Cost Adjustment In Utility Rate Schedules, Joe H. Foy Jun 1960

Cost Adjustment In Utility Rate Schedules, Joe H. Foy

Vanderbilt Law Review

For many years public utilities and regulatory commissions have been greatly concerned over the time and expense involved in proceedings relative to utility rates. Few types of legal proceedings are more complex, intricate and expensive than the full-blown utility rate case, with its myriad problems in valuation, economics, accounting, law and engineering. Particularly during inflationary periods, such as the present, mounting expenses of operation confront utilities and commissions with the dismal prospect of repeated applications for rate adjustment and formal hearings thereon. It is not surprising that techniques have been sought to simplify the rate making process, consistent with the …

Non-Tax Aspects Of Thin Incorporation, Thomas H. Rainey Jr. Jun 1960

Non-Tax Aspects Of Thin Incorporation, Thomas H. Rainey Jr.

Vanderbilt Law Review

The coveted privilege of conducting business in the corporate form is not an unconditional grant.' As consideration for granting the corporate privilege of doing business with limited liability, the law requires that the shareholders "put at the risk of the business some stake which shall appear reasonably adequate for its prospective needs." This "stake," characterized as equity capital, represents that portion of the shareholders' capital investment which is required by law as the basis of financial responsibility for the protection of corporate creditors. This special fund is substituted for the personal liability which the participants would otherwise have for the …

Some Observations On The Law And The Nature Of The Judicial Process, Robert C. Finley Mar 1960

Some Observations On The Law And The Nature Of The Judicial Process, Robert C. Finley

Washington Law Review

My purpose in mentioning some of these developments is to point out and to emphasize that the most constructive changes have occurred (1) in the field of procedural law, and (2) in judicial administration. The latter term of course largely refers to methods or mechanics for expediting and handling the business of the courts. The one significant area wherein we have lagged the most is in the field of substantive law evaluation, revision, and improvement.

The Divorce Act Of 1949—One Decade Later, Luvern Rieke Mar 1960

The Divorce Act Of 1949—One Decade Later, Luvern Rieke

Washington Law Review

In the legislative session of 1949 a new divorce law was enacted. Proposed departures from the existing act had been reported to the State Bar Association. The objectives and contemplated effects of the new legislation were discussed in an article immediately after the act was adopted. Trouble was predicted Today, with ten years of experience under the act and in light of 172 reported opinions dealing with it, it seems appropriate to see what has occurred. The objective of this review is to identify, by placing together the related decisions of the Washington court, trends which have appeared and significant …

Torts - Wrongful Death - Expected Inheritance As An Element Of Damages, James Cripe Feb 1960

Torts - Wrongful Death - Expected Inheritance As An Element Of Damages, James Cripe

Michigan Law Review

Plaintiff, the widow of a railroad employee who was killed as the result of the defendant's negligence, instituted this action under the Federal Employers' Liability Act to recover damages for his death. The lower court in awarding a judgment refused to include the plaintiff's expectancy of inheritance in the measure of damages. On appeal, held, reversed. The expectance of an inheritance from the deceased is a pecuniary benefit which the beneficiary of the action might reasonably have received if the deceased had not died of his injuries. Martin v. Atlantic Coast Line Railroad Company, (5th Cir. 1959) 268 …

Bid Depositories, George H. Schueller Feb 1960

Bid Depositories, George H. Schueller

Michigan Law Review

The decision by the United States District Court for the Southern District of California in the civil antitrust case of United States v. Bakersfield Associated Plumbing Contractors, Inc. brought in its wake considerable renewed interest, discussion, and activities concerning "bid depositories." This is apparent from the trade press and from inquiries reaching the Antitrust Division, including a number of requests for clearance of bid depository plans through so-called "railroad release" procedures. Even more recently, institution of the civil and criminal antitrust cases of United States v. Arizona Masonry and Plastering Contractors' Association provided further stimulation. The term "renewed" interest and …
