate and gift tax treatment between spouses residing in community property states and those residing in common law property states. The plan …

Consideration Of Tax Aspects In Awarding Damages For Personal Injuries, Doris B. Gorman Apr 1956

Consideration Of Tax Aspects In Awarding Damages For Personal Injuries, Doris B. Gorman

Vanderbilt Law Review

The recent decision of the House of Lords, in British Transport Commission v. Gourley has completely changed the English position on the question of whether income taxes should be considered in determining personal injury damages based on actual or prospective loss of earnings. The House of Lords held that the lower court should have taken the tax aspects into account and that the damage award must be reduced accordingly. By this holding, the House of Lords overruled Jordan v. The Limmer And Trinidad Lake Asphalt Co. and Billingham v. Hughes, which until then represented the ruling law in England on …
