Systematic Exclusion Of Negroes From Selective Service Boards: Some Proposals For Reform, Michigan Law Review Feb 1969

Systematic Exclusion Of Negroes From Selective Service Boards: Some Proposals For Reform, Michigan Law Review

Michigan Law Review

The concept of the local draft board is based on the theory that selection of persons for compulsory military service can be accomplished most fairly by small groups of neighbors of those who are to serve. As the National Office of the Selective Service recently stated: "Because of its comparatively long association with a registrant and knowledge of what he has done, the local board is relatively well qualified to evaluate his ability to perform," A corollary to this basic theory is that a more flexible selection process evincing greater sensitivity to the problems of individual registrants can be achieved …

Damage Measures And Economic Rationality: The Geometry Of Contract Law, Robert L. Birmingham Feb 1969

Damage Measures And Economic Rationality: The Geometry Of Contract Law, Robert L. Birmingham

Duke Law Journal

The question of damage measures presented by the conscious decision of a promisor to breach a losing contract raises one of the most perplexing conceptual problems in contract law. Recognizing the present inability of the courts rationally to resolve the problem, as illustrated by the opposing decisions in Groves v. John Wunder Company and Peevyhouse v. Garland Coal and Mining Company, the author undertakes to examine the premises of contract law with a fresh perspective-economic analysis.

Vietnam And Public International Law, Anthony D'Amato Jan 1969

Vietnam And Public International Law, Anthony D'Amato

Faculty Working Papers

With each international crisis inevitably come the selfstyled "realists" proclaiming that there is no such thing as public international law. The Vietnam war is no exception, although here, due to the unusual complexity of the facts and the controversy over the applicable rules of international law, many of the published replies to the "realist's" positions have themselves been insubstantial and unconvincing. Let us look first, briefly, at the arguments of one of the realists, and then, with equal brevity, at some of the counterclaims. The remainder of this comment will be addressed to the larger issues involved and some suggested …

General Statement:

The Law School was established as a part of Richmond College in 1870. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to The T. C. Williams School of Law. At various times the School has received further generous gifts from members of the family of Mr. Williams. A substantial gift came through a bequest from Mr. T. C. Pennsylvania Experiment In Due Process, Marian Schwalm Furman, James A. Conners Jr.

Duquesne Law Review

The purpose of this paper is to present and describe a unique legislative prescription, an untried approach to the long-standing and vexing problem of insuring that each patient confined in a public mental institution will be insured at least a minimum standard of treatment. Such legislation, embodying the concept of state responsibility for treatment and offering a method for assumption of that responsibility, has been introduced in the 1969-1970 Pennsylvania legislative session.

Patents - Patentable Subject Matter, E. Kears Pollock Jan 1969

Patents - Patentable Subject Matter, E. Kears Pollock

Duquesne Law Review

The Court of Customs and Patent Appeals has held that the mere fact that elements of a claimed method for the reduction of data may be accomplished using the mind or a general purpose digital computer properly programmed does not invalidate the claim as a process within the meaning of 15 U.S.C. § 101. The court has further raised substantial doubt as to the unpatentability of "mental step" claims generally and has applied the distinction of functions occurring in nature being accomplished by methods outside nature to mental functions.

In re Prater, United States Court of Customs and Patent Appeals, …

Collective Bargaining Without Work Stoppage?, Alvin L. Goldman

Law Faculty Scholarly Articles

Legal institutions have provided us with numerous spectator sports. The jury trial and its predecessors, including trial by combat, are obvious examples. In the mid-nineteenth century, arguments before the Supreme Court of the United States occasionally attracted crowds of spectators and captured the front pages of the yellow press. In more recent times, proxy fights have been rumored to provide action for the bookmaking set and televised legislative investigations have won top-viewer ratings. Among the perennial spectator sports provided by our legal institutions over the past half-century or more has been the confrontation of labor and management across the collective …

Reapportionment--Legislative Bodies--Significant Deviation From Standard Of Substantial Population Equality Of State Legislative Districts Is Permissible To Provide Representatives For Two Island Counties--Vigneault V. Secretary Of The Commonwealth, Michigan Law Review Jan 1969

Reapportionment--Legislative Bodies--Significant Deviation From Standard Of Substantial Population Equality Of State Legislative Districts Is Permissible To Provide Representatives For Two Island Counties--Vigneault V. Secretary Of The Commonwealth, Michigan Law Review

Michigan Law Review

Since Baker v. Carr, when the Supreme Court overruled a long line of earlier decisions and concluded that the relationship of the equal protection clause to a state's power to create geographical districts for legislative representation was a justiciable issue, state apportionment plans have come under increasing judicial scrutiny. In Gray v. Sanders, the Court held invalid a Georgia primary election plan which favored voters from rural areas. Although Gray dealt with the dilution of individual voting rights rather than legislative reapportionment, it is important as the first enunciation of the now-famous "one man-one vote" test. Specifically, the …

The Effect Of A Large Reservoir On Local Government Revenue And Expenditure, Clyde T. Bates Jan 1969

The Effect Of A Large Reservoir On Local Government Revenue And Expenditure, Clyde T. Bates

KWRRI Research Reports

Development of a large multi-purpose reservoir within the area of their jurisdiction may affect property ta.x revenue and expenditure of county governments and school districts. Privately owned land sold to a federally sponsored reservoir is not subject to property taxes because of the doctrine of intergovernmental immunity. Local officials often assume that this loss of assessment will reduce their tax revenue and thereby their fiscal ability to provide an acceptable level of government services. They may also expect the influx of construction workers or the disruption of existing facilities to increase the cost of providing these services. The study approaches …
