On Charting A Course Through The Mathematical Quagmire: The Future Of Baker V. Carr, Jerold H. Israel

The Tennessee reapportionment decision, Baker v. Carr,' has been popularly characterized as one of the "very few judicial decisions which have fundamentally reshaped our constitutional system."'2 Newspaper and magazine commentators generally have predicted that the decision of last March is likely to "change the course of our history" by producing a drastic alteration in the balance of power on the state political scene.3 While this end may be desirable,4 any such estimate of the future impact of the Baker decision, at least insofar as its legal consequence is concerned,5 seems not only premature but somewhat exaggerated. The future significance of …

Law And History, C. J. Friedrich
Law And History, C. J. Friedrich
Vanderbilt Law Review
Law is frozen history. In an elementary sense, everything we study when we study law is the report of an event in history, and all history consists of such records or reports. It therefore cannot be my task to develop a sermon on the importance of historical records for the understanding of the law; the tie is too intimate and too obvious to need laboring." The work of Professor Maine on 'Ancient Law,'" wrote Professor T. W. Dwight in his Introduction to that book in the sixties of the last century, "is almost the only one in the English language …

Real Property -- 1961 Tennessee Survey, Thomas G. Roady, Jr.
Vanderbilt Law Review
Probably no area of the law is fraught with more confusion than that involving construction of clauses in deeds and wills which impose some restraint on the conduct of grantees or devisees- seemingly not in the best interest of society. Clauses which tend to deter grantees or devisees from marriage or remarriage have constituted a fertile source of litigation for centuries. And though the stated rules of law prohibit and restrict the use of marriage or remarriage as a condition to vest or divest interests in real property, there are very few cases in which the courts in this country …

The Moment Of Truth: Probability Theory And Standards Of Proof, V. C. Ball
The Moment Of Truth: Probability Theory And Standards Of Proof, V. C. Ball
Vanderbilt Law Review
Specialists in all the fields involved agree that the process of proof and persuasion in judicial proceedings presents problems in the application of probability theory and communication theory. When the broader term "information" is used, the problems coalesce, both in judicial trials and in other human affairs. In jury trials, one focus of this coalescence is the formulation for the jury of issues of fact to be decided by them, and their progress to verdict or disagreement.
Although Cicero asserted that probability is the very guide of life, and Thomas Jefferson thought mathematical reasoning and deductions were a fine preparation for …

Taxation - Federal Income Tax - Published Opinions Of The New Tax Officialdom: A Review, David G. Hill S.Ed.
Michigan Law Review
President John F. Kennedy has appointed as his principal tax officials two men who have long been on record as proponents of tax reform. This comment is a collection and, to a small extent, an analysis of the opinions found in their published statements on taxation. Stanley S. Surrey, fifty-year-old Assistant Secretary of the Treasury for Tax Policy, first served with the Treasury Department in 1937. He was Tax Legislative Counsel from 1942 to 1947 and later served as Special Counsel to the House Ways and Means Subcommittee on Administration of the Revenue Laws. He also has served as Reporter …
