The Appellate Judiciary Of Georgia And Contempt Out Of Court, D. Greir Stephenson, Jr. Jan 1968

The Appellate Judiciary Of Georgia And Contempt Out Of Court, D. Greir Stephenson, Jr.

Georgia Law Review

TO state the obvious, contempt of court is a broad topic, and this article is not the place for an exhaustive treatment of the various types of contempt-civil and criminal, direct and indirect. Instead, the focus is on one variety of indirect or constructive contempt: that arising from criticism of a judge, spoken or written outside the courtroom. To limit the subject in such a way precludes discussion of other inter- estng aspects of contempt law, but perhaps the advantages gained from sharp perspective and clear concentration more than offset the disadvantages incurred from a narrowed concern. The law of constructive …

Electoral College - Its Defects And Dangers, The, John D. Feerick

Faculty Scholarship

In a few months we will witness the operation of the electoral college system of electing the President and Vice President of the United States. Due partly to the appearance of George C. Wallace's American Independent Party,' the 1968 election could be decided in the House of Representatives, where each state has one vote regardless of its population. The election seems certain to point up the perils in our present system. Although our system of electing the President is now under scrutiny by Congress, reform does not appear imminent. As in the case of presidential inability, a tragedy or near …

Psychiatric Testimony, Trial Gamesmanship And The Defense Of Insanity, Stanley E. Willis, Ii Jan 1968

Psychiatric Testimony, Trial Gamesmanship And The Defense Of Insanity, Stanley E. Willis, Ii

San Diego Law Review

It is the thesis of this Article that the insanity defense with its use of psychiatric testimony is often prejudicial to the criminal defendant. The issue of the defendant’s sanity puts antagonistic propositions into motion which require proof by evidence. If the defendant’s purported insanity were not put in issue by the defense counsel then the prosecutor’s negative assertions that the defendant was sane would not be permissible. Numerous elements are automatically assumed as mitigating factors in many trials (e.g., passionate response to produced anger and desperation and despair), and operate subliminally to influence the judge and the jury. The …

Control Of Air Pollution Through The Assertion Of Private Rights, Julian Conrad Juergensmeyer Dec 1967

Control Of Air Pollution Through The Assertion Of Private Rights, Julian Conrad Juergensmeyer

Duke Law Journal

Air pollution is clearly one of the major social problems confronting contemporary American society. Yet the United States is still without an effective federal pollution control program, and those state and local control programs that do exist are largely ineffective. Until government regulation is able to keep the expulsion of air contaminants within tolerable limits, it will be necessary for those seeking to control air pollution to rely upon the assertion of private rights. In this article the author discusses the principal causes of action available to the private pollution controller, and concludes that, although traditional legal concepts may provide …

Learned Treatises As Direct Evidence: The Alabama Experience Dec 1967

Learned Treatises As Direct Evidence: The Alabama Experience

Duke Law Journal

A majority of American jurisdictions refuse to permit the use of learned treatises as direct evidence, reasoning that to do so would violate the rule against hearsay evidence. However, many commentators have contended that, in adopting such a position, these courts have failed to consider the underlying purposes of the hearsay rule. Alabama, which has permitted the introduction of treatises as direct evidence, affords a useful contrast for testing both the rationale of the majority rule and the criticisms of it. It has been the goal of this comment to evaluate the present majority view against the Alabama experience. On …

Regulation Of Finance Charges On Consumer Instalment Credit, Robert W. Johnson Nov 1967

Regulation Of Finance Charges On Consumer Instalment Credit, Robert W. Johnson

Michigan Law Review

The subject of adequate disclosure of finance charges in consumer credit transactions has, in recent years, "become a rallying point for consumers and a battle line for industry." Equal heat is generated by discussions concerning the regulation of finance charges on consumer instalment credit. The aim of this article is to examine briefly the existing pattern of rate regulation and then to explore the purposes of ceilings on consumer finance charges and the problems involved in their design. As is true with the question of disclosure of finance charges, the problems are extremely complex. Men of good will on both …

The Antidumping Act And The Future Of East-West Trade, Peter Buck Feller Nov 1967

The Antidumping Act And The Future Of East-West Trade, Peter Buck Feller

Michigan Law Review

Because of the peculiarities of price formation in Communist countries, both with regard to export commodities and those intended for domestic consumption, the applicability of traditional antidumping concepts to communist price discrimination, and the usefulness of the Antidumping Act of 1921 in coping with it, are questions which should be examined and resolved before moves toward freer trade between East and West reach full stride. The essence of the problem was captured in a 1963 statement by the then Senator Humphrey: "The present act is ineffective in preventing dumping from communist countries, which can control their home prices by state …

Income Tax Allocations And Dividends Under The Model Business Corporation Act, Michael D. O'Keefe Jun 1967

Income Tax Allocations And Dividends Under The Model Business Corporation Act, Michael D. O'Keefe

Washington Law Review

Modern dividend statutes, as exemplified by the Model Business Corporation Act, have incorporated many accounting terms. For aid in the complex process of construing such statutes, the courts and commentators have turned to generally accepted accounting principles. Although accounting principles may be helpful in statutory interpretation, they are not determinative. The accounting attitude toward a transaction must still be correlated with the dividend policies inherent in the statute.

Evidence: Admission Of Mathematical Probability Statistics Held Erroneous For Want Of Demonstration Of Validity

Duke Law Journal

In State v. Sneed the New Mexico Supreme Court limited its disapproval of evidence of probability statistics to the particular facts presented but failed to articulate specific safeguards for subsequent use of such evidence. This note explores the nature of probability statistics, their potential utility in a legal context, and criteria by which their admissibility might be determined.
