The Amending Of Articles 23 And 27 Of The United Nations Charter: A Mathematical Analysis, Robert S. Junn

Vanderbilt Journal of Transnational Law

From the time of the San Francisco Conference, the composition of the Security Council and its voting procedure was most severely criticized. The basic criticism had been the veto power of the five permanent members on substantive resolutions. This resulted in a long and vigorous political struggle on the part of the non-veto members of the Organization to amend the Charter in order to increase their voting strength in the Security Council. When the changes on membership and voting procedure came into force on August 31, 1965, a great victory was claimed. This case of the United Nations is intriguing …

The Generality Of Neutral Principles: A Game-Theoretic Perspective, Robert L. Birmingham Jan 1970

The Generality Of Neutral Principles: A Game-Theoretic Perspective, Robert L. Birmingham

Articles by Maurer Faculty

Eleven years ago Professor Wechsler first argued that constitutional adjudication should be based on neutral principles of general applicability that transcend the factual contexts of the cases in which they are announced. Since that time, legal scholars have been engaged in a continuing debate over both the meaning and the validity of Wechsler's thesis. Professor Birmingham adds a new perspective to this debate by analyzing neutrality and generality in terms of game theory.

Psychology And The Criminal Law, Paul E. Meehl Jan 1970

Psychology And The Criminal Law, Paul E. Meehl

University of Richmond Law Review

The two opposite errors a lawyer may make in evaluating the social scientist's contribution to law are to be overly critical and hostile, or to be unduly impressed and uncritically receptive. I have seen examples of both mistakes. The extreme form of the first attitude is shown by the lawyer who frankly believes that psychology, psychiatry, and sociology are mostly "baloney," pretentious disciplines which have abandoned common-sense knowledge of human life but whose claim to have substituted scientific knowledge is spurious. I would like to believe that this hostile attitude is always based upon misinformation or ignorance; but unfortunately, if …

Metaphysics And Law, Roy L. Stone-De Montpensier

Duke Law Journal

The dichotomy between questions of fact and questions of law serves as a starting point for the following discussion of the nature of legal reasoning. In the course of the dialogue the author notes similarities and dissimilarities between legal reasoning and philosophical and mathematical reasoning. In the end we are left with a clearer insight into the distinctive features of the adjudicative process.
